SUBJECT: Parking Lot Plan -Dry Cleaner, Car Wash & Lube Center; proposed mixed use
development to be located at 3950, 3952 and 3954 Texas Avenue South, Tract
F-3 of the Ponderosa Place Subdivision Section II. (95-413)
A Project Review Committee meeting was held Wednesday, July 5, 1995 to discuss the above
mentioned parking lot plan. Staff Planner Dunn moved to approve the proposed site plan with the
following discretionary items, ordinance requirements and comments:

_ The drainage report is still being reviewed by staff; however, it appears that the detention
pond sizing is workable. In order to screen the detention pond, install lows bbery '~
along the Frontage Road and the adjacent access drive to the existing power pole. ~„ ~~nb~`"~'.

The following is a list of ordinance requirements identified by the Project Review
Committee. This list does not relieve the applicant of total compliance with all current
ordinance requirements.
Ordinance Requirements:
The 28' access easement must be marked as afire lane in order to utilize the proposed fire
hydrant. No parking will be allowed in this fire lane.
Submit a complete landscape plan with planting details and irrigation system.

Submit details on the proposed traffic directional signs with the building plans for review
and approval. The proposed signs and locations are not approved with the site plan.
_ Denote which easement is referred to in the access agreements section and clearly define
the easement on the site plan. (Staff is concerned with the location of five parking spaces
in that access easement and would prefer to exclude those parking spaces from the
easement to be dedicated.)
_ Outside electrical disconnects are required for all buildings.
.Attach water and sanitary sewer demands.
Show meter locations, existing and proposed utility lines and their sizes.
Comments/Concerns:
Staff has determined that the proposed shared dumpster is acceptable; however, show an
alternate location on the Exxon site in case a dumpster is needed in the future. If in the
future there is a dispute between the two property owners, Exxon must have an acceptable
location for their own dumpster.
_ The customer must provide two conduits from the existing pad transformer to the meter
location on the building approximately 36" deep. The customer is also responsible for
20% of the total cost of service. Coordinate the relocation of the existing power pole to
be done at the owner's expense and electrical service details with Electrical Line Designer
Don Lusk at (409) 764-3660.
Conduit and/or easements are required to provide telephone service to the development.
Coordinate telephone service details with G.T.E. Representative Laverne Akin at (409)
821-4723.
P&Z Representative Garner seconded the motion to approve the site plan with the above
mentioned conditions which passed unopposed (3 - 0).
SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE REVISED
SITE PLAN ATTACHED TO CONTINUE WITH PHASE II OF THE BUILDING PERMIT
PROCESS. COORDINATE .FUTURE SUBMITTALS WITH DEVELOPMENT
COORDINATOR SHIRLEY YOLK AT (409) 764-3570.
APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee
to the Planning and Zoning Commission within five days after the PRC Committee meeting.
Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions
imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether
under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of
the final site plan as approved by the PRC, showing all changes and requirements imposed by the
PRC, and accompanied by a written explanation of those items being appealed. Until said copies
are. on file, no further development approval shall occur, and no further action by the Commission
shall take place. An applicant may appeal only certain aspects of site plan review, and in the
absence of discretionary review by the Commission, or review pursuant to a petition, all other
aspects of the site plan shall be final. Any notice of appeal shall state with particularity the aspects
