Jim, I am writing this letter i_n answer and in question to ~leronica's letter of May
9, 1996. Tie letter is i~~ coliceril of infortllation regarding the applicant of request
concerning sewer Lines in Sandstone Subdivision. IeTeither myself nor my parents,
Mr. c4L Mrs. ~.3. Jones will be the applicant. It would be hard for I-Iub to ask for the
amendment, in that he is on the City Council. We are only trying to be helpful
regarding leis iil~nediate deeds.
I believe there should be some research done in regard to the Sandstone
Subdivision aid the aiulexation of Sandstone.. There are only a few people still
around that may reflect on this time frame. It may be necessary for the old minutes
to be checked as to when Sandstone was annexed and what ordinance was ii' effect
at that time. Since I was the developer of Sandstones I remember the details
somewhat more directly. I do remember the annexation and some of the
conversations as they related to Sandstone, cane of which was the sewer system or
the lack of a public system ~.t that time. I was tald that the City would have two
years to install a sewer to Sandstone in that we were already on the City water.
This all took place prior to me serving on the City Council. It was while 1 was on
the City Council that the City of College Station passed a bond and constructed a
line on the southern edgy of Sandstone. i asked then how would the City of College
Station extend those services and was told that those lines necessary for all lots
would be extended at a later date. 141though, the City of College Station gave
penllission for any property owner that wanted, could extend the necessary lures at
their expense. Since that point the City ha.s never extended those rules to each
property .and now are tryiig to force those property owners not converted to pa;y
what should be the City of College Station's expense.
Jin, my question to you ~s, V~'liat was the ordinance and responsibility of the City
of College Station in the mid to late 1970's~ What was pronn~sed when annexed?
What leas not been provided? I believe I a1n correct as to my statements withal this
letter. In that the minutes should reflect those discussions and the ordinance and
policies of that period, all of which should further back up my memory. Tt is not my
attempt to ask for anything other than what was origuially promised. It is now
brought to the. table. by redevelopment within Sandstone and any costs for those
facilities that should be born by the developer. of that property. The only new lot,
from the anginal eighteen is the lot added with Lot 91z being subdivided. Jim., most
of the people that attached onto someones sewer line paid apro-rata reimbursement.
Joe Brewster, Lot 11 ~ put the line in for his home and now two other lines are
tapped into his lii-le and he has never been reimbursed.
Jim, I would also ask, Why the City of College Station would, under their new
policy or / ordinance want to locate a r~aan .hole at a corner, that would only ser~~e
one lot? The other three lots are already on the sewer system, Jim, Lot SR is Mr.
and Mrs. Jones lot and is lower in elevation than the proposed location. It would
take two-ninety degree turns for Mr, and Mrs. Jones to tie onto the proposed
location in that their sewer is stubbed out the back of their home silo must go back
and around the detached garage and then up hill to the proposed man hole, The;
ninety degree. torus would also be a contradiction to the policies of the sanitation
department. We are not permitted to place any ninety degree turns in any
installation that ties onto the City's systerri because it causes a blockage in the lines.
Jim, my parents understand that if a problem occurs that is not repairable that they
are faced with an expense to tie onto the sewer system. They also understood that it
is or was the City of College Station's responsibility to bang the line to their
property. Mom c~ Dad are both over sixty-five and mom has r etired and dad was
disable-retired in his late fifties they are on a fixed income, These matters are and
leave been handled very abruptly and to them in a very upsetting way. It is upsetting
to me to have them .call me crying, after receiving a letter from the City of College
StatlOfll, ~n how and where they are going to get the money to pay for these sei~wices,
especially when they are not needed.
Jim, I believe these problem sterols from the City of College Station not living up
to their promise when they annexed Sandstone. I believe a president was set when
the City never extended those services they said they would and then continued to
charge everyone to tic onto the City Service. I also believe the City's Staff could
have answered a lot of their own questions with a little field research and eliminated
a. lot of controversy. I wo~lld appreciate your input in that I believe you were on the
City Staff along with Elrey when this all took place. I ain riot trying to be hard to
get along with but it ddes cause people to get upset and defensive when matters
such as this are handled without some compassion and respect with past
commitments. I look forward to this entire epis®de being over and resolved.

Gentlemen:
Enclosed is TAC Realty, Inc.'s check dated April 17, 1996, in the amount of $1,450.
TAC Realty, Inc. ("TAC") understands that the check will be cashed by you ar~d that
the proceeds from that check will be placed in an interest-bearing account. Such
proceeds, together with the interest earned thereon, are referred to in this letter as the
"Deposit". This letter will set forth the terms upon which the City of College Station,
Texas (the "City") will hold the Deposit; .and the Deposit is delivered to you sut~ject to
the provisions of this letter.
TAC has agreed to .construct and install certain fencing, landscaping and related
improvements relative to the Woodcreek Section Seven subdivision, which fencing,
landscaping and improvements (collectively, the "Improvements") are particularly
described on the letter dated June 29, 1995, from Paul S. Darmitzel to Jane Kee, a
copy of which is attached hereto as Exhibit "A".
In the event. that TAC has failed to substantially complete construction of the
Improvements on or before September 1, 1996, the City may utilize all or any portion
of the Deposit to complete such Improvements. Following completion of the
Improvements by the City, the remaining portion of the Deposit, if any, will be returned
to TAC.
Upon substantial completion of .the Improvements by TAC, the City will promptly
verify such completion and promptly remit to TAC the remaining portion of the
Deposit.

Re: Final Plat - Woodcreek Section Seven
Dear Jane:
Pursuant to the Presubmission Conference Report dated June 22, 1995, the following is a
list of specifications which will apply to the screening fence along Stonebridge Drive, on the north
side of V1/oodcreek Section Seven:
1. The screening fence will be 6' tall and will consist of brick pillars on 20° (+/-) centers,
with -wood cedar fence panels between pillars.
2. The fence will extend along the south side of Stonebridge Drive, from Stonebrook
Drive to Scarborough.
3. TAC Realty, Inc. will. plant grass between the fence and the curb of Stonebridge
Drive. In addition, TAC Realty, Inc. will plant one (1) frfteen gallon Nelly Stevens holly in front
of the center of each fence- panel, on the Stonebridge Drive side of that panel.
4. TAC Realty,. Inc. will install an underground irrigation systeril to provide water fir the
grass and the Nelly Stevens holly plants.
5. Wilshire Homeowners' Association, the homeowners' association which will
administer Woodcreek Section Seven, will be required by recorded restrictive covenants to
maintain and repair the screening fence,- the irrigation system and the landscaping on the
Stonebridge Drive side of the screening fence. ,

Dear Natalie:
Pursuant to our telephone conversation earlier today, enclosed are the following
items:
1. Check in the amount of $1,450, the proceeds of which will be held by
the City as security for completion by TAC Realty, Inc. of landscaping
requirements for Woodcreek Section Seven.
2. Letter from TAC Realty, Inc. to the City setting forth the terms upon
which the $1,450 security deposit is to be held.
3. Draft of restrictive covenants for Woodcreek Section Seven.
As we have discussed, the restrictive covenants have not yet been filed since they
must reference the filing information for the plat. As we discussed, someone can meet
you at the Courthouse if you want to achieve a simultaneous filing of the plat and the
restrictive covenants. Once you are ready to file the plat, please give me a call so that
we can coordinate efforts on this matter.
I have highlighted on the enclosed restrictive covenants those provisions which
are particularly relevant to the Association's obligation to maintain common area
landscaping and amenities.

Dear Shirley:
Enclosed is a legal description and map of the drainage easement to be obtained across
the Uvacek property, adjacent to Woodcreek Section Seven.
I understand that the City will prepare its "standard form" drainage easement for execution
by Mr. Uvacek.
As you know, we are most anxious to proceed with construction. Please advise me
whether we can at this point obtain conditional approval of the construction plans, subject only
to execution of the drainage easement.
