ACRE TRACT SITUATED 1N THE MORGAN RECTOR LEAGUE, A-46, BRAZOS COUNTY, TEXAS, AND BEING A PORTION OF THAT SAME CALLED 112.86 ACRE TRACT CONVEYED TO EAST BYPASS DEVEL- OPMENT GROUP BY DEED RECORDED IN VOLUME 428, PAGE 297,. OF THE DEED RECORDS -0F BRAZOS .COUNTY, TEXAS, FROM. A-O AGRICULTURAL - OPEN AND R-1 SINGLE FAMILY RESIDENTIAL TO 22.514 ACRES AS R-1 SINGLE FAMILY RESIDENTIAL, 34.020 ACRES AS C-1 GENERAL COMMERCIAL, and 5.643 ACRES TO A-P ADMINISTRATIVE-PROFESSIONAL. WHEREAS, on April 13, 1995, the City Council of the City of College Station convened and pursuant to notices prescribed.. by law held a public hearing with regard to the application. for the rezoning of a 69.842 acre #ract situated. in the MORGAN Rector League, A-46, Brazos County, Texas; WHEREAS,. the above-described property_is currently zoned R-1 Residential and the current use is undeveloped;. WHEREAS,. the owner of the above-described property, East .Bypass Development Group, purchased the property by deed recorded- in Volume 428, Page 297, of the Official Records of Brazos County, Texas; WHEREAS, the :owner has applied for the rezoning. of the above-described property into three separate-tracts as follows: TRACT'ONE - 22.514 Acres - R-1 Single Family Residential: Being all that certain tract or parcel of .land .lying and being situated in the MORGAN RECTOR LEAGUE, A-46, in College Station, Brazos County, Texas and being a portion of the 112.86 acre tract conveyed to East Bypass Development Group by deed recorded in Volume 428, Page. 297, of the Deed Records of Brazos County and being more particularly described by metes and bounds as follows: COMMENCING: at a 1/2-inch iron rod. found for the most southerly corner of a 0.17 acre Sebesta Road, Right-of=Way tract described in Volume 1348, Page 146, said iron rod marking.. the intersection of the .northeast. right-of-way line of State Highway No. 6 {East Bypass) andthe new southeast right-of--way'line of Sebesta. WHEREAS, the City Council of the City:of College Station, Texas, heard evidence that the area in which the above-described tract is located is predominantly undeveloped; WHEREAS, rezoning the subject tract of land into the three aforementioned tracts would allow the Owner to utilize the.. land for its best suited purposes by implementing sing a family residential housing,. parkland dedication, and general. commercial devel- opment'in the area:;. WHEREAS, rezoning the subject tract of land into the three aforementioned tracts would allow the owner to develop the property in such a way #hat it fills a need in the local real property market; and WHEREAS, the subject rezoning i consistent with. the City's Comprehensive Plan for development; NOW, '.THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS; that the 69.842:: acre tract mentioned above is hereby rezoned from A-O Agricultural-Open and R-1 Single Family Residential to 22.514 acres R-1 Single Family Residential, 34..020 acres as 'C-1 General Commercial, and 5.643 acres of A-P Administrative-Professional, effective immediately.
