Yes, it does. I don't see it as a problem for the two easements to intersect
as long as everyone (including A&M) knows what is happening and is in
(written) agreement.

I was off Friday so here goes. Thursday night went fairly well. They said
when they left that they would look into other options to see if they were
feasible. We wanted them to provide us with something in writing so that in
the future, if we annexed this area and took responsibility for the utilities
in that easement, that A&M would not come back and tell us we had to remove
them. Another scenario would be if in the process of A&M maintaining their
line they damaged ours, then it would not be our responsibility to repair the
damages. Does all of this make sense?

So what happened last night with Taggart? Why did staff require him to get a
letter. from A&M in the first place? Why are we concerned about enforcing
A&M's property rights in their easement?

Subject: River Run Estates
I've done a substantial amount of research on the issue of coexisting
easements, and I have come to the conclusion that there is no legal reason why
an easement held by the City cannot coexist with an easement held by A&M, AS
LONG AS use of the easement held by Taggart/ the City does not interfere with
A&M's full use and enjoyment of their easement interest. If there is
interference by the second easement-holder, then the first easement "wins."
If A&M were to file suit against a second easement-holder claiming that the
second easement unreasonably interferes with A&M's easement, and a judge or
jury agrees, then an injunction could issue prohibiting that second
easement-holder from maintaining its easement.
That's a snapshot of the law on the issue. I think you just need to decide
how much risk you are willing to assume with regard to our assuming ownership
of the proposed easement and the likelihood of being able to peaceably coexist
with A&M.

Please find a copy of the easement attached to this response.
If there is not language in an easement to specifically preclude usage by others, then others may
use the easement; if the rights of the "grantee" are not adversely affected. This opinion was
verified by Tom Giesenschlag, Title Attorney for Brazos County Abstract Company, on Thursday
October 12, 1995.
Also, the 100° x 100° compressor site easement recorded in Volume 1437, Page 45 to Ferguson
Crossing Pipeline Company has been determined to be offsite. Southwest Gas Pipeline Company
has acquired this easement and has identified it to be for Compressor Site #151059 at the
intersection of Pipelines #151059 and 35098. This site is located to the east of Hopes Creek
Road.

I am in receipt of your letter dated October 24, 1'995, wherein you have .requested
authorization to overlap other utility easements on the referenced outfall easement.. As I am sure you
are aware, The Texas A&M University System does not have the authority to grant easements across
thisparticular tract of land. The only entity that-can grant easements across this property is the owner
of the land. However, you are on notice that-Texas A&M University will not enter into a joint use of
this easement with any other entity and will not subordinate its position in the easement.
I am sorry that we are not able to accommodate you. in this matter, but do wish you every
success in the development of this property. ,

RE: Final (ETA Plat Estates at River Run Phase II. (95-23~
The above referenced final plat was reviewed at a Presubmission Conference on
Wednesday, October 4, 1995. The preliminary plat has been revised since it was
approved by the Commission and Council in December of 1993. These revisions were
made in order to reflect changes made by the Phase II final plat. This revised plat, due
to its large size, is available for your review in Development Services. Staff would
recommend approval of the final plat with the comments identified at the
Presubmission Conference.
