Sullens dba Quality Enterprises, we, Commerce National Bank, 2405 Texas Avenue South, College Station, Texas 77840, have opened an IRREVOCABLE LETTER OF CREDIT in your favor in an amount equal to Sixty-Seven Thousand and no/100 Dollars (67,000.00) available by your drafts at Commerce National Bank. The specific purpose of this letter is to guarantee payment for required work to be completed by Dennis A. Sullens dba Quality Enterprises, hereinafter termed CONTRACTOR, in conformity with terms and conditions detailed within the AGREEMENT, dated December 27, 1995, entered into between Nantucket, Ltd. , hereinafter termed OWNER, and the CONTRACTOR in which the OWNER agrees to pay CONTRACTOR $67,580.00 Drafts must be presented to the drawee no later than January 1 1, 1997 and contain the following: 1. A notarized statement from a licensed and professional .engineer to the effect that the work has not been completed in accordance with specifications set forth in the AGREEMENT. 2. A copy, notarized by a duly authorized party to the County of Brazos to be true and correct, of the document giving the CONTRACTOR written notice to commence work, including the specific date such notice was given. Such document must verify that sufficient time has been allowed to complete the work under the terms and conditions of the AGREEMEI~T'T. 3. A notarized statement from a duly authorized employee of the County of Brazos stating that all reasonable efforts have been made to facilitate the satisfactory completion of the work specified in the AGREEMENT by the CONTRACTOR, and that such completion will require the County of Brazos to use funds drawn under this Letter of Credit to do so. 2405 Texas Avenue South College Station.
