HomeMy WebLinkAboutStaff Report.STAFF REPORT Case No.: 95-702 Applicant: Jerry Kieschnick for Holy'Cross Lutheran Church ITEM CONSIDERATION OF A CONDITIONAL USE PERMIT TO ALLOW THE EXPANSION OF EXISTING. CHURCH FACILITIES LOCATED AT 1200 FOXFIRE DRIVE; THE SOUTHWEST CORNER OF FOXFIRE AND SEBESTA ROAD. ITEM SUIVEVIARY AND STAFF RECOMMENDATION This church was constructed before the site was within the city limits. The proposal is to expand the facility from 6087 square feet to 9887 square feet and to bring the parking lot up to .code.. Phase I of the expansion will include the addition of 3800 square feet, the upgrade of 102 parking spaces, and the use of the existing gravel drive for a maximum of one year.. The existing gravel drive will also require approval from the Fire Department as a fire lane. An all weather surface and appropriate signage will be necessary at all times, and the fire lane must be maintained until the second phase of the project. Phase II will include the upgrade of the existing gravel drive from the end of the new paved section to Eoxfire Drive and the construction of 40 additional parking spaces on either side of the drive.. The easterly portion of the site is reserved for future expansion that will need to return to the Commission 'for review. Phase I parking will exceed the ordinance parking requirement by 69 spaces. The PRC met on May 3 and recommends approval with minor conditions. relating to missing items that are needed to satisfy ordinance requirements. Civic Pride -Citizens benefit from well planned, attractive residential and commercial .areas. COMPREHENSIVE PLAN -The following are Goals and Objectives from the City's adopted Comprehensive Plan. Applicable ones are in bold. Complies with Future Land Use Plan Map`:: Yes. Churches are allowed in any zoning district if the Conditional Use Permit standards are found to be met (see comments below). Development Goals and Objectives: LAND USE Protection of residential uses: The Commission must find that the proposed expansion: wilLnot be in conflict with surrounding planned uses. Encourage use of vacant land w/services: Utilities are adequate for the expansion.' Avoid strip commercial: n/a TRANSPORTATION Provide. major arterials to prevent congestion: Adequate pedestrian/bike movement: Ensure safety and ease of maintenance: Location of streets based on function: Driveway access: The access points meet the Driveway Ordinance standards ECONOMIC DEVELOPMENT N/A Compatible with environment: Encourage. retirees: Encourage tourism: PARKS AND RECREATION N/A Link parks by pathways and natural features: Combine parks with schools: HOUSING N/A Maintain integrity of existing supply: are we overbuilt? Encourage diversified housing: COMMUNITY APPEARANCE Promote good site design: The site plan, with the exception of the continuing use of the existing. gravel drive, meets current codes. The completion of Phase II will bring the entire site up to code. Prevent and eliminate unsightly conditions: Phase II will eliminate the gravel drive HISTORICAL OVERVIEW The Commission has final authority over CUP's unless there is an appeal. In the past, if there was a conflict with residenrial uses., the Commission has approved CUP's for churches with screening provisions in the form of either a wooden fence or shrubs. None as of date of report ADDITIONAL COMMENTS Conditional use permits are granted by the Commission, subject to appropriate conditions and safeguards, when the Commission finds: A. That the proposed use meets all the. minimum standards established in the Zoning Ordinance for this type of use; B. That the proposed use is in harmony withthe purpose and intent of the zoning ordinance and the plan for physical development of the district as embodied in the comprehensive plan for the development of the City; C. That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property. 3
