RE: Appeal of the Project Review Committee requirements for the
construction of a sidewalk on Longmire Drive for Bovine Elite
(95-405)
This appeal is before the Commission at the request of Mr. Carl Rugg, owner of
Bovine Elite, Inc. at 3300 Longmire Drive. The legal description of this property is
Lot 6, Block 21, Ponderosa Place, a resubdivision of Southwood Valley Section 4-A.
The Presubmission conference was held on February 15, 1995 and required the
construction of the sidewalk along Longmire Drive at that time. The City's Sidewalk
Ordinance requires a sidewalk to be six feet wide when placed directly behind the curb.
If there is a six foot green space between the sidewalk and curb, the width of the
sidewalk is then reduced to four feet. The applicant is appealing this requirement due
to the surrounding properties along Longmire Drive not having sidewalks . Mr. Rugg
would like the City to construct and assess the property owners for their portion of the
sidewalk so that the sidewalks are continuous along Longmire Drive. A copy of Mr.
Rugg's letter is attached for your review. In a related case, the Longmire Mini-Storage
at 3400 Longmire Drive built a sidewalk required by the City's Sidewalk Master Plan
as part of their site plan.
Staff recommends denial of this variance due to consistency and to support the Project
Review Committee's decision to follow the City's Sidewalk Master Plan. The question
is whether or not the City plans to follow .the Sidewalk Master Plan and require the
construction of these sidewalks or to selectively enforce this plan on a case by case
basis. Staff feels that as development occurs, the developer should follow the
ordinances set forth by the City where applicable.

SFC 907.9.2
Extinguishers of a minimum classification of 2A-20BC shall be provided and so located that no pump,
dispenser of fill-pipe opening shall be a greater distance than 75' from such extinguisher.
SFC 907.4.6.2
Manually operated pump master switch shall be provided in an approved location, within 75 ft of, but no
nearer than 15 ft to, any dispenser. Where such master switch is not visible from all dispensers, the
location thereof shall be indicated by approved signs.
SFC 907.4.7.2
Emergency controls shall be installed at a location acceptable to the fire official, but controls shall be not
more than 75 ft from dispenser.

build a sidewalk on the frorrt of the property that we are nvw constructing our new
office. [also realize that with the city's long range plan calls for a sidewalk running the
length of Longmire to acxommodate future foot traffic. What l propose today is a
variance to the current requirement whereby Bovine Elite, [nc. is assessed for it's
portion of sidewalk at the same time that the remaining sidewalk is built in front of all
existing businesses. [believe that this is a fair proposal in light of the can-ent foot
traffic in the area.

I want to make some comments on the site plans scheduled for review on February 15.
1. Parking Lot Plan; Bovine Elite -
This site is operationally correct. However, the size of the container pad and the size of the screening
should be on the site plan.
2. Final Plat; Southwood Valley Section 19 -
I noticed that this site is being rezoned for multi-fanuly development. Since this site is bordered by four
streets, two of which have high traffic, we need to be aware of the container locations when this site is
developed.
These are my comments for these site plans. Please contact me if you have any questions.

Larry just called. Wants to be able to move guy in end of next week. Will
have everything ready he thinks except landscaping. Please get me the letter
of credit amount (the 5 X landscape points). Also by Monday or Tuesday he'll
be ready for a "driveby". If any of us see anything major to let him know
ASAP. Will you send out the word on this. Says his concrete flume and
curbing should be finished this weekend. I told him to go ahead and have the
letter of credit ready and then if he gets ahead and gets most landscaping in
we'll just take a letter from him for the reminder if it's minor like grass
and a tree or 2.

matter. I will grant the easement as soon as my engineer and surveyor can prepare the

SUBJECT: Parking Lot Plan -Bovine Elite; proposed facility to be located at ~346A Longmire
Drive, Tract A of the Ponderosa Place Subdivision totaling 0.713 acres. (95-405)
A Project Review Committee Meeting was held Wednesday, February 15, 1995 to discuss the
above mentioned parking lot plan. Assistant City Engineer Morgan moved to recommend
approval of the parking lot plan with the following conditions:
CONDITIONS OF APPROVAL:
The following is a list of ordinance requirements identified by the Project Review
Committee. This .list does not relieve the applicant of total compliance with all current
ordinance requirements.
Ordinance Requirements:
Site Plan Related.•
In the parking legend, break down the square footage's of office and storage/warehouse
and show where these separate uses are located within the building.
The solid waste container pad must be at least 12 x 12.

~~ _ The proposed driveway location is not approved. Submit a drawing that shows the
R, adjacent and opposite driveways along Longmire so that staff can determine if it meets
current ordinance requirements.
Provide a sidewalk along the Longmire frontage.
Provide radii on curbs interior to the site.
Provide sidewalk, curb and pavement details.
_ Check the fire flows on the existing fire hydrant to see if the flows are adequate to provide
coverage for the proposed site.
Add a table for water, sewer and irrigation demands to include taps and meter sizes.
_ The driveway throat length must be a minimum of 40'; currently it's only 29'.
Submit details on the drainage outlet structure.
_ Runoff for this site must go to a defined drainage area. This should be addressed as part
of the drainage development permit prior to any site work.
May have problems with DDP -with regard to an access easement?
Landscape Plan Related.•
An additional 480 points are needed for Streetscape compliance.
Screen the first parking space with a berm or shrubs or wall.
Submit an irrigation plan prior to the issuance of a certificate of occupancy.
Comments/Concerns:
Extend the utility easement out to Longmire Drive to allow for a future street light circuit.
Provide two 2" conduits along the entire length of the south property line for the street
light circuit. The customer will also be responsible for 20% of the total cost of electrical
service. Coordinate details with Electrical Line Coordinator Don Lusk at (409) 764-3660.
G.T.E. has existing buried facilities along the rear property line (northwest) of this
development. The developer/owner is to provide two 3" diameter PVC pipe with pull
string from the rear property line (northwest) to the outside termination point. The PVC
pipe shall ell up 4' at the termination point and the conduit should be capped. The service
entrance must be located within 20' of the power service multi-ground neutral and no
closer than 36". If termination is not within 20' of power service multi-ground, a 8' x 5/8"
ground rod must be placed at the base of the termination. Coordinate details with G.T.E.
Representative Laverne Akin at (409) 821-4723.

P & Z Representative Hall seconded the motion to approve the site plan with the above
mentioned conditions which passed unopposed (3 - 0).
SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE REVISED
SITE PLAN ATTACHED TO CONTINUE WITH PHASE II OF THE BUILDING PERMIT
PROCESS. COORDINATE FUTURE SUBMITTALS WITH DEVELOPMENT
COORDINATOR SHIRLEY VOLK AT (409) 764-3570.
APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee
to the Planning and Zoning Commission within five days after the PRC Committee meeting.
Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions
imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether
under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of
the final site plan as approved by the PRC, showing all changes and requirements imposed by the
PRC, and accompanied by a written explanation of those items being appealed. Until said copies
are on file, no further development approval shall occur, and no further action by the Commission
shall take place. An applicant may appeal only certain aspects of site plan review, and in the
absence of discretionary review by the Commission, or review pursuant to a petition, all other
aspects of the site plan shall be final. Any notice of appeal shall state with particularity the aspects
which are to be appealed. Coordinate appeal process through Development Coordinator Shirley
