LICENSE AGREEMENT

7°HIS LICENSE AGREEMENT' {"License"), dated for reference purposes as of
9995, is entered Into by and between LONG .JOHN S[t_VER'S, INC.,' a Delaware
corporation {"LJS"), and CAROLYN WALDEN, an indivi'duat, dlbla Chill out Snow Canes,
(Licensee }.
1. premises_ LJS hereby grants to ticensee a license and .right to occupy a portion
..(hereinafter "License Area"} of LJS' restaurant property ,located at 18Q8 Texas ,venue, in
.College Station, Texas {°Property") as designated on the site plan drawing annexed hereto as
Exhibit "A", together with the right to use, in common with .LJS, its business invitees and
customers, the fallowing common areas and facilities: public restrooms, designated parking
.areas and the entrance and exit drives (someti,~es coii?ctively, "Common Areas"}.
2. Term. ,The term of this License shall be one (1) year, commencing on the effective date
(hereinafter defined}. Thereafter, provided Licensee is nc~t in default of any term or provision
hereof, Licensee shall have the right to extend the term of this License, upon sixty (60) days
prior written notice, for a period of one (1 } year. Provided, 17owever, Licensee (so long as
Licensee is not in default} and LJS each have the unconditional right to terminate t"is !ice^se
et any time without cause upon giving sixty (~0} days prior,written notice to the other- party,

4. Licensee's Construction Mork, Utilities. Licenses shall perform, at its expense, ail
installafian and canstguotion work relating fo the business facilities of Licenses, including
utilities, in and about the License Area as detailed on Exhibit "A" . LJS shall have no
obligation whatsoever to provide. any utility service to Licenses or to pay any cost associated
with such insfallafion and construction.. in'this regard, Licensee acknowledges that LJS
makes no representation or warranty wi#i1 respect to the License Araa•nor the property of
which the License Area, is a part, nor its suitability for L icensee's intended use, LJS and
Licensee have heretofore mutua{fy agreed upon the site plan annexed hereto as Exhibit "A"
and by their execution of this License waive any right to object to said plans.
5. t15e of License Area.. Licensee acknowledges that LJS operates a restaurant in the
Building located on the properly of which the License Area is apart, and that LJS has agreed
to enter into this License based in material part upon Licensee's representation that its. use c`

LANDSCAPE GUIDELINES
FOR THE NORTHGATE ZONING DISTRICT

In an effort to ppromote an attractive and functional urban. setting in
the North ate District, the followin ideas are incorporated into the
landscape~treetscape requirements ~or this area...
1) In areas where buildinggs and sidewalks. exist, maintain a .minimum
~ pedestrian walkway.: of 60" (5 feet).. This is' the minimum space
I, required by A.N.S.I. standards for the side by side passage of two
', wheelchairs.: This. walkway space may .:either be on the building .side
or the curb side of the sidewalk. Many .existing. building sites in
Northgate lack enough space to include any landscape/streetscape
additions.. These.. sites shall be considered exempt from external
requirements.
2) The .landscape/streetscape improvements should encompass at
least i/3 of the width. of the building frontage. Doorway .widths shall.

conditions. Initial planting size and mature height/spread.. are
important issues.:
