HomeMy WebLinkAboutOrdinanceCpl '~`~` ~ X995 ORDINANCE NO. 2121. !~N ORDINANCE REZONING A 38,308 SQUARE FOOT TRACT OF LAND OWNED `BY FIRST STATE BANK KNOWN AS LOT 3 OF THE FINAL PLAT RESUBDIVtDING THE COURTYARD APARTMENTS SUBDIVISION SITUATED IN THE MORGAN RECTOR SURVEY: FROM A-P, ADMINISTRATIVE - `PROFESSIONAL TO C-3, PLANNED COMMERCIAL. WHEREAS,. on April 27 1995, the City Council of the City of College Station convened and pursuant to notices prescribed by law held a public hearing with regard to the application for the rezoning of 38,308 square feet of property subdivided by final plat as Lot 3 of the Courtyard Apartments Resubdivision situated in the Morgan Rector Survey, Brazos County, Texas; WHEREAS, the property is currently zoned A-P AdministrativelProfessional and is utilized as a bank by First State Bank; WHEREAS,: the owner of the. property is Caldwell Capital Corporation who purchased the property by deed dated _January 13, 1989, recorded. in Volume 1095, Page 572, of the Official Records of Brazos County, Texas; WHEREAS, the owner has applied for the .rezoning of the :property to C-3 Planned Commercial zoning; WHEREAS, the City Council of-the City of College Station, Texas, heard evidence as to the commercial uses, including. properties originally intended as fiigh density residential under the Comprehensive Plan, on Harvey Road between Texas Avenue and the East Bypass; and' WHEREAS, the property will continue to be utilized as a banking institution and the rezoning would authorize the location of a sign on the tract; WHEREAS, the City .Council of the City of College Station, Texas, has determined that the rezoning of the tract to C 3 Planned Commercial will not have ill-effects on the adjoining commercial tracts and that these commercial uses consti#ute a changed condition that makes. the property more suited to commerical use; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the said property: Lot 3 of the Final Plat resubdividing the' Courtyard Apartments Subdivision, recorded in Volume 757, Page 336 of the Official Records of Brazos County, Texas, is hereby rezoned from A-P, Administrative`- Professonal'to C-3 Planned Commercial, effective immediatly.
