Here's the problem: We will not-file the plat until (a)the waterline is built and (b)we hear back from FEMA. Mike Davis doesn't have any money to construct the water line. He needs to sell the property to get the money to da that. He oah't sell the property until the final plat is filed. We can't file the final plat until the FEMA stuff comes back and the water line is constructed! Also, how can they get a final plat filed .showing the OLD flood plain? (If you will recall, the plat submitted shows the flood plain removed from this property - hence the need for the .Letter of Map Revision from FEMA.) Anyway, Steve's question is: "Can something be worked out?"! Personally, about the. only thing I can. think of costs money.- and that's what Mike Davis doesn't apparently have! And as to the question about the plat showing the old flood plain - it would have to go back .through both P&Z & Council, sa I can't think that would be anything that could be done faster. Perhaps, since he says it would be like the Preliminary Plat we could take it .direct :from P&Z to Council, but .other than that, I really can't think of anything. About the best Steve could think of is that if, at closing, the City becomes a party to the closing and some kind of escrow fund is set up for the City for the waterline, with the Title Company: holding it until funds are needed. That won't help with the filing of the plat, tho"! Have you ali got any ideas on this? I advised him to have his attorney prepare something that we can run by our City Engineer and out City Attorney prior to the last minute so they have time to review it. Now, next question is to Veronica. Is there a way you can contact the FEMA people to see if they can give you some kind of window during which their review might be done? Nissan site. We denied there request for 2 curb from the very beginning and are now prepared to approve the' location of a single curb cut for the site without a (cross) access easement running across the front of the site. If we required the access easement, it would probably kill the deal. Steve and I met with Mike Davis. yesterday to make him aware of the situation and to see what his plans were for the remaining portion of his property to the north (not a part of the plat). Mike was already aware that even with a single curb cut permitted on the Nissan site, he wouldn't be able to get a driveway to his "unplatted property due to the location of the exit ramp. He indicated he had already worked out a deal with Bert Wheeler (.who owns the property to the north of Davis' unplatted tract) for a driveway on Wheelers tract that would serve bath of their properties. Steve and I went out this AM to check out the location. of this drive. It is in my opinion still not far enough away from the exit ramp and depending on how you interpret our ordinance to measure "distance from striped gore" it would meet our ordinance. It would, however, be about 600 feet north of the Nissan driveway. All things considered, I plan to call DD this afternoon and approve the location of the Nissan Drive and not require a cross access easement. Shirley, DD will probably be calling you to set up a predevelopment meeting. Mr. Alexander further advised that we state on the site plans that the tank be installed according to N.F.P.A. 30. (Jane this addresses tie down requirements among other things so we will not have a tank floating down the creek) He also said the. note about .clean-up responsibility is a good idea. II Dear Mr. Noble: As you have requested, the City of College Station has outlined herein two options available for you to obtain building permits for the above referenced site. Option 1: The City of College. Station, has reviewed. and conditionally approved a final plat for this property. The condition attached to this plat is approval by FEMA for the letter of map revision which will revise the flood plain location. Once this approval is received and the waterline is constructed or guaranteed, this final plat may be filed for record and the building permit may be obtained. This, of course, assumes that all building permit drawings have been reviewed and approved. Option 2: The City understands the concern regarding the time frame on the FEMA letter and that this may hold up the desired time frame for construction. The second option available to you would be to resubmit a final plat. showing the floodplain location according to the current FEMA maps. This plat would have to be processed through the P&Z and Council. Once approved and the waterline is guaranteed or constructed, the plat could be filed for record and building permits issued. (Again assuming that all building permit drawings: have been reviewed and approved.) I hope that this helps clarify the process for you.
