HomeMy WebLinkAboutStaff ReportSTAFF REPORT Case No.: 95-205 Applicant: LaCour Investments ITEM SUMMARY This-property is located in the Wolf Pen Creek District along the south side of SH 30 (Harvey Rd.). It is approximately 1050 feet east of the Texas Ave./SH 30 intersection, adjacent and east of the existing Taco Bell. Previously approved is a preliminary plat dividing the property into two lots, a 4.339 acre lot along SH 30 and the remainder as a reserve lot to the south. Wolf Pen Creek runs through the property and by ordinance, property dedication is required if the developer chooses not to develop the park area at this time. That plat was approved with the conditions that Kyle Street be shown for future extension and the provision of access for Taco Bell to the Kyle Street extension. This is a final plat of the one lot that fronts on SH 30 and of the area to be dedicated for the Wolf Pen Creek project. It was mentioned during the preliminary plat that the application wished to defer the WPC dedication. Staff has been working on a development agreement because of this. Since that time, the applicant has decided to dedicate the property. However, there are still several other deferrals being requested so a development agreement is being presented with this tnal plat. STAFF RECOMMENDATION Staff recommends approvals per the following: The applicant is asking: 1. To defer the design. and construction of a 12" waterline. 2. To defer the submission of impact studies addressing the reserve tract until it final plats. 3. To defer the payment of back taxes on the property until the final plat is filed and the sale can occur. 4. To deter the design and construction of a sidewalk along SH 30 until the site plan is submitted for the lot being tnal platted. 5. To pay only part of the City's administrative costs for the preparation of this development agreement. 6. City shall not make any future assessments against the developer for design or construction of Kyle street where the ROW is being dedicated. In consideration,forthese items staff recommends that the following be accomplished: 1. Developer shall design and construct a 12" waterline within 12 months of the date of the agreement. 2. The Kyle street ROW through the WPC dedication and the reserve tract shall be dedicated with this final plat. 3. An access easement shall be granted to Taco Bell with this final plat and their easternmost curb opening closed within 30 days of the Certificate of Occupancy for the buyer of the lot being final platted. 4. An access easement shall be granted with this final plat giving access to the WPC dedication area. 5. When the City purchases ROW through the lot that is being platted now and constructs Kyle Street through the entirety of the property, City reserves right to assess the lot currently being platted for improvements. 6. Developer pays 50% of the administrative costs of this agreement up to $2,500. COUNCIL POLICY ENDS STATEMENTS -The following Ends Statements that are in bold are relevant to this particular case. Employment/Prosperity -Citizens benefit from an environment that is conducive to providing diverse employment opportunities. Civic Pride -Citizens benefit from well planned, attractive residential and commercial areas. COMPREHENSIVE PLAN -The following are Goals and Objectives from the City's adopted Comprehensive Plan that are applicable in this case: COMPLIES WITH FUTURE LAND USE PLAN MAP?: YES DEVELOPMENT GOALS AND OR,IECTIVES: LAND USE Avoid strip commercial: Size and depth of property meets policies regarding strip commercial and Kyle extension will provide frontage ~on two streets TRANSPORTATION Location of streets based on function: Includes partial Kyle ROW dedication Driveway access: Easement will be provided for Taco Bell so that driveway access can be relocated ECONOMIC DEVELOPMENT - NA PARKS AND RECREATION Link parks by pathways and natural features: This property has WPC dedication area HOUSING -NA COMMUNITY APPEARANCE Promote good site design: Good appearance, minimize drainage impacts, and increase pedestrian safety -Will occur with development of Lot l and eventual Kyle Street construction. ENGINEERING COMMENTS AND IMPACT STUDIES - Water -Water is available to Lot 1 through an existing line in SH 30. Demands generated from the anticipated use on Lot 1 can be handled by the waterline along SOH 30. Water will need to be extended along the Kyle extension to loop the water system between SH 30 and Holleman, thus providing an adequate connection for park development and the reserve tract. Sewer -Available and adequate to Lot l.. Streets -Access to Lot 1 is to SH 30 which is adequate to handle anticipated traffic.. Drainage -Drainage is currently overland toward the creeks Improvements made on Lot 1 will .have to comply with the Drainage Ordinance and the Wolf Pen Creek portion of the zoning ordinance at the time of site development. Flood Plain -Flood plain is located on Lot 1 _ Sidewalks -Sidewalks w311 be required along SH 30 and along the Kyle extension at the time of platting or site development. Parkland Dedication -Not applicable to commercial. If multifamily develops, parkland will be obtained at building permit. - SUBDIVISION ORDINANCE COMPLIANCE Variance Requested - Delay impact studies ,provision of water service and sidewalk through development agreement. Oversize Request -Staff anticipates a request on the 12" waterline along the Kyle extension,. however, there has been no request submitted to date. Easement Dedications - As shown on the plat. ZONING ORDINANCE COMPLIANCE Proposed.
