Apparently the O'Bries were not willing to meet the County's requirement on the plat. Our conclusion was that. until the plat was. approved by the County and filed for record there remains a subdivision reg violation and we cannot make any utility connections. I asked Shirley to inform Ed O'Brien and Ray Crow of this position. I also spoke with Joe Brewster today. He says his house is on the market and has conserns re: the plat not being filed due to Dr. Henry's refusal to sign. I also got ahold of Don Garrett, the engineer for the O'Briens ~~~'~-~ and explained that the City would continue processing the plats he turned in m on these properties, but would not provide utility connections unti_1 the -~ Fr~t~ subdivision violations are corrected. Don called me back, said he had 'o '~ gotten in touch with Ray Crow, had worked out what has to be done to satisfy the county. He said to hold up on processing the plats, since they will be changing to meet the County's needs, and he would be bringing in some revisions. I guess to save the O'Briens money, we ought to have the Council delay action on the plats (if that would comply with the 30 day rule), or if that won't work, I guess we will just have to with-draw them at the request of the applicant's engineer. I'll keep trying to get in touch with Mrs. O'Brien to let her know what's going on. I really don't like withdrawing the plat without her knowledge, but as I think about it, I don't think delaying action meets the statute requirements. Anyway, I've got a call in to Ray Crow to confirm what Don .Garrett told me. After that meeting, the County Court of Commissioners met to review the same plats and required additional ROW dedication and they required that all of the property involved in the preliminary plat be included on the final plat. The changes required by the County were great enough to necessitate another review by the City Commission. Therefore you are seeing the plat for the second time for recommendation to Council. Both plats now include three lots, whereas the previous Bird Pond plats showed only two lots with only Lot 1 to be finaled. Staff recommends approval.
