(2) any lot in the preceding plat ryas limited by
deed restrictions to residential use for not more
than two residential units per lot.
(b) Notice of the hearing requu•ed under Section
212.014 shall he given. before the 15th day before the
date of the heal°ing by:
(1) publication in an official newspaper or a ~~errs-
paper of genera] circulation in the county in which
the municipality is located; and
{2) by r`~°itten notice, rr~th a copy of Subsection
(c) attached, forwarded by the municipal authority
r°esponsible for approving plats to the orr-ners of lots
that are in the original subdivision and that .are
within 200 feet of the lots to be replatted, as indicat-
ed on the,most recenth~ approved municipal tax roll
or in the case of a subtliv~sion vrithin the extratei-r-i-
tor-ial jurisdiction, the most recentl}• approved coun-
ty tax roll of the. property upon. vv-hich the r°eplat is
requested, The vv-t•itten notice ma}• be delivered,by
depositing the notice, properly addressed vrith post-
age prepaid,' in a host office or postal depository
within the boundaries of the municipality.
(c) If the pr°oposed replat requu•es a ~ ar-iance and is
protested' irr accordance with this subsection, the pro-
posed replat must receise, in order to be approved,
the affirmative vote of at least three-fourths of the
members'. pr°esent of the municipal planning conunis-
sion or ggverning body, or both. For a legal protest,
vr~r-itten instruments signed by the ovvner~ of at least
20 percent of the area of the lots or land immediateh•
adjoining the area covered U}~ the p~°oposed replat and
extending ?00 feet from that area. but vrithin the
original subdi~~ision, must be filed with the municipal
planning cormnission or' governing bod~•, or both, prior
to the close `of the public hearing.
(d) in computing the percentage. of land area under
Subsection (c), the.-area of streets and alleys shall be
included.
(e) Compliance a-ith Subsections (c) and (d) is not
required for° approval of a replat of part of a preceding
plat if the area to be replatted was. designated or
reserved for other than single or duplex family resi-
dential use by notation on the last legally recorded
plat or in the legally recorded resu•ictions applicable
to the plat.

§ 212.016.. Amending Plat ~
(a) The. municipal authority responsible for approv-
ing plats mar' approve and issue an amending plat, i

which may be recorded and is controlling over -the.
preceding plat rrzthout vacation of that plat, if the
amending plat is signed by the applicants only and is
solely for. one or more of the following purposes:
(1) to correct an error in a course or distance
shown on the preceding plat;
(2) to add a course or distance that was omitted
on the .preceding plat;
{3) to correct an etror in a real property descrip-
tion. sho~m on the preceding plat;
(4) to indicate monuments set after the death,
disability, or retirement from practice of the engi-
neer or surveyor responsible for setting monu-
ments;
(5) to show the location or character of a monu-
ment that has been changed in location or character
or that is shown incorrectly as to location or charac-
ter on the preceding plat;
(6) to correct any other type of scrivener or
.clerical error or omission previously approved by
the municipal authority responsible for approving
plats, including lot numbers, acreage, street names,
and identification of adjacent r°ecorded plats; ' -=
(7) to correct an error in com•ses and distances of
lot lines between tvvo adjacent lots if:
(A) both lot. ovvmers join in the application for
amending the plat;
(B) neither lot is abolished;
(C) the amendment does not attempt to re-
move recorded co~~enants or restrictions; and
(D) the amendment does not have a material
adverse effect on the property rights of the other
owners in the plat;
(8) to relocate a I'ot line to eliminate an inadver-
tent encroachment of a building or other improve-
ment on a lot line'... o• easement;
(9) to .relocate one or more lot lines between one
or more adjacent. lots if:
(A) the ovv-nei•s of all those lots join in the
application for amending the plat;
(B) the. amendment does not attempt to re-
move recorded covenants or restrictions; and
(C) the amendment does not increase the num-
her of lots;
(10) to make necessary changes to the preceding
plat to create six or fewer lots in the subdivision or
a part of the subdivision covered by the preceding
plat if:
(A) the changes do not affect applicable zoning
and other regulations of the municipality;

RE: Final Plat of a Portion of Block 23, College Park .Subdivision. (96-201)
The above referenced final plat, .located -at the. southwest corner of Park. Place and South
Dexter, was.. reviewed at a Presubmission Conference on Wednesday, January 17, 1996. The
purpose of .this final plat: is to rectify an illegal subdivision that took place since the adoption of
the Subdivision Regulations in 1970. The Subdivision Regulations state that a final plat must
be approved and filed for record prior to the City issuing a 'building,. plumbing or electrical
permit. As part of this. replat, a ten {10) foot wide sanitary sewer easementis being dedicated
across the north corner of the. property to facilitate an .existing sewer .line. Staff recommends
approval of thefinal plat with the comments identified-at the Presubmission Conference.
