Texas 77845 RE: Detention Facility for Block 3, West Knoll -Section 2 (DDP #288) Dear Sirs: It has come to my attention that the requirements established during our meeting of November 20, 1995 have not been completed. These requirements are as follows: The capacity of the pond must meet the design criteria established in the drainage report by Garrett Engineering. As discussed, the pond does not have to match the final grades, but will need to conform to the size and shape indicated in the drainage report. This capacity is required in order for the detained water not to top the existing berm and run onto Southwest Parkway where it will enter the drainage system unregulated. The outlet control structure must be installed in order for the pond to function as designed. The channel that directs the storm water into the detention pond must be constructed in addition to the berms between the existing duplexes. These berms should direct one-half of the water from each lot to the pond. These items must be taken care of immediately. -Let this letter serve as official notice that all building permits will be withheld for any structure at this location until all items are complete. I am aware of the fact that these are drastic measures, but the City has begun to receive complaints as to flooding problems with this site being specifically mentioned. Your expedient response to this request is appreciated, Either myself or David Dobbs will be available to meet with you on site to discuss what will be necessary to satisfy these requirements. By the way, the developer on the Medina/SW Pkwy property, knocked on our door a :couple of weeks ago asking us to sign a petition. He wanted us to agree that the city should not build a sidewalk on Medina. He is not too happy about this. He said that we intentionaly sat on this CO so that we could force his hand. He said that the detention pond was not needed for this site and we knew it. He went on to say that what they did was correct by sending the water to the front of the buildings rather than keeping it to the back as designed by Garrett. He stated that he was close friends to ALL of the Council members and that he would visit with all of them if necessary. To put it nicely, he said this was a bunch of crap and he was ticked off. They need to grade the existing duplexes to route through the pond and to bring the back side of each roof to the back so that it will flow to the pond. As it stands, some of the water in the back appears to be coming to the front (the streets) which is not the wa it was designed. The existing grading will not suffice. Also, the pond's outlet structure is (1) nonexistent or (2) very silted up, it is not working. Date: 1/22/96 4:47pm Subject: Sidewalk Variance Request -Reply i think our interpretation was correct. the sidewalk requirement in the subdivision regulations is applied with a final plat, regardless of if it is a replat, and regardless of if the streets were constructed previously. the council gave us direction to get sidewalks in town and our response was to amend the subdivision regulations to include getting sidewalks at final plat and at site plan. i can think of all kinds of scenarios where, like on Dexter, the sidewalk is important to overall pedestrian circulation, regardless of if it is in an already developed area or not. i dont think the developer in this case had any vested rights with regard to the sidewalk construction since he requested a replat on undeveloped property. »> Shirley Volk 01/22/96 04:12pm »> Pve been thinking about the Thomas Bros. sidewalk variance request suite it was denied by P&Z last week, and Pm wondering if stafh was correct in its interpretation that a sidewalk was actually required on Medina and Dexter. This is an area of town which was platted in 1970 and the Thomas Bros. actually replatted only about 1/3 of section 2 so it could be developed easier. It was platted and zoned for duplexes previously, but there were so many easements Criss-crossing the land it was next to impossible to develop. What the Thomas Bros actually did was make some paper and utility changes. They didn't build any streets -those streets were built in about 1970. And, when the streets were built, sidewalks were not required!\ Now these builders are trying to develop lots what is now 14 lots that used to be 141ots; in other words, the outside dimensions of this particular area didn't change; the streets were already there; so, perhaps the sidewalk requirement in the subdivision regulations might not apply. (95-213) A Presubmission Conference was held Wednesday, April 19, 1995 to discuss the above mentioned final plat. The following ordinance requirements and comments were made by the various staff members: Ordinance Requirements: Streetscape elements must be installed along the frontage of Southwest Parkway. These ® elements must be installed or guaranteed prior to filing the final plat for record. (Screening of the parking areas from Dexter and Medina Drives will be addressed at the time of site plan review.) No drainage discharge will be allowed over the existing sidewalk along Southwest Parkway. Provide a 15° public utility easement through lots 1 or 14 to access the existing manhole on lot 14. City Engineer DATE: November 30, 1995 RE: SIDEWALK VARIANCE REQUEST -WEST KNOLL SECTION 2 (MEDINA STREET) In May of this year, the above final plat came before the Commission and Council for approval. The plat was approved with the condition that sidewalks be placed on Dexter and Medina streets in front of the lots being subdivided, in accordance with the City of College Station subdivision ordinance. The applicant is requesting a variance to this requirement on Medina Street only, as the applicant is willing to construct the sidewalk along Dexter. Attached to this variance request is a copy of a petition and comments from adjacent property owners. The sidewalks constructed along Dexter and Medina would be continued into the neighborhood in front of existing single family residential homes, with future City sidewalk funds. Property owners or renters of 3 of the 4 lots (lots 8-11) that would be directly affected by the construction of the sidewalk, have signed the petition in opposition to the sidewalk being continued through the frontage of their lots. The petition is also signed by 3 property owners in the immediate area, all which oppose the construction of the sidewalk. Although not signing the petition, staff did talk to most of the renters in the duplexes constructed on the West Knoll lots, most which said they were indifferent to the sidewalk, and only 2 said they did not want a sidewalk there, none of the residents polled said they definitely wanted a sidewalk. Staff also received one phone call from a property owner on Medina who was in favor of having a sidewalk on Medina. Although the City subdivision ordinance would require the construction of the Medina sidewalk, staff would support this variance request for the following reasons: • the opposition expressed by property owners in the area, who would ultimately use the sidewalk • with the opposition expressed, the adjacent piece of sidewalk, which would be constructed by the City, would be very difficult to complete leaving a sidewalk from Southwest Parkway through only a portion of Medina • the fact that there are alternate routes for future sidewalk construction for school children to get to South Knoll school from the neighborhood ~ this plat was "infilling" an area and as such it is sometimes difficult to adapt "newer" standards to surrounding existing development ®® ~i~ r ~ ~~ r~r~h~ fah " ~~ P.®. 8®x 10106 C®Ilege Statl®n, Texas 77842 (409) 696-4384 ®r (409) 893-0982 Octorber 4, 1995 Shirley Volk Development Coordinator -Planning & Zoning Dept. As you know we have already constructed 4 duplexes on Medina and will be starting construction on the remaining 3 within approximately 60 days to complete the develop- ment on that street. I am hoping you will submit our request to the Planning & Zoning Board to review the necessity of a sidewalk on a street that .dead ends to the north of the aformentioned duplexes. As you know we have already constructed a sidewalk along Dexter and really do not see the necessity of another north-south sidewalk on a narrow street like Medina. I have never observed anyone walking for pleasure or otherwise on Medina which leads me to question the reason for a sidewalk. The existing parking areas for the residents of the duplexes is at least 24" higher than the existing street heighth of Medina. However, the hold will remain in effect for Lots Rl, R2 and. Upon completion of all structures, final grading wlll be required as indicated in the approved drainage report. 2. If not, tell me and I'll put one in.) »> Joey Dunn 08/16/96 I2:08pm »> As some of you know, I finally made contact with Charles Thomas to inform him about the landscaping that was never installed for his West Knoll duplexes, and that if not extended, we would have to draw down on his $4800 l.s. bond that expires on Sunday. He was pretty upset at the time and threatened to go to the mayor and council members,like he did with the Medina sidewalk issue, mostly as a result of all the drainage improvements he had to do. I've also realized through this process that 8 of the duplexes received b.p.'s before the duplex l.s. points were added to the ordinance, and are grandfathered from the additional points. Therefore, the additional landscaping is only required on the 6 duplexes on the south end - 3 on Medina and 3 on Dexter. I faxed him copies of the 6 b.p.'s with the landscape plans that he submitted. I've. also talked to him a couple times since then and he's calmed down, because I think he realized he didn't have a leg to stand on. So, the result of all this is that he has contacted his banker - Norwest - to extend the bond till November 18„ 1996 (which by the way didn't cost him a dime extra) so that he can either put in the l.s. himself, or negotiate with the owner to pay the extra cost. We will be getting a faxed confirmation of this extension from a bank representative sometime this afternoon. When it is received, I will put a copy on Deborah's desk to be filed in the l.o.c. drawer. Box 10106 College Station, Texas 77845 RE: Detention Facility for Block 3, West Knoll -Section 2 (DDP #288) Dear Sirs: At the last City Council meeting on June 13, 1996, a citizen indicated that the detention pond at your site was not functioning properly during storm events. As in all situations brought before Council, staff will investigate the concern. On Thursday, June 20, I made an inspection of your pond and found what I understand to be the concern. The three duplexes situated on Lots Rl, R2 and R3, Block 3, West Knoll -Section 2 are not complete and therefore the final grading has not occurred. Please remember that the final grading must be complete prior to the issuance of a Certificate of Occupancy for any of these structures. In addition to the building code requirements, the following items must be taken care of prior to issuance of a certificate of occupancy or releasing the guarantee bond. These relocations must be inspected by the City. The existing transformer boxes along Colgate Drive must be adequately screened from the right-of--way. These elements must also be installed at the corner of Cypress Drive and Kalanchoe Court to screen the proposed parking areas so that they are not visible from Colgate Drive. Submit a plan addressing this requirement to be reviewed and approved by staff prior to installation. _ Provide a sidewalk along Colgate Drive to connect with the existing sidewalk along Cypress Drive. Submit the construction documents for the required sidewalk to be reviewed and approved by staff prior to installation. The sidewalk must be inspected during construction.
