We have revised the Melrose Subdivision plat to include three signatures blocks, one for
each owner. In addition, I have removed a proposed 30' public utility easement along
Jones Butler which was meant to be the relocation point for the City of Bryan electrical
line which currently runs through our site. At this time, we have not been able to reach
an agreement with the City of Bryan as to the location of the new easement. Therefore,
we will add it by separate instrument at a later date. The plat is currently circulating to
each owner for approval and notarization.

Please accept the attached final plat application and fee as our submittal package. for the
proposed Melrose Subdivision. We are submitting the final plat at this time in order to
try and meet the August 15th deadline for Planning and Zoning Commission. The
accompany infrastructure .plans will be submitted shortly in order to achieve the 15th
approval deadline. The majority of the final plat follows the original preliminary plat
submitted in the beginning of June with the exception of the lot configurations moving
Lot 2 over into Lot 1 and adding the acreage from Lot 2 into Lot 3. In addition, we
have removed the proposed wastewater and water easements running through Lot 3 to
the adjacent property owners pending further discussions in the development agreement
process.
We appreciate. your cooperation in the approval of this final plat and look forward to

I wanted to follow-up from our November 22nd meeting with you regarding the City of Bryan's
lectric easement on this site.. Have ou heard an more from them :about this? If ou recall,. in our

meeting with you,. me, yourson Don, Shirley Volk, Bob Pohl, and Jim. Callaway, we set out what we
thought would be terms for a mutually agreeable solution. They were:
L as the property owner in this situation,you were agreeable to granting a joint electrical utility
.easement for both the City of Bryan°s and the City of College Station's use.
2: the City of College Station was agreeable to a joint easement with Bryan with that easement
being located parallel to the Jones- Butler right-of-way suitable for our needs.. We agreed to
provide Bryan equal rights for -use of this easement. We also had no problem :with the'language
the City of Bryan wants that says "on, over, and across". However, we can not give up future
franchising authority in this easement document: You may recall-that I suggested that the
franchisin issue need not be mentioned in this easement agreement:. We can not give them

telecom usage of this easement, unless thistelecom usage is'strictly for electric utility operations.
As the property owner, you agreed that you were the party hat needed to negotiate with the City of
Bryan under these tentative terms. We concurred that since you were the land owner, that it was most
appropriate for you to conduct these negotiations. Let me know if I have conveyed what we agreed to

accurately or if we need to meet to discuss this further. We want to be as proactive. as we can be
within the limits of our role to get this resolved so your development is facilitated.

Melrose Subdivision
Case #96-226
On Wednesday, July 31, 1996, staff reviewed the. final plat for the Melrose Subdivision and
identified the following items:.
Ordinance Requirements:
Remove the."Approval of the City Council" signature block.
.Show all water, sewer and electrical easements as "Public Utility Easements".
Submit paid tax certificates for the subject property.
_ Clarify general note #3. It sounds like there will be additional dedications in the future in
addition to the rights-of--way shown on the plat.
Comments/Concerns:
_ Provide a blanket utility easement over the subject property to allow for utility installation;
especially since the existing overhead will need to .remain temporarily. Coordinate
electrical service details with Electrical Operations Coordinator Tony Michalsky at (409)

SUBMIT THE REVISED MYLAR ORIGINAL AND 10 COPIES OF THE FINAL PLAT BY

COMMISSION PACKETS FOR THE MEETING OF THURSDAY, AUGUST 15, 1996.
