POLICY STATEMENT
K(fi) Geometric Design of Driveway Access.. (d) The maximum width of residential driveway. approach,
shown in Figure 3 and measured at the property line, shall not exceed twenty-eight feet (28') in width,
while the minimum width shall zot be less than ten feet (10') in width..
STAFF COMMENTS
The applicant is in the process of building a house on a corner lot in Phase 9 of Emerald Forest. The
home will front Spring Creek and the garage will be accessed by Crystal Oaks. It will have two (2) two
car garages. which explains the applicants desire for a larger driveway. Staff worked with the applicant to
develop a design that would accommodate the home's four (4) car garage and still meet the City's
driveway ordinance. The applicant did not find the design acceptable and is requesting a curb cut of 40
feet (40') on Crystal Oaks which exceeds the ordinance requirement by twelve feet (12').
STAFF RECOMMENDATION
Staff recommends denial of the request due to the following considerations:
1. Consistency. While this forty foot (40') wide residential driveway will not pose a safety problem,
Staff is compelled to deny the request in order to rerziain consistent with previous decisions of
other similar requests.
2. Although the ordinance allows some stiff discretion, stiff feels a variance of twelve feet (12') is
beyond our discretionary authority. Staff has. agreed to an additional two feet (2') which would
allow for a thirty. foot (30') driveway opening.
