COMMISSIONERS PRESENT Chairman Hawthorne and Commissioners Gribou, Smith, Hall, Garner and Lane. COMMISSIONERS ABSENT: Commissioner Lightfoot STAFF PRESENT: City Planner Kee, Assistant City Engineer Morgan, Senior Planner Kuenzel, Graduate Civil Engineer Homeyer, Planning Technician Thomas and Transportation Planner Hard. AGENDA ITEM NO. 1: The Consent Agenda consists of non-controversial or "housekeeping" items required by law. Items may be removed from the Consent Agenda by any citizen, City staff member, or Commissioner by making such a request prior to a motion and vote on the Consent Agenda. (l.l) Approval of minutes from the meeting of November 2, 1995. (1.2) Consideration of a final E.T.7. plat of Willow Run Subdivision Phase One. (95-230) (1.3) Consideration of a final plat of Pebble Creek Phase 3C Subdivision. (95-241) (1.4) Consideration of a final plat of Harvey Road East and Gateway Park Subdivisions. (95-242) Consent agenda items 1.1, 1.2, 1.3 and 1.4 were approved unanimously by consent. AGENDA ITEM NO. 2: Consideration of a previously tabled conditional use permit request to allow the Kanon Bible Church facility to be located at 317 Dominik in the Culpepper Plaza Phase II Center. (95-712) Commissioner Gribou moved to remove the conditional use permit request from the table for consideration. Commissioner Lane seconded the motion which passed unopposed (6 - 0). Senior Planner Kuenzel stated that the request was tabled to answer the following three questions: (1) If the church is approved, how would existing sites that currently sell alcohol be affected upon future repermitting? (2) Is there a variance procedure to the 300' distance limitation? (3) Will the Bentley House be restricted from placing refrigerators offering alcoholic beverages in each room if the conditional use permit is granted? City Engineer December 14. 1995 Executive Member Approval: Ends Statements /Strategic Issues:#8 -Civic Pride Item:Consideration of a Final Plat (Replat) of Pebble Creek Phase 3C, a right- of-way dedication plat for a portion of Spearman Drive, located between Putter Court and St. Andrews Street.(95-241) Item Summary: This plat is a right-of-way dedication plat for Spearman Drive. The purpose is to correct some existing drainage problE:ms in the area and provide a better connection between a large portion of i;he Pebble Creek Development and the Phase 5 sections where the new Pebble Creek elementary school will be located. The applicant is requesting to delay the installation of the sidewalk along the west side of Spearman, as portions would have to be removed as new phases, with street intersections, come in on that side. Because development on the east side of Spearman is complete, installation of that sidewalk does not pose a problem. Staff is concerned with the delay of the sidewalk on the west because of the anticipated August 1996 opening of the elementary school and the adjacent City park. Staff and the applicant have agreed that the sidewalk could safely be delayed until May 1996, in the hopes that construction plans for the futurE: west phases would be completed prior to that and construction would begin ar~d incorporate the sidewalk. In the event that this does not occur, staff is recommending that the applicant begin construction on this sidewalk in May so it will be complete when school opens. In addition, the drainage from this street is being designed to outfall into an open channel, which does not meet all of the City's drainage criteria. Because this is a temporary measure, again awaiting construction of the west phases, staff recommends thafi. the developer not dedicate a public drainage easement across this section, and instead maintain this section on private .property with assurances of maintenance. The applicant is agreeable to these recommendations. The P&Z heard this item at their November 16, 1995 meeting and recommended approval by consent. (95-241) A Presubmission Conference meeting was held Wednesday, ]November 1, 1995 to discuss the above mentioned final plat.. The following is a list of ordinance requirements identified by the Presubmission Conference. This list does not relieve tlhe applicant of total compliance with alt current ordinance requirements. Ordinance Requirements: Provide a vicinity map. Note that there is no floodplain on the subject property. The applicant has requested to waive the construction of the sidewalk along the west side ( of Spearman Drive until the development of that propperty or May of 1996, whichever comes first. Staff will recommend approval of this request with the condition that a ~ uarantee is posted for the design and construction of that sidewalk or the sidewalk is r constructed and accepted prior to filing the plat for record. Work with staff on the maintenance details of the temporary open channel drainage from ® Spearman Drive to the area west of that extension.
