MEMORANDUM

RE: Final Plat of Jordan Subdivision. (96-204)
The above referenced final plat, located adjacent to and on the west. side of the LaSelva
Nursery. approximately 1.5 miles east of the intersection of State Highways 6 and 30,
was reviewed at a Presubmission Conference on Wednesday, January 31, 1996. The
purpose. of this final plat is to subdivide 5.84 acres into three lots. zoned C-3, Planned
Commercial. The average lot size for the three subdivided lots is 1.95 acres. .Water
and sewer services are currently available to all three lots. The applicant is requesting
a variance. to the driveway ordinance requirement of having. a minimum spacing of 275
feet between driveways. The applicant is desiring an individual access drive for each
lot. As the enclosed letter from the applicant states, the proposed distance between
each drive would be approximately 190 feet. Also enclosed is a memorandum from
staff recommending. denial of this variance. :Staff recommends approval of the final
plat with .the comments :identified ~~t the Presubmission Conference and denial of
the. requested driveway-variance.

RE : Driveway Variance for Jordan Final Plat (96-204)
The applicant for the above referenced plat, Mr. Weldon Jordan, requests a variance for
the amount of separation required between non-residential driveways. Please see his letter
to Development Coordinator Shirley Volk included as part your packet information.
The subject property is located on -State Highway 30, a major arterial. The variance
request is an appeal to section K(3)(h) of the driveway ordinance which requires that
adjacent driveways on major arterials be no closer than 275 feet apart. The applicant
desires a reduction in this requirement to about 170 feet in order that separate driveways
can be provided for each ofhis lots being platted.
Staff worked with the applicant on trying to determine the location of access for this
property. It was initially agreed that Lots 2 and 3 would share a driveway and Lot 1 would
have its own driveway. A shared access easement between Lots 2 and 3 is included on the
plat. Staff considers this position a compromise, since even with the shared driveway the
275 feet spacing requirement can not be met. Staff agreed to this .arrangement since it
consolidated the number of driveways from 3 to 2.
Staff recommends denial of the variance request. The requested spacing of about 170 feet
between driveways on SH 30 would not even meet the City's ordinance requirement for a
collector street. In addition, the City's development policies state that access points to
thoroughfares and. arterials should be minimized and consolidated wherever possible
through the plat and site plan review process.

~ in the amount. of $16;005.00. `'This dollar amount was-determined by Garrett Engme~ering
according to their. Engineer's Estimate for. ca~struction of the eight inch (8°`) water line. .Upon
