City Attorney C~ ~~ RE: Proposed rezoning of 69 acres ~ DATE: Apri17, 1995 I have reviewed your request for assistance on the proposed rezoning of 69 acres. at Sebesta Road and State Highway 6 East By-Pass.. As I understand it, you intend to use the requirement of a landscape buffer as a changed condition to the rezoning. Obviously, there are concerns as to the reach of the decision in Dolan. However, my su position is that the decision will have the least impact in rezoning cases. Therefore, I believe that the rezoning can be conditioned on the buffer. I do have a concern with no. 3. I believe that the owner should have the discretion to decide how he wants to handle the creek.. There should not be a requirement that it be dedicated to or accessible by the public. Finally, the owner should de- cide whether he wants the buffer to remain on the C-1 tract onto be placed in the residential zone. If placed in the residential zone it can be a common area to be maintained by a :home owner's association. As a note, please be cognizant of the fact that with each development plan that is rejected the City becomes more vulnerable. to a total takings claim. Anyway, the parks expenses look ok. Parks maintenance expenses are allocated based on land .acreage percentages so commercial uses get about $48/1000 sq. feet. That makes up nearly half of the $30,790. SF units are charged. about $222 per unit for parks. If these are different from previous FIA runs, it's because I updated the land use acreages. Since this request has. parkland in it you could use these numbers and not .add any cost for .the park, or you could back out the park maintenance cost and figure out the annual maintenance cost for this specific park. The actual maintenance cost from the model is $13,819. The rest of the $30,790. is for recreation and other parks. stuff that this .development would cause to grow. If this is confusing, give me a call. My short answer is, yes these numbers are good, use them and do not allocate any extra cost for the proposed park.
