(95-407) A Project Review Committee Meeting was held Wednesday, Apri126, 1995 to discuss the above mentioned parking lot plan. City Engineer Laza moved to approve the parking lot plan with the following conditions: CONDITIONS OF APPROVAL: Discretionary Items: Enlarge the end island closest to the entrance and drive thru to include one parking space and the existing 12" elm tree. The proposed 4' concrete sidewalk along Texas Avenue is acceptable. _ The approval of the site plan is conditioned upon the approval of the final drainage report and grading plan. If the site is altered significantly because of the drainage, staff has the discretion to bring the site plan back before the Project Review Committee for their review and approval. _ The proposed parallel parking does not meet minimum AASHTO (American Association of State Highway and Transportation Officials) standards. The end islands should be reconfigured to meet these minimum standards and still meet the minimum parking island requirements. PRC Report Wings NMore Case #95-407 Page 2 of 3 The following is a list of ordinance requirements identified by the Project Review Committee. This list does not relieve the applicant of total compliance with all current ordinance requirements. Ordinance Requirements: _ Submit a landscape plan to include the required landscape and Streetscape plantings. Streetscape point requirements will be based on the additional parking lot frontage along Texas Avenue and the frontage along Deacon Drive. Staff calculated that 1110 landscape points and 1350 Streetscape points need to be provided. The new parking along Texas Avenue must be adequately screened. Show the required handicap ramps and details. _ Relocate the proposed dumpster to an angle on the adjacent property near the drive thru area. The dumpster will be a 4 yard container serviced by a front-end loader. The dumpster location must be adequately screened from all public rights-of--way. The sidewalk location along Deacon Drive must meet current ordinance requirements especially with respect to width and setback from the curb. The sidewalks along Deacon Drive and Texas Avenue must connect and continue around that corner of the property. _ Show the existing fire hydrant along Deacon Drive. The hydrant located in the existing apartment complex cannot be utilized for this site. Comments/Concerns: _ The developer must supply the concrete pad, the service conductor from the pad to the panel and two 4" conduits from the transformer location to the existing power pole and 30' of 4" rigid conduit for the riser up the power pole. The developer is also responsible for approximately 20% of the total job cost. Coordinate electrical service details with Electrical Line Coordinator Don Lusk at (409) 764-3660. _ The proposed parking area along the alley may create a maintenance problem due to the slope differential between the parking islands and the pavement section. _ The fire department has requested a fire lane from the entrance of Deacon Drive to extend approximately 100' into the site; however, this is not a requirement. _ There are .existing facilities to the building. P & Z Representative Lane seconded the motion to approve the site plan with the above mentioned conditions which passed unopposed (3 - 0). PRC Report Wings NN~ore Case #95-407 Page 3 of 3 SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE REVISED SITE PLAN ATTACHED TO CONTINUE WITH PHASE II OF THE BUII.DING PERMIT PROCESS. COORDINATE FUTURE SUBMITTALS WITH DEVELOPMENT COORDINATOR SHIRLEY VOLK AT (409) 764-3570. APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee to the Planning and Zoning Commission within five days after the PRC Committee meeting. Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of the final site plan as approved by the PRC, showing all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until said copies are on file, no further development approval shall occur, and no further action by the Commission shall take place. An applicant may appeal only certain aspects of site plan review, and in the absence of discretionary review by the Commission, or review pursuant to a petition, all other aspects of the site plan shall be final. Any notice of appeal shall state with particularity the aspects which are to be appealed. Coordinate appeal process through Development Coordinator Shirley Volk at (409) 764-3741. FILE NOTE Wings N More 3230 Texas Avenue South Case #95-407 A Project Review Committee meeting was scheduled for Wednesday, March 15, 1995 to review the site plan for the Wings N More (previously Apartments Plus) building at 3230 Texas Avenue South. Several issues were identified by staff, primarily access, that would change the layout substantially. Staff decided to have a predevelopment meeting instead of a Project Review Committee meeting so that these issues could be discussed and negotiated without a formal PRC. Staff members present were: Ed Hard, Veronica Morgan, Jane Kee, Shirley Volk, Natalie Thomas and Don Lusk. The following items were discussed with Stuart Kling, Thomas Baber, Mark Dennard, Lawrence Link and Steve Musser: _ Staff informed Mark that the curb cut along Deacon closest to the Texas Avenue Frontage Road must be closed. The second curb cut along Deacon can remain open; however, it must also provide cross access to the adjacent vacant lot. Two curb cuts will be allowed to the private alley as long as the minimum parking requirements are met. Mark agreed to close the curb cut on Deacon with the understanding that he can expand the second curb cut along Deacon to a maximum of 36' in width. (Ed suggested that because of the width, lane markings and arrows should be installed to help direct traffic flow.) _ Staff informed Mark that the existing driveway variance on the adjacent vacant property can be reconsidered by the Commission due to changed conditions since the variance was granted (Mark owns all of the property with frontage along Deacon from Texas Avenue to Longmire.) _ If parking is provided on the adjacent vacant lot, it can be placed in the utility easement; however, if parking is placed in the access and parking easement, adequate access must be maintained between the two properties. Mark informed staff that he would like to abandon the interior access and parking easements for all of the property that he owns. Staff suggested that he file an amending plat to clear up the easements or he can request an easement abandonment by the City Council. However, at that time, the access points for the entire property will be reviewed. At a minimum, the private access easements between the individual lots must remain so that each lot does not have direct access to Deacon. Wings NMo~e File Note #95-407 Page 2 of 2 _ Staff agreed to give up the 24' streetscape reserve along Deacon for the new driving aisle into the parking area as long as at least two of the large elm trees in that area remain. The narrowest that drive could be is 15' wide with one way access. The fire department does not need to access the site to provide fire protection. _ Staff agreed to give up the 24' streetscape reserve along the Texas Avenue Frontage Road for the new parking area with the addition of a landscaped parking island in the existing parking area. A sidewalk is required along the frontages of Deacon and Texas Avenue. If there is a ditch along the frontage road that would not allow a sidewalk, then a variance can be granted at the PRC level. If a variance is requested to not provide one in either location, then a variance must be granted by the P&Z. _ Show the existing fire hydrant along Deacon and take all fire protection measurements from that fire hydrant to see if an additional hydrant is required. _ The existing sign does not meet current ordinance requirements. Staff is researching the sign and suggested that Mark not spend any money on designing a new sign until staff has determined if the sign is legally non conforming. The dumpster must be screened from all public rights-of--way and accessible by a front-end loading truck. Veronica discussed drainage issues with Stuart Kling privately after the meeting. She informed him that TxDOT may not approve the proposed drainage plan especially with respect to the outlet into the Texas Avenue frontage road. Veronica also informed Stuart that she is concerned with the drainage discharge into the private alley and the maintenance of that alley. Natalie Thomas Planning Technician March 16, 1995
