Ordinance Requirements:
_ Remove the City Council signature block. (The final. plat will not go_ on to City Council
unless the applicant decides to appeal the Planning & Zoning Commission's decision.)
Comments/Concerns:
_ Staff will not support the variance request to the surfacing. requirements .even though the
County has granted the variance. Staff believes that granting. the variance would only
perpetuate the problem of .gravel roads. Assistant City Engineer Morgan is .putting
together. cost estimates for the proposed and required surfacing requirements.
_ Coordinate telephone service requirementswith G.T.E. Representative Laverne Akin at

COMMISSION PACKETS FOR THE MEETING OF ..THURSDAY, JULY 18, 1996 AT 7:00
P.M.
AGENDA ITEM NO. 4: Consideration of a preliminary plat of the Holleman and Welsh
Addition totaling 6.88 acres located on the northeast corner of the Holleman and Welsh
intersection. (96-303).
Senior Planner: Kuenzel presented. the staff report and stated that the corner lot is to be sold for a
renovation of the convenience store located on the northwest corner of the plat. In addition, the
remaining C-T zoned area will be subdivided into two commercial lots..The R-1 area contained within
the plat is proposed as two lots, one for an existing house at the corner of Dexter and Holleman and one
for future subdivision. This preliminary plat will not continue on to City Council for their review since
no .planning issues are involved. Staff recommended approval of the preliminary plat with the comments
outlined in the Presubmission Conference report.
Commissioner Lightfoot moved to approve the preliminary plat of the Holleman :and Welsh Addition
located on the northeast corner of the Holleman and. Welsh intersection with staff recommendations.
Commissioner Garner seconded the motion which passed unopposed (4 - 0}.
AGENDA ITEM N0. 5: Consideration of a preliminary plat for the Willow Run Phase II
Subdivision totaling 42.3 acres and. located in the City's E.T.J. just north of Capstone Drive.
(96-304)
Senior Planner Kuenzel presented the staff report and stated that the applicant wishes to add a phase to
Willow Run by creating .four .lots and a new private cul-de-sac. The private drive exceeds the length of
a cul-de=sac and the applicant is requesting a variance to than standard. In instances where large rural
tracts are proposed within the E.T.J., the City has granted such variances. In addition, the applicant is
requesting a variance to the standards for surfacing. He intends to meet the gravel base and right-of-
way;width requirements but does not wish to provide a two course asphalt surface because the road is
to .remain private. If the road is to come ..under County. maintenance m the future, the asphalt surface
must first be provided. The Countyapproved the preliminary plat; however, the surfacing. variance was
not discussed.. Staff recommended approval of the preliminary plat with the cul-de-sac length variance
and the postponement of the private road surfacing requirements.until the final plat.
Representative of the applicant, Mike McClure of McClure Engineering stated .that he and the owner
met with Commissioner''Gary Norton and. he agreed to support their proposal as long as they built the
private road to the same geometry as County standards.
Commissioner Garner moved to .approve the preliminary .plat of Willow Run Phase Two with staff
recommendations. Commissioner Smith seconded the motion which passed unopposed (4 - 0).
AGENDA'ITEM NO. 6: Consideration of a preliminary plat of tiie McDonald's Addition
totaling 0.87 acres located in the southeast quadrant of the George Bush Drive and Marion Pugh
intersection. (96-305)
Senior Planner Kuenzel presented the staff report and stated that the comments. identified in the
Presubmission Conference report have been .addressed. The corner lot is to be developed into a
McDonald's restaurant.. Staff recommended approval of the preliminary .plat as revised after the
Presubmission Conference.
.Commissioner Lightfoot: moved to approve the preliminary .plat of he McDonald's Addition with staff
recommendations. Commissioner Smith seconded the motion which passed unopposed (4 - 0).

table action on this plat to allow the developer the opportunity to work out details outside this
meeting room. Mr. Smith seconded. the motion.
Mr. Parker asked if staff is satisfied with the access being proposed. Mr. Laza. replied in the
affirmative. Mr. Massey. said he would like to second Mr. LightfooYs comments,: but would
indeed like to see "common sense" used in notifying .adjacent property owners who would be
impacted, even if they are not legally required to receive. notification.
City Planner Kee.. reminded the Commission of its statutory obligations when considering. plats
and replats, and. reminded them that because of the statutory 30 day rule, the commission only
has the option to deny or approve this plat, with tabling not being an option.
Assistant City Attorney Carla Robinson stated that she would concur with Mrs. Kee's opinion, but
would be required to conduct research to give the Commission. a definite answer.
Mr. Lightfoot removed his motion totable this plat. Mr. Smith removed his second to that
motion.
Mr. Lightfoot then .made a motion to decline this plat. Mr Massey seconded the motion which
carried by a vote of 4-2 with Gamer 8 Parker voting against the motion.
AGENDA ITEM NO. 5: Consideration of a final plat of the Willow Run Phase II
E.T.J subdivision totaling 42.3 acres divided into four residential lots located along
Capstone Drive. This final plat also includes a variance requestto the City's minimum
surfacing requirements of the proposed private road. (96-219)
City Engineer Laza located the property and described the E.T.J. plat. He then. explained the
variance the applicant was requesting for the surfacing. requirement, stating that staff would
recommend denial of that variance request because if this area would get annexed the City
would become the responsible partyy for upgrading the roads. He added that the County has
already considered this plat and variance, and approved both as submitted.
.Acting Chairman Gribou announced that although this item' is not scheduled for a public hearing,
he would .invite any interested-party to, make comments. Mike McClure,. project engineer, came
forvvard to explain thatthe developer,., had donated land to the County for Capstone Drive when
he orignallybegan this subdivision, and the County constructed it as a gravel road. The.
developer now would like to make this road which. connects to Capstone. a gravel road. also, and
has plans to retain ownership of the road and make known to the .residents on the road he has
the option to..upgrade it at a later date,. but',would like to build the road to County standards at this
time and the variance request would only be to the surfacing. He added that residents living on
this road would fiave to drive orr gravel roads to get to this road, so it doesn't seem to make ,good
sense to require this road to be hard surface when all others are gravel corning to this road.
No one else spoke. Ms. Gamer made a motion to approve the plat, but to deny the variance
request. Mr. Lightfoot seconded the motion which carried unanimously (t;-0).
AGENDA ITEM N0.6: Consideration of a preliminary plat of the Freeman
Subdivision totaling 5.6 acres consisting of one C-1 General Commercial of located
along the east side of Texas Avenue between Krenek Tap and W. King Cole Drive. {96-
310)
City Planner Kee made the staff presentation which briefly covered the staff report included in
the,packets. She stated staff recommends approval of this plat as submitted because all
previous concerns,:~y~ been addressed.
