HomeMy WebLinkAboutStaff ReportSTAFF REPORT Case No.: 95-307 Applicant: McClure Engineering for Omar Smith Enterprises ITEM: Preliminary Plat of Carter Lake Acres, an ETJ subdivision ITEM SUNIlVIARY AND STAFF RECOMMENDATION: Carter Lake Acres is an ETJ Subdivision located at the northwest corner of the Rock Prairie Road and Bradley Road intersection (Actually part of the subdivision is within the City Limits while the majority is in the ETJ). A Presubmission Conference was held on April 5, 1995 to discuss this item. At this meeting, staff recommended that a clarification be made to general note #11. As written, the note is not legally enforceable. Also, due to the fact that these lots take their sole access from Harris Road and Bradley Road, staff recommended that these existing streets be brought up to County rural road standards. The Subdivision Regulations state within the Special Conditions in Area of Extraterritorial Jurisdiction that, "Streets...does not require a curb and gutter, but requires all-weather, gravel or crushed stone base, road surface with not less than a two(2) course inverted penetration asphalt surface." This description would meet the County rural standards. Both roads as existing do not meet these standards. Staff also recommended that additional right-of-way, in accordance with a recent right-of- way/alignment study of Rock Prairie Road (SH6 to Greens Prairie Road), be dedicated. Staff recommends. approval of the plat. with the condition that note #11 be modified, that Harris and Bradley Roads be upgraded, that additional right-of-~ way along Rock Prairie Road be dedicated and with the remaining comments as outlined in the Presubmission Conference Report, attached. Quality Service -Citizens benefit from a reasonable tax revenue for the value and quality of service delivered. Cultural Arts -Citizens benefit from participation in the arts. Employment/Prosperity -Citizens benefit from an environment that is conducive to providing diverse employment opportunities. Civic Pride -Citizens benefit from well. planned, attractive residential and commercial areas. COMPREHENSIVE PLAN -The following are Goals and Objectives from the City's adopted Comprehensive Plan. Applicable ones are in bold. Streets -Rock Prairie Road is a minor arterial adequate to handle traffic. Additional right-of-way for Rock Prairie Road, per a recent engineering study establishing right-of-way needs and alignment, is being dedicated on lot 1. Drainage -Overland. with little to no impact because of the large lot sizes. Flood Plain -None Sidewalks -N/A Parkland Dedication -Will be dedicated with final plat for lots within City SUBDIVISION ORDINANCE COMPLIANCE Proposed Public Improvements -Improvements to Bradley Road. Easement Dedications - As shown on the plat. ZONING ORDINANCE COMPLIANCE Proposed Use -Single Family Does proposal comply with zoning ordinance regulations? - No. Applicant will seek a rezoning of the lot within the City in order to meet minimum lot size requirements. Current zoning of A-O requires minimum 5 acre lot. R-1 requires 5,000 S.F. 2
