However, after you and I had spoken, Jane, Veronica, Nat & I met and determined that (1)we have been charged with the responsibility of taking items to reviewing bodies with complete, accurate information. We would not be able to do that in this case for several reasons, those being (1)written documentation was not included in the packets for the Commission's review, and (2)there is no staff member free today to get ready to make a presentation at tonight's meeting that would be good'. enough to cover all areas to be considered (since there is no written documentation). Therefore, we will not be able to include this item on an emergency agenda item for tonight's meeting. As you know, some of the information required for plat submittal was not even turned in until yesterday at approximately 12:30 or 1 p.m. (At which time V & L worked through the entire lunch hour to help review & approve some items). They (Greg & Tom) told us then that approval of those items would be enough to satisfy the bank. Then at 5 p.m. last night. when Jane brought him to me, he said that if they couldn't get on P&Z agenda tonight, the deal would fall through. Today I got Greg &`Tom together in my office-with Nat & I and I explained all of the above, told them that while we would not be able to get them on tonight's P&Z agenda, we WOULD work with them. to .get on the same Council meeting {i.e., 5/11) they would have been 'on had they made tonight's P&Z agenda. I asked if that would help them and Tom replied very gruffly that it would not! I looked surprised, and asked if he was aware that by getting on tonight's P&Z agenda, he would still not have an approved plat because our City requires approval by both the Commission and the Council, and he said he didnot know that either,. that he had. hired Greg to be the local expert, and had expected him to keep abreast of all of that! I then explained that even if they have approved building plans, the City will not issue a building permit until the plat if filed for record.. I explained that the plat cannot be .filed for record until it is approved by the P&Z, approved by the CC, has all infrastructure construction documents approved, the infrastructure is either built. and accepted or it is guaranteed, the parkland dedication is paid AND in this case, the off-site easements for drainage are filed for record. I then told them. that you had also offered to call the bank for them to explain our processes,. if they thought it'would help. They gave me the name of the contact person, but I asked them to call her to see when you should call (to be sure she would be available and know why you were calling). They assured me they would do that and get that info back to me. They both said they would like to be in the room when the phone conversation takes place. They also said they would have to''check with their company to see if the call should be made. That's were we are to date - except that I've had one more call from Greg to ask if we could issue a Slab Only .permit without having the plat filed for record, and I replied that we cannot. Also. explained that as far as they along in the review process, we would. be able to issue a full building permit before they can get the platting process completed.. Haven't heard back anything on the phone call to the bank. I'll keep you apprised. Thanks for your help so far! If you write a letter, and please do if it will get them off our back, I would suggest you say something like "as long as all ordinance requirements are met, pending approval by the Planning & Zoning Commission and the City Council." If you want to throw something. in about "engineering .requirements" like he asked, I would pput that in addition to ordinance requirements. There, I've given advice to an attorney! How's that for shear gall! Anyway, i don't know if he wants this "TO WHOM IT MAY CONCERN" or if he wants it to that contact at the bank. I will always welcome advice from you! I see a logic problem here: he wants me to say that there is no legal impediment to the approval of the W.P. plat approval. And, you're right. I would have to add the caveat of "subject to ordinance compliance." Well, if they refuse to or fail to comply with 'some aspect of the ordinance, that's a legal impediment to plat approval. And this doesn't even take into account all of the things that could happen through the p&z, council approval process. It seems. to me that there is just too much up in the air for me to make the kind of representation that he'wants to Nations Bank. What happens if he doesn't get a letter? Since the date of .your letter, Brisben. Development's employees and .subcontractors have made diligent attempts to remove the dirt and mud "caked" on the roadway adjacent to its property and along roadways in the vicinity that .are traversed by the construction crews entenng and leaving the Windsor Point site. _ My client is aware. of the safety problems that can exist if the dirt remains on -the roadway.. It has, per your recommendation and request, .obtained laborers to remove the dirt with shovels. Additionally, it has leased equipment and hired operators to sweep the .roadway. It does not intend to jeopardize the integrity of your pavement or create safety problems for the public. It is Brsben's desire to be a good neighbor during construction and thereafter. My client's construction: project is at a critical stage. Concrete work and asphalt work. that will hopefully alleviate a .great ,amount of the mud problem is scheduled to be completed within the next thirty to .sixty days.. This infra-structure work should allow a circuitous route through the Windsor Point project on continuous pavement. That will most certainly reduce mud or dirt being tracked off of the ite onto the public right-of-way. For that rea on, it is of great concern that their permits not be interrupted. My client believes it has taken the action .necessary to remove: and alleviate the problem on the Parkway. If .your inspectors indicate otherwise, please contact me immediately so that we can view and implement other alternatives that will satisfy the problems that you and others have observed. In some instances, screening may be required between different land uses or around unsightly site facilities.. In the specific case of the Windsor Pointe Apartment complex, the fencing requirements were related to dumpster screening only. If you choose to fence around the. facility as a site retrofit, we will need to first approve an amendment to the approved siteplan. Materials are not specified in the City's development requirements, however, the City does have authority to review site characteristics that may be considered "offensive", and details for the fencing will be requested. From the beginning of the project at ground breaking, the City's engineering inspection staff indicated that Mr. Tom Lowe, the project manager for the job, was extremely cooperative and was doing a good job. Inspectors from both building and fire were frequent visitors to the site, and all have reported that once Mr. Lowe became familiar with the local ordinances .and the interpretation of the applicable. building codes, he was cooperative and constructed a quality product. It was my personal experience as the City's development coordinator, that Mr. Lowe was cooperative and eager to work with the City to ensure completion of a quality project in the allotted time frame. Citg'Planner Kee moved to recommend approval of the parking lot plan with the following conditions: CONDITIONS OF APPROVAL: Discretionary Items: The parking areas and the locations where meters/utilities hit the buildings must be adequately screened from Central Park Lane and Southwest Parkway. Look at some alternatives to the proposed parking lot closest to the existing 20' concrete alley in the Southwest Crossing Subdivision. The parking lot should be opened to allow traffic on the adjacent alley or a combination of bollards and landscaping should be installed to prohibt_traffic from driving over the curb and accessing the adjacent alley. _ If the site plan. is approved, it is with the assumption that the proposed drainage plan is correct.
