Reverend Jackson of the New Hope Baptist Church approached the Commission and stated that there are only a few members of the church at this time and they would like to continue worshipping in the existing building. He requested that the Commission give the church a chance to worship and grow at their existing location as they have for the past eight months. Reverend Jackson stated that they have finished with the interior improvements; however, they are still installing siding on the exterior. Commissioner Lane closed the public hearing. Commissioner Lightfoot moved to grant a conditional use permit request to New Hope Baptist Church at 1200 Carolina Street with staff recommendations. Commissioner Garner seconded the motion which passed unopposed (4 - 0). AGENDA ITEM NO. 3: Public hearing to consider a final plat of Shenandoah Phase One, Block B. (95-236) Assistant City Engineer Morgan presented the staff report and informed the Commission that the replat is subdividing an existing 1.20 acre reserve tract at the front entrance of the Shenandoah Subdivision into two lots for future development. The property is currently zoned C-N neighborhood commercial. A Presubmission Conference was held on October 4, 1995 at which time staff required the applicant to show the proposed shared access easement between lots 1 and 2 of block B and that the owner's signature block be signed prior to filing the plat. Staff recommended approval of the final plat with the conditions listed in the Presubmission Conference report. Commissioner Lane opened the public hearing. Seeing no one present to speak in favor of or in opposition to the request, he closed the public hearing. Commissioner Garner moved to recommend approval of the final plat of Shenandoah Phase One, block B with the recommendations listed in the Presubmission Conference Report. Commissioner Lightfoot seconded the motion which passed unopposed (4 - 0). AGENDA ITEM NO. 4: .Consideration of a final plat and revised preliminary plat of the Estates at River Run Phase II Subdivision located in the City's E.T.J. (95-237) j/' Graduate Civil Engineer Homeyer presented the staff report and stated that the revisions to the preliminary plat were made in order to reflect changes made by phase two of this development. The applicant is requesting a variance to the cul-de-sac lengths in phase two. Staff recommended approval of this variance request due to the low density of the area and the small number of homes that can be constructed on these cul-de-sacs. There is a conflict with Texas A&M University's effluent easement as shown on the final plat. The City's legal staff recommended that in order to share that easement with the University, the developer must obtain a letter of approval from the University or either shift the cul- de-sac configuration so that the overlap does not exist. Staff recommended approval of the final plat and revised preliminary plat with the comments identified in the Presubmission Conference Report. Commissioner Garner questioned staff about the drainage comment in the Presubmission report. Graduate Civil Engineer Homeyer stated that the legal department has determined that the City's drainage ordinance cannot be enforced in the City's extra territorial jurisdiction. Commissioner Lightfoot moved to recommend approval of the revised preliminary plat and final plat of Estates at River Run Phase II Subdivision with staff recommendations. (95- 237) Item Summary: The subject property is located to the north of Estates at River Run Phase I in the City's E.T.J. A Presubmission Conference was held on October 4, 1995 and Staff recommends approval with the comments identified at that meeting. The Planning and Zoning Commission heard this item at their October 19, 1995 meeting and recommended approval with the Presubmission Conference comments .and the following conditions. The first alternative would be for the developer to shift the cul-de-sac and utility easement so that the proposed easement did not encroach upon Texas ABM University's effluent easement. The second alternative would be for the developer to approach Texas A&M and receive a written agreement to share this easement. Staff feels this modification to the plat is necessary in order to protect the City's utility interests in the future, if and when this subdivision is annexed. Texas A&M, as the easement holder; has primary rights to this easement to maintain and operate their facility. If A&M feels this encroachment would impair their ability to maintain their utility line, then they could require the secondary utilities to be removed. Another scenario, would be that during the maintenance of A&M's utility, they damage the secondary utility, the owner of that utility would be responsible to make the necessary repairs. For these reasons, staff would recommend that approval be based upon these conditions. Financial Summary: N/A Staff Recommendation: Staff recommends approval with the Presubmission Conference comments and the condition that (a) the cul-de-sac and utility easement is modified so as not to encroach upon A&M's effluent easement or (b) A&M provide a written agreement in regard to a shared easement.
