BRAZOS COUNTY, TEXAS, FROM A-O AGRICULTURAL-OPEN AND R-1 SINGLE FAMII,Y RESIDENTIAL TO R & D RESEARCH AND DEVELOPMENT WHEREAS, on June 27, 1996, the City Council of the City.. of College Station convened and, pursuant. to notices prescribed bylaw, held a public hearing with regard to the application for the rezoning of a 33.366 acre tract or parcel of land situated in the Morgan Rector League, Abstract No, 46, m the City of College Station, Brazos County, Texas, and more particularly described as follows: Being a 33.366 acre tract or parcel of land lying and being situated in the Morgan Rector League, Abstract No. 46, .College Station,: Brazos County, Texas, and being a part of the so-called 112.86 acre tract of land. conveyed to East By-Pass Development Group by deed recorded in Volume 428, Page 297, Deed .Records, Brazos County, Texas, and said 33.366 acre tract being more particularly described as follows: BEGINNING. at a 5/8" iron rod found set in concrete for the south .corner of the herein described tract of land, said rod. also marking the westernmost corner of Lot 4, Block 19, Woodcrcek Section 5 Subdivision, College Station, Brazos County, Texas as recorded in .Volume 1318, Page 171, Official Records, Brazos County, Texas; THENCE N 30°11'49" W, through the 112.86 acre tract,. for a distance of 644.73' to a point; THENCE N 45°36'18" W, through the 112.86 acre tract, for a distance of 689.30' to a Point; THENCE N 13°00'32" W, through the 112.86 acre tract, for a distance of 575.45' to a point; THENCE N 45°36'18" W, through the 112.86 acre tract, for a distance of 150.00' to a point for a corner located on the southeasterly right-of--way line of Sebesta Road; THENCE N 44°25' 10" E, along said southeasterly right-of--way line of Sebesta Road, for a distance of"210.00' o a point for a corner, said point also being: the west corner of the 125.9 acre T.D. Letbetter Tract,as recorded in Volume 136, Page 223, Deed Records, Brazos County, Texas; THENCE S 45°36'18" E, for a distance of 1,295.01', along the common boundary with said Letbetter Tract, to a %2' iron rod found, said rod also marking the south corner of the aforesaid T.D. Letbetter Tract; THENCE N 45°38'47" E, continuing along the common boundary with said Letbctter Tract, for a distance of 801.96' to a 6" Cedar fence post found for a corner, THENCE S 46°06'37" E, for a' distance of 624.72' to a 5/8" iron rod found, said rod marking the west corner of a College Station City Park Tract as recorded in Volume 918, js/c/rezone96/sebesta.doc 7/24/96 m Ordinance No. 2186 Page 2 Page 678, Official'Records, and furthermore said rod marking the northernmost comer of Block 19, Woodcreek Section 5 Subdivision; THENCE S 44°04'33" W, along the common boundary with said Block 19, for a distance of 1,498.60' to the POINT OF BEGINNING, containing 33.336 acres of land more or less. WHEREAS, on February 6, 1996, the property. was rezoned to M-1 with the condition that .deed restrictions be filed making the City a party to the. subdivision plat and the condition that the applicant convey a small portion of land to the City to enable the City to enforce the deed restric- tions; WHEREAS, the zoning did not become effective because the property owner did not .fulfill the conditions required; and as a result the property is still zoned A-O Agricultural Open and R-1 Single Family Residential; WHEREAS, the owner of the above-described property, East By-Pass Development Group, has applied for the rezoning of the above-described property from A-O and R-1 to R & D Research and Development; WHEREAS, the current use of the property is agricultural or vacant; WHEREAS, the City Council of the City of College Station heard evidence as to the fact that the proposed development will not have any negative impacts to the adjacent residential properties; WHEREAS, evidence was presented that the proposed zoning change is in accordance with the Comprehensive Plan and proposed Comprehensive Plan; and WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the growth in College Station is primarily to the south and along State Highway 6 and that mixed use development along State Highway 6 is appropriate for this area; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the entire 33.366 acre tract described above is rezoned to R & D, Research and Development, effective immediately. AN ORDINANCE REZONING A 32.72 ACRE TRACT OF LAND SITUATED IN THE ROBERT STEVENSON LEAGUE, ABSTRACT NO. 54, IN THE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS, AND BEING A.PORTION OF THE HORACE SCHAFFER, ET AL 56.5 ACRE TRACT (400/7), FROM A-0 AGRICULTURAL OPEN TO R®2 DUPLEXES. .. WHEREAS, on June 13, 1996, the Gity Council of he City of College Station convened and, pursuant to notices prescribed by law, held a public hearing with regard to the application-for the rezoning of 32.72 acres of property situated in the Robert Stevenson League, Abstract No. 54, m the City of College Station, Brazos County, Texas, and more particularly described as follows: Being all of that. certain tract or parcel of land .lying and being .situated in the Robert Stevenson League, College Station, Brazos County, Texas and .being a part of Tract (a) .conveyed to Horace Schaffer and Clyde .Schaffer, Trustee by Fritz Schaffer et ux, recorded.: in Volume 400 page 7, ®eed Records of Brazos County, Texas and being described as follows: BEGINNING:.. at a '/2' iron rod found at the south corner of said tract A same being at the intersection of the northwest right-of-way line of Graham Road and the northeast right-of-way line of Schaffer Road; THENCE: N 45°00'00" W - .881.86 feet along said Schaffer Road. line to a %2' iron rod found at the south corner of a Brazos County 0.48 acre tract (8.10/820); THENCE: N 45°02'39" E - 42.93 feet along the southeast line of said Brazos County tract to a 1/2" iron road found at the southeast corner of said tract; THENCE: N 44°5T21" E - 53.61 feet continuing along said Brazos County tract line and comer'in the centerline'of a creek; THENCE: along said Creek centerline for the following calls: N 5°37'07" E - 304.89 feet, N 16°58'36" E - 167.55 feet, N 33°02'42" E - 139.9.3 feet, N 48°11'54" E - 121.82 feet, N 77°19'27" E - 139.69 feet, N 49°35'48" E - 105.11 feet and S 79°41'27" E - 206.44 feet and corner in the common line between said 77.00 acre tract and the Godley P. Open, and the current use is agricultural; WHEREAS, the owner of the above-described property,. Horace Schaffer, purchased the property on September 20, 1994, by deed recorded m Volume 2224, Page .208 of the Official Records of Brazos County, Texas;. WHEREAS,. the owner has applied for the rezoning of the above-described property to R-2 Duplexes; , WHEREAS, the City Council of the City of College Station,hea~d evidence that the area in which the above described tract is located is currently used for agriculture; WHEREAS, .the City Council of the City. of College Station heard evidence .that the property .situated immediately across Schaffer Road from the subject property has been rezoned and developed for single-family residential use; WHEREAS, rezoning the subject tract of land into the aforementioned tract would allow the owner o develop the property in such away that it fills a need in thelocal real property. market; and WHEREAS, the subject rezoning is consistent with the City's. Comprehensive Plan for development; NOW, THEREFORE, BE IT-ORDAINED- BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,. TEXAS, thaf the 32.72 acre tract .mentioned above is hereby rezoned from A-0 Agricultural-Open to R-2 Duplexes, effective immediately. PASSED and APPROVED this 27th day of June, 1996.
