In order or accommodate this along with all utilities, a 100 ft wide right-of-wa;y is anticipated as a requirement. A conceptual cross-section of the envisioned 100 ft right-of-way is included as Figure 1. We appreciate the opportunity to perform this service in reviewing the rights- of-way requirement for the .City of College Station. If any questions arise, we will be glad to address them. As per our conversation, on the Carter Lake Acres preliminary plat, the language on the plat is not sufficient to bind the property owners to dedicated the additional ten feet in width of right-of-way. A promise to dedicate in the future is revocable at the discretion of the offeror. It is my understanding that the other concern that you had was the location of utilities in this "potential right-of-way." You can require the utility easement to be located adjacent to this extra ten feet in width. If you want the seventy foot right-of-way, you can require the property' owners to dedicate the full width and then maintain it as a sixty foot wide street until the County agrees to take over the maintance function. As to the improvement of the street. I am of the opinion that you~~;Can require the improvement of the street that is adjacent to this subdivision. This street is the only access to this subdivision and the subdivision of the property will place an additional burden on the existing substandard infrastructure. It went well this AM with your suggestions. The owner did balk at the req. to improve the private road but we went for it anyway. They may ask for a variance or argue their opinion of the legality of it at Council when we get there in May. Bart Munroe is the owner and as you know he's an attorney. Legal should have received the packet of stuff that will be reviewed this Wed. at PRC. In it there is a preliminary plat of Carter Lake Acres. Part of this is in the City and part is in the County (NOT in an area we are looking at for annexation). Note 11 (the 1st note 11) apparently defers the additional right-of-way that the County wants until such time as the road (which is currently a private road) becomes public. I've never encountered a note like this before and maybe the City doesn't care. Is this note enforceable on future owners of the lots and shouldn't there be a minimum dedication mentioned. It just says "as per County standard'°. It is a dedication beyond our City standard. I guess my basic question is should we be concerned about this note? If the County wants to grant a variance to their ROW dedication is this the way for them to do it? BOX 3788 • PHONE 409-846-2222 BRYAN, TEXAS 77805 April 11, 1995 Ms. Bane Kee City Planner CITY OF COLLEGE STATION P.0• Box 9960 College Station, Texas 77842 RE: CARTER LAKE ACRES PRELIMINARY PLAT STAFF REVIEW AND COMMENTS Dear bane: Pursuant to the completion of the outstanding items listed in your April 7, 1995 Presubmission Conference Report, I submit the following clarification/explanation of the items not addressed on the revised preliminary plat: With reference to your comments on General Note 11, it: seems apparent that I have failed to communicate to you that OMAR SMITH ENTERPRISES, INC. does not have total control of the private road (called Harris Road). We are simply one of many homeowner association members who are guaranteed access to our property as documented in the recorded deed restrictions for Carter Lake Subdivision. Each member pays a yearly fee for the maintenance of the road. Consequently, this is a privately owned perimeter road. In the event that the County is to assume maintenance, upgrading to County Standards at that time would seem appropriate. The Robert Poling tract along the southwest side of the proposed subdivision was subdivided from the parent tract prior to 1970. I have searched the County Deed Records and have found that the property was in its present configuration on 11/22/b8 as evidenced by a recorded deed from James David Carroll et ux to Elton David Smith et ux in Volume 274, Page 817. Concerning establishment of the Pipeline boundaries, Mr. :Eiaskell Rogers with EXXON PIPELINE COMPANY, P.O. Box 2220, Houston, Texas 77252- 2220, has begun the work to redefine the existing pipeline easement. The County Commissioners' Court approved the Preliminary Plat at its regularly scheduled meeting on April 10, 1995. Should you have further questions concerning this plat, please advise.
