Item: Consideration of a preliminary plat and final plat of Trinity Gardens
Subdivision.
Item Summary: The preliminary plat of the subject property includes 5 acres
located south of and adjacent to the Foxfire Subdivision. The property is
located just outside the City limits. Both the preliminary plat and the final plat
show three single family lots to reflect a previous subdivision. Council
considered a contract for sewer service on 4-13-95 and approved it contingent
upon the property being platted. An annexation petition has previously been
accepted by the City Council for Lot 1, but there has been no direction as to
when to begin annexation proceedings. Staff recommends approval of both
the preliminary and final plats with presubmission conference notes. The
County has approved both with conditions which will be met prior to filing for
record.

SUBJECT: Preliminary Plat -Trinity Gardens Addition (Bird Pond Addition); proposed subdivision totaling 5.00
acres located on the northeast corner of the Bird Pond Road and Frost Drive intersection. (95-302)
A Presubmission Conference was held Wednesday, March 8, 1995 to discuss the above mentioned preliminary
plat. The following ordinance requirements were made by the various staff members:
Ordinance RecLuirements:
Show the location of Francis O'Brien°s house.
_ Show the private water line located within the future right-of--way dedication.
_ Submit a letter from the County Commissioner's court approving the preliminary plat prior to the
Planning and Zoning Commission meeting scheduled for Thursday, Apri16, 1995.
_ There could be a potential .setback encroachment if the properly is ever annexed. There should be a
minimum 7 1/2' setback between the existing shed and the property line.
_ Reflect proper distances of the right-of--way and property lines along Frost Drive and Bird Pond Road.
Remove the "actual" vs. "proposed" dimensions and wording on the plat and only include what is being
dedicated with this plat.
_ The sanitary sewer service is a separate issue; however, staff would recommend the extension of the public
line instead of the extension of a private line unless staff receives information that shows the public line is
not feasible.
SUBMIT 1 MYLAR ORIGINAL AND 15 COPIES OF THE REVISED PRELIMINARY PLAT BY FRIDAY,
MARCH 31, 1995 TO BE INCLUDED IN THE PACKETS OF THE PLANNING AND ZONING COMMISSION

SUBJECT: Final Plat -Bird Pond Addition; proposed single family lot to be annexed into the
City limits totaling 0.98 acres and part of an original 5.0 acre tract owned by
Francis O'Brien. (95-202)
A Presubmission Conference was held Wednesday, January 18, 1995 to discuss the above
mentioned final plat. The following ordinance requirements and comments were made by the
various staff members:
Ordinance Requirements:
_ If the reserve tract is not included in the final plat, correct the title block acreage and
remove the "reserve tract" from the title.
Dedicate a private utility easement to cover the existing private water line that crosses lot
1 to serve the reserve tract.
Dedicate a .private access easement if access will be shared between lot 1 and the reserve
tract.
_ If the applicant wants to avoid a potential setback encroachment if the property is ever
annexed, then there should be a minimum 7 1/2' setback area between the existing garage
and the proposed property line.
_ The final plat must be reviewed and approved by the Brazos County Commissioner's
Court and a letter of approval from the County Engineer must be received prior to the
City Council meeting. scheduled for February 23, 1995.

Commissioner Lightfoot moved to recommend approval of the rezoning request of block 14A of
Southwood Valley Section 19 located on the southeast corner of the F.M. 2818 and Southwood
intersection from C-1 General Commercial to R-4 Low Density Apartments with staff
recommendations. Commissioner Garner seconded the motion which passed unopposed (5 - 0).
AGENDA ITEM N0.4: Consideration of a preliminary and final plat for the Bird
Pond Addition located south of the Fogfire Subdivision in the City's E.T.J. ~5-302 & 202)
Senior Planner Kuenzel presented the staff report for both the preliminary and final plat. The
subject property is located just outside the City limits. The preliminary plat shows one single
family lot (0.98 acres) and one reserve tract (the remainder) to reflect a previous subdivision. The
final plat is of the 0.98 acre single family lot only, the reserve tract is not being final platted at this
time. Council will consider a contract for sewer service as part of the final plat. An annexation
petition has previously been accepted by the City Council but there has been no direction as to
when to begin annexation proceedings. Staff recommended approval of both the preliminary and
final plats with the presubmission conference notes.
Representative of the applicant, Earl Havel with Garrett Engineering approached the Commission
and stated that he is currently working with the County to schedule the plats for the
Commissioners Court.
Commissioner Gribou moved to recommend approval of the preliminary and final plats of the Bird
Pond Subdivision with staff recommendations. Commissioner Smith seconded the motion which
passed unopposed (5 - 0).
AGENDA ITEM NO. S: Consideration of a variance request to the paving
requirements for a portion of the rear drive surface for the proposed Coca-Cola Warehouse
Building to be located on the north side of Sebesta Road approximately 200' west of Foxfire
Drive. (94-424)
Project Engineer McCully presented the variance and recommended denial of the request. The
proposed warehouse on Sebesta Road is required to provide access to all points of the building
for fire department response. To meet this requirement, the applicant chose to provide a
minimum width lane around the building which connects with the driveway and parking areas at
the front of the building. In addition, in order to meet the City screening requirements for trash
receptacles,. the dumpster pad was placed behind the building adjacent to the fire lane. This drive
lane will therefore need to accommodate emergency vehicles, sanitation trucks, as well as cars and
delivery trucks used for the business. In accordance with Ordinance Section 9.2, all off street
parking areas, including access drives, must be surfaced in concrete or asphalt, and must be
curbed. On January 17, 1995, staff received a request that the drive lane around the rear of the
building be treated as a temporary parking lot, or be considered for a variance; in either case to be
allowed to use gravel surfacing instead of asphalt or concrete. The Ordinance only provides for
temporary (gravel) parking lots where they are not needed to meet other ordinance requirements.
As this is not the case here, the only recourse is to meet the Ordinance or seek a variance.

and the reserve tract, a private access easement must be dedicated.
