AGENDA ITEM NO. 1: The Consent Agenda consists of non-controversial or
"housekeeping" items required by law. Items may be removed from the Consent Agenda by any

Consent agenda items 1.1, 1.2, 1.3 and 1.4 were approved unanimously by consent.
AGENDA ITEM NO. 2: Consideration of a previously tabled conditional use permit request
to allow the Kanon Bible Church facility to be located at 317 Dominik in the Culpepper Plaza
Phase II Center. (95-712)
Commissioner Gribou moved to remove the conditional use permit request from the table for
consideration. Commissioner Lane seconded the motion which passed unopposed (6 - 0).
Senior Planner Kuenzel stated that the request was tabled to answer the following three questions:
(1) If the church is approved, how would existing sites that currently sell alcohol be affected
upon future repermitting?
(2) Is there a variance procedure to the 300' distance limitation?
(3) Will the Bentley House be restricted from placing refrigerators offering alcoholic
beverages in each room if the conditional use permit is granted?

Item: Consideration of a final plat of Harvey Road East and Gateway Park
Subdivisions. (95-242)
Item Summary: The subject property is located at the intersection of Harvey Road
and State Highway 6. This final amending plat of Lot 1 R of the Harvey Road East
Subdivision and Lot 2, Block 2 of Gateway Park Subdivision reflects the as built
conditions of a 30 foot private access easement. This easement provides access
from the public alley to the Furrow Building Materials expansion. In addition to the
comments. made at the Presubmission Conference held on November 1, 1995, staff
requested that the private drainage easement be designated as public with the
condition that all unimproved channel sections be maintained by the property owner.
This designation gives the City the authority to enter the property during emergency
situations to correct drainage problems. This concern however, was not discussed
during the Presubmission Conference but is considered to be of high importance due
to the existing conditions of other private drainage easements. The engineer for this
plat has made this easement designation including a note for the above mentioned
condition. Staff recommends approval with the comments identified at the
Presubmission Conference. The Planning and Zoning Commission considered this
item at their November 16, 1995 meeting and recommended approval by consent.

SUBJECT: Final Plat -Harvey Road East & Gateway Park; proposed .amending plat of lot 1
of the Harvey Road East Subdivision and lot 2, block 2 of the Gateway Park
Subdivision located at the north intersection of State Highway 30 and the East
Bypass. (95-242)
A Presubmission Conference meeting was held Wednesday, November 1, 1995 to discuss the
above mentioned final plat.. The following is a list of ordinance requirements identified by
the Presubmission Conference. This list does not relieve the applicant of total compliance
with all current ordinance requirements.
Ordinance Requirements:
_ Move the legal description and ownership information of the Sam's Subdivision lot closer
to the resubdivision plat drawing.
Note the owner of the 10' x 157.5', 15' x 145.5' and 10' x 411.5' utility easement located
on lot 1R of the Harvey Road East Subdivision.
Note the total area of the plat. (12.62 acres)
_ Correct the right-of--way designation. of State Highway 30 near the Gateway Park
Subdivision. (Shown at 50' right-of-way and previous plat shows a 150' right-of--way.)
_ Note that the existing 50' wide alley in the rear of the lots is a "private" alley.
_ Correct the vicinity map with respect to Appomattox and Dartmouth Drives.
_ Provide a 20' public utility easement across the East Bypass frontage to cover the existing
overhead electrical line.
