SUBJECT: Parking Lot Plan -Wayne Court's Snow Cones; proposed snow cone business to
be located in the parking lot of the existing Leon Sevcik Texaco station located at
2200 Longmire Drive near the F.M. 2818 intersection. (95-410)
A Project Review Committee meeting was held Wednesday, May 17, 1995 to discuss the above
mentioned parking lot plan. The Committee expressed concern of intensifying the existing
parking situation by eliminating parking spaces to allow a snow cone building. However, the
applicant determined that the existing service area is 4764 square feet (requiring 48 spaces) and
the sales area is 943 square feet (requiring 4 spaces). Including the bay areas, there are a total of
69 parking spaces for the site, exceeding current ordinance requirements by 17 parking spaces.
Assistant City Engineer Morgan moved to approve the proposed site plan with the following
discretionary items, ordinance requirements and comments:

Discretionary Items:
Outdoor seating area is allowed as long as the entire area used by the snow cone building
does not exceed the proposed three parking spaces.
The following is a list of ordinance requirements identified by the Project Review
Committee. This list does not relieve the applicant of total compliance with all current
ordinance requirements.
Ordinance Requirements:
Show the dimensions of the proposed building area.
_ Submit a copy of the approval letter from the Brazos County Health Department.
Submit the required $500 bond.

P&Z Representative Hall seconded the motion to approve the site plan with the above mentioned
conditions which passed unopposed (3 - 0).
SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE REVISED
SITE PLAN ATTACHED TO CONTINUE WITH PHASE II OF THE BUILDING PERMIT
PROCESS. COORDINATE FUTURE SUBMITTALS WITH DEVELOPMENT
COORDINATOR SHIRLEY VOLK AT (409) 764-3570.
APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee
to the Planning and Zoning Commission within five days after the PRC Committee meeting.
Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions
imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether
under state or federal law.. An applicant appealing the decision of the PRC shall file ten copies of
the final site plan as approved by the PRC, showing all changes and requirements imposed by the
PRC, and accompanied by a written explanation of those items being appealed. Until said copies
are on file, no further development approval shall occur, and no further action by the Commission
shall take place. An applicant may appeal only certain aspects of site plan review, and in the
absence of discretionary review by the Commission, or review pursuant to a petition, all other
aspects of the site plan shall be final. Any notice of appeal shall state with particularity the aspects
which are to be appealed. Coordinate appeal process through Development Coordinator Shirley
