TEXAS, BY AMEND- ING CERTAIN OVERLAY DISTRICT PROVISIONS IN SUB-SECTIONS A, B, AND K, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on October 12, 1995 the College Station City Council determined that certain. provisions within the.City's Zoning Ordinance that pertain #o the Overlay District require clarification of certain language in order to avoid misapplication of the ordi- Hance and to ensure. compliance with the intent of the ordinance; NOV1/ THEREFORE,. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: That sub-sections A, B, and K of Section 8.19 of the Ordinance. No. 1638, the Zoning Ordinance, of the City. of College Station are hereby amended to read as follows: A. In the event that an area is rezoned to apply the overlay district, this district shall apply to all multi-family,. commercial, and industrial property, and where applica- ble, to single family, duplex or townhouse development. The underlying .district establishes the .permitted uses and shall remain. in full .force, and the require- ments of the overlay 'districf are to be applied in addition to the underlying use and site restrictions. B. PURPOSE: This district is established to enhance the image of key entry points, major corridors, and' other areas of concern, as determined by the City. Council, by maintaining a sense of openness and continuity. In cases of conflict between this overlay- district and the underlying zones, the more restrictive regulation shalt apply. K. SPECIAL RESTRICTIONS FOR GASOLINE SERVICE STATIONS: In cases where the underlying zoning district permits gasoline service stations and a station. is proposed, the following restrictions shall apply: 1. ACTIVITIES RESTRICTED: _ no major emergency auto repair. _ no body, fender, or paint work. no sale. or rental.of vehicles. _ all activities except those associated with fuel pumping must be conducted within an enclosed. building. _ service bays and car. wash bays shall be oriented to face away from any R.O.W. Where this is :impossible, screeningmethods will be required. ~. +; Ordinance No. 2151 2. STORAGE AND DISPLAY: _ no outside storage or display of merchandise. _ storage tanks must be located below grade. _ no outside storage of vehicles.. _ ice and vending. machines must be enclosed. in a building. _ no.additional advertising within view of the R.O.W. 4. SIGNS _ sign height shall be restricted by .:the provisions of Table I, but shall not exceed the height of the building. one detached'sign and two attached signs will be permitted. _ no freestanding fuel price signage shall be permitted. _ signs for air,.'water and other similar services or products must meet the criteria for exempt signs. II.
