ROBERTSON SURVEY, ABSTRACT NO. 404 IN THE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS AND BEING OUT OF THE RESIDUE OF A CALLED 505.19 ACRE TRACT, DESCRIBED AS "TRACT 1" IN A DEED TO PEBBLE CREEK DEVELOPMENT. COMPANY RECORDED `IN VOLUME 1671, PAGE 276 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS, FROM R-3 TOWNHOUSE-ROWNOUSE AND A®O AGRICULTURE-OPEN SPACE TO R-1 SINGLE FAMII.,Y RESIDENTIAL. WHEREAS, on August 29, 1996, the City Council of the City of College Station convened and, pursuant to notices prescribed bylaw,. held a public hearing with regard to the- application for. the rezoning of a 45.33 acre tract of land located in the S.A. Robertson Survey, Abstract No. 404, in the City of College Station, Brazos County, Texas, and more particularly described as follows: Being a 45.33 acre tract of land located in the S.A. Robertson Survey, Abstract Na 404 in the City of College Station,. Brazos County, Texas and being out of the residue of a called 505.19 acre tract, described as "Tract 1" in a deed to Pebble Creek Development Company of record in Volume 1671, :Page .276 of the Brazos County,. Texas Deed Records. Said. 45.33 acres being more particularly described by metes and bounds as follows: BEGINNING at an iron rod found_ in the. south line of Spearman Drive (60' R-0-W), marking the most easterly corner of Block 25, ,Pebble Creek Phase SD of record in Volume. 2541, Page. 239 of said deed records, same being the southwest corner of Pebble Creek, Phase 3C (Spearn~an Drive Dedication-unrecorded), said iron rod also marking a corner of the above mentioned residue and the northwest corner of the herein described tract; THENCE an arc .distance of 453.41. feet along said southline of Spearman Drive and a curve to the left, having. a radius. of 1345.00 feet and whose chord bears S 76 deg. 35 min. 12 sec. E - 451.27 feet to a point for the Point of Tangency of said curve; Thence S 86 deg. 14 min. 39 sec. E - 148.93 feet along said line of.Spearman Drive to an iron'rod found marking the Point of Curvature of a curve to the left; THENCE an= arG distance of 280.05. feet along said south line of Spearman Drive and said curve to the left having a radius of 835.00 feet and whose chord bears N 84 deg.. 08 min. 53 sec. E - 278.73 feet to an iron rod :found marking the Point of Tangency of said curve; THENCE N 74 deg. 32 min. 23 sec. E - 567.76 feet continuing .along said south line of Spearman4)rive to a point for the northwest corner of Block 22, Pebble. Ereek Phase 4A of record in Volume 2422, Page 1S 1 of said deed records, same being a cornea of said residue and the northeast corner of the herein described tract; THENCE along the west line of said Phase 4A and the west line of Pebble Creek Phase 4C of record in volume 2324, Page 201 of -said deed records. the following three (3) calls: ®rdinance No. 2202 Page 2 S 46 deg. 11 min. 11 sec. E -366.91 feet town iron rod found; S 39 deg.. 35 min. 17 sec. E - .508.25 feet to an iron rod. found; and S 15 .deg. 27 min. 42 sec. E - 105.75 feet to a point for the south line of Royal Adelade Drive (60' R-0 W), marking the southwest comer of said Phase 4C, and an ell comer of residue and the herein described tract; THENCEN 74 deg. 32 min. 18 sec. E - 149.01 feetalong said line of Royal Adelade Drive to a point for a corner of the herein described tract; THENCE S 15 deg. 27 min. 42 sec. E - 130.00 feet leaving said R-O W to a point. for the southeast comer of the herein described tract; THENCE along the south line of the herein described tract, the following three (3) calls: S 74 deg. 32 min. 18 sec. W - 1187.35 feet to an angle point; S 47-deg. 10 min. 15 sec. W - 202.51 feet to an angle point; and S 29 deg. 16 min. 07 sec. W - 271.18 feet to an iron rod found marking the most easterly corner of the College Station Business Center, Phase One of record in Volume 2470, :Page Z77 of said deed records, same being the most southerly comer of the herein described tract; 'T'HENCE N 43 ~= 57 min. 04 sec. W - 1576.84 .feet.. (Base Bearing .Platted Call - Volume .2470, Page 277): along. the northeasterly line of said: Phase One to an iron rod found in the southeasterly line of the above mentioned Block 25, Pebble Creek Phase SD, said iron rod marking the most northerly corner of said Phase One, a-comer of said residue and the most westerly corner of the herein described tract; 'THENCE N 44 deg. 02 min. OS sec. E -449.86 feet along said line of Block 25 to the Point of Beginning. WI3EREAS, the above-described property is currently zoned R-3 Townhouse-Rowhouse and A-O Agriculture-Open Space and the current use is Vacant-Agricultural; WHEREAS, the owner of the above-described property,. Pebble Creek. Development Co., has applied for the rezoning. of the above-described property to R- I Single Family Residential; WI~REAS, the City. Council of the City. of College Station, Texas: heard evidence that the area surrounding the above-described property has changed from agricultural use to a residential subdivision for single family housing; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the proposed zoning change is in accordance with the Comprehensive Plan and proposed Compre- hensive Plan; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the proposed zoning .change is in accordance with -the approved master plan for the Pebble Creek subdivision; NOW, THEREFORE,. BE IT .ORDAINED BY .THE -CITY COUNCIL OF THE CITY OF COLLEGE. STATION, TEXAS, that-the entire 45.33. acre.. tract described above is rezoned to R 1 Single Family Residential, effective immediately.
