Legal request went up today. When you
get it see if you can tell me how long
it might take. Developer wants to get
final plat approved so he can sell
property and make money (hopefully to
pay off back taxes). I think dev.
agreemnt. and final plat should go
together to Council 'cause they're both

Talked to Robert Todd today. He reps. Credit Union sale I guess. He
referenced a mtg. where we told him that City would purchase ROW from Credit
Union. This is true. Kyle is not on T-fare plan and this would be our
normal procedure. I don't remember this mtg. but I believe it could have
occured. It was long before 2 things occured - the emphasis CIP Comm.
placed on Kyle extension and LaCour wanting to defer WPC dedication. Roop
called me just now to get an update. I called Taggart right after lunch and
he was in a mtg. Haven't heard back. Roop says Taggart is supposed to make
it clear that LaCour does not intend to dedicate ROW across Creidt Un.
tract. Their deal is already sealed. Options I see are LaCour can go ahead
and develop or dedicate the WPC property as per ord. Maybe City can
ultimately purchase RoW from Credit Un. but what can we get now if we agree
to this? Anyone got any bright ideas. I hate dev. Agremnts. - they are
never nice things.

shirley caught me today to speak to a
man about the kyle alignment through
the noonan/dale tract. he is working on
teh dale tract. i would tike us to
somehow (either we do and pay for or
something) decide on an alignment so we
can get as much row with these two
plats (noonan and dale) and not have to
realign and reaquire row to correct for
the 35'offset. because of the creek
alignment in here, i dont think we can.
just look at an aerial or topo and
figure it out in final form. i think we
wilt need it surveyed to determine the
best angle to cross the creek with the
bridge. any guidance or suggestions
here. according to shirley, this guy
will be coming back in for a predev.
meeting in the near future. food for
thought. is the better part of valor
here to just take the 35' off each and
let the cip project that will
ultimately build kyle worry about
alignment and payment for future row
acquisition?

FYI- we are looking at prelim. plat of
Noonan right now. Any merit in trying
to shift the ROW a little at the LaCour
line to help line it up better?

I haven't looked at the plats, etc. in
some time, but, I would think that
lining up better would be good.

OK - we'll look at it. - Whoops, back
up. We won't look to take any more RoW
off the Noonan tract. We 'll hvae to
get it from Dale and work from there.
I just talked to Jim and clarifies his
response. He did not intend to change
what we told the Noonans which is what
they show on their PP.

ok, we can look at alignment and if it
affects noonan, we will just know it
for future acquisition. if it affects
dale, we could get it now. kent, i need
money so we can hire someone to do an
alignment study and the necessary
survey work needed around the creek for
the bridge alignment, we dont have
enough time to do it in house. given
what we are trying to do, i dont think
we can impose this requirement on the
dale property, since noonan and lacour
didnt have to partake. you guys let me
know if you dont agree.

Robert Todd just called and said the
credit union probably will not want to
build on the WPC land because of the
imposition of the dedication of the row
for the street (extension of S Kyle).
He recalls a meeting with staff at
which time staff talked about a
possible future extension of a street
in that location, but with the
understanding (at Least on their part)
that the location would be identified
and value of the property would be
determined with a purchase of the row
to follow. I don't remember being in a
meeting with that particular
conversation - all I remember is that
they were urged to work with Taco Bell
to get the existing drive to that
business closed, so the 2 businesses
could share a drive which would be
directly in line with the existing
street & traffic signal at S Kyle &
Harvey. He says this will undoubtedly
cause the project to be scrapped. This
is FYI. I forgot to cc Elrey on this.
