REVIEW COMMITTEE (PRC) DISCRETIONARY ITEM APPEAL Dear Mr. Hawthorne, The owners of the Southwood Living. Center which is a nursing home located at 1201 Rock Prairie Road are proposing to construct an upscale retirement home adjacent to the Southwood Living. Center. During a recent PRC meeting the staff required that a sidewalk be constructed between the two facilities because they felt that the facilities were connected. The owner has requested that I appeal this requirement because the two facilities are not connected in any way and the sidewalk would be constructed along a private driveway between the two facilities. City Engineer ~ €, Date:. September 14, 1995 REs APPEAL OF A SIDEWALK REQUIREMENT AT THE COLLEGE STATION PERSONAL CARE FACILITY SITE LOCATED AT 1151 ROCK PRAIRIE. ROAD On August 23, 1995 .the PRC met to review the site plan for the above referenced site..At that meeting a sidewalk along the private drive between this facility and the Southwood Living Center facility was required. In the Zoning Ordinance, the PRC has the discretion to impose additional requirements when necessary to preserve public health,. safety and general welfare. One of these additional requirements is 10.2 "B. Assured pedestrian safety which may include the,provision of sidewalks along the perimeter of the property..." The PRC is concerned about the safety of the residents at the Personal Care Facility being able to leave the building and walk to other areas, which may include the Living Center or other destinations along Rock Prairie Road. We realize that there will not be an extension of~the sidewalk across the Living Center property to extend to Rock Prairie Road. The safety concern exists along the private road where the detention pond exists. Citizens walking along this roadway do not have a safe place to retreat because of the slopes on the pond. Once on the Living Center property, the grass area could be used for pedestrians, although the ideal situation would be to extend the sidewalk. The. Living .Center is not a part of this site ,plan application and the PRC could not require the extension of the.sidewalk along that property. (95-503) A Project. Review Committee meeting was .held Wednesday, August 23, 1995 to discuss the above mentioned site plan. P&Z Representative Garner moved to recommend approval of the site plan with all of the conditions listed below with the exception of the sidewalk requirement between the two facilities. This motion died due to lack of a second. City Engineer Laza moved to approve phase one of the proposed site plan with the following discretionary items, ordinance requirements and comments.: CONDITIONS. OF APPROVAL: Discretionary Items _ Provide a sidewalk along the private drive between this facility and the Southwood Living Center. This list does not relieve the applicant of total compliance with all ~;urrent ordinance requirements. Ordinance Requirements _ Show the ownership and current zoning of all abutting parcels. (With the exception of the single family lots in the adjacent Southwood Forest subdivision.) _ Supply information regarding medical waste for this facility. _ The two proposed turnaround areas do not meet minimum requirements for emergency vehicles. Modify the two turnaround areas to provide sufficient access for emergency vehicles. (The revised turnaround proposed during .the meeting. with the gravel "T" turnaround is acceptable.) _ Curbing is required around the perimeter of all paved areas with the exception of the temporary gravel turnaround since it will not be accessible to the public. _ .Section 290.44 of the TNRCC code states .that "where dead ends are necessary as ~i stage in the growth of a system, .they shall be located and arranged with a view to ultimately connecting them to provide circulation". Show the proposed connection to the water line in the Westchester Subdivision. - The proposed entrance drive must be a designated fire lane. _ Provide flow calculations for the fire hydrant located on the northernmost side ~of the property - a loop system maybe required. _ The fire department Siamese connection must be relocated to meet the minimum diistance allowed between the Siamese connection and the closest fire hydrant. _ The proposed fire hydrant in the rear of the. property may need to be relocated to provide the minimum 3'00' coverage area for future phases. _ Submit an irrigation plan with the construction documents. There are' not enough landscape points provided to meet the minimum requirements. The proposed live oak trees are 75 points and not ISO points. _ Clearly identify the phasing of the project so that all of phase one plus 20' is includled in the.. development area. (Include the detention pond plus 20` in phase one.) _ Provide the minimum, maximum and average water, landscaping and sanitary sewer demands. _ Show where the sidewalks are located on the property. (The detail is shown on the site plan but not the location.) Within the drainage easement for the detention pond, determine if there is a flume and if it ties into the outlet structure. The existing ponding problem should be addressed with the proposed development. APPEAL PROCESS': An applicant may appeal the decision of the Project Review Committee to the Planning and Zoning Commission within .five (5) days after the PRC Committee meting. Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and .surrender of all complaints, defects, or potential invalidity, whether under state or federal law. An applicant appealing the.: decision of the PRC shall file ten copies of the final site plan as .approved by the .PRC, showing all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until said copies are on file, no further development approval shall occur, and no further action by the Commission shall take place. An applicant may appeal only certain aspects of site. plan review, and in the absence of discretionary review by the Commission, or review pursuant to a petition, all other aspects of the site plan_shall be final.
