Dear City .Council Members:
I am writing to request. that the City .Council deny the rezoning of the
property along the north side of University Drive from the Highway
6 Bypass to the Spring Loop development(Case No.: 95-105).
The. Council. should deny this rezoning for the following reasons:
(1) The large increase in commercial property along University Drive
(39.9 acres from R-1 to C-B) is inconsistent with Plan 2000, in which
c®nsultants recommended that commercial property be confined to
the intersection (Hyw 6 Bypass) and that the remainder of the
property) along University Drive be R-1 to R-3.
(2) 'In 1985 the City set a precedent _by denying a similar request to
rezone land on either side of Lincoln .Drive {Spring Loop extension) to
.commercial ('A Study of the University Drive Corridor', June 1991).
(3) The requested rezoning of this property is inconsistent with
development along the south side of University Drive, where the
present use is A-P, R-1, and R-3.
(4) 'The rezoning.. is of little benefit to the City, the residents, or the
voters. There is substantial land nearby which is already zoned
commercial. Furthermore, nothing. warrants such significant changes
in the zoned use of land along the main entrance to the City.

{5) The change of 24.7 acres from R-1 to R.-S could increase the
population density of the area from 197 families to S92 families.
Such a .dramatic change in population density along such a very busy
thoroughfare should not be made. without a .complete traffic study.
(6) The `residents and owners of the PUD across from .this property
(Post Oak Forest) did not receive proper notification of the .proposed
rezoning. The PUD property is within 200 ft. of the property
proposed. for rezoning.

Although our Post Oak Forest subdivision is within two-hundred feet of the proposed commercial
rezoning. approved by the Zoning Commission on March 16,1995, our Home Owners Association
did not receive the official notification required by law. We wish, therefore, to place before the
City Council for its. meeting on April 13'' the following recommendations:
1. The Home Owners Association of Post Oak Forest, Inc., opposes rezoning this area
of University Drive to C-5.
2. If rezoning is to occur, our Home Owners Association requests that rezoning be
approved only for the specific proposal presented in behalf of Lowe's.
3, And our Home Owners. Association. requests, further,. that any other requests for
rezoning that portion of University Drive be presented to the Zoning Commission
and the City Council on apiece-by-piece, individual basis, with appropriate
notification. to all interested' parties within. the two-hundred feet perimeter, as
required by law.

the C-B zone)
To Whom It May Concern:
This letter is to clarify certain conditions required for development of the above referenced
property. The property was rezoned in 1995 with certain conditions as follows:
1. .Access drives to the property shall be limited to one driveway off the By-
Pass Frontage Road and one driveway off of University Drive. Please. refer to the
enclosed map for approximate driveway locations. These locations were approved as part
of the Council adoption of the University Drive. Study and comply with the City's
Driveway Access Policy. The City's Driveway Access Ordinance will help you determine
exact driveway locations.
2. Cross access shall be provided within the development among all future
lots. Note that the extension of Glenhaven Drive .across University Dr. through this
property is on the City's adopted thoroughfare plan. Internal access should be oriented to
this roadway:
3. A landscape buffer shall be provided between the subject property and the
existing R-1 property in the northeast corner. At a minimum this shall consist of a solid
screen fence with landscaping adjacent. Thi will be review at the time of site
development:
4. A sewer impact study shall be conducted at the time of development to
.determine whether there is enough capacity in the existing system to handle the proposed
development.
5. Prior to C-B zoning being effective a tree survey shall be .conducted and
submitted for c+~terrnination of tree preservation. This survey should identify native trees
of 8 inch. caliper or larger within the first 50 feet of the University Dr. frontage..... The
survey should include this frontage-along University Dr. adjacent to the R-5 zoning
as ®vell.
6. Any additional costs relating to turning lanes or medians associated with a
new traffic 'signal at Glenhaven shall be borne in part by the developer. This will be
discussed at the time of site development.
Any deviation from the above conditions. would require a rezoning request.

I have forwarded a request for a letter regarding utility availability to the City's Division
Manager for Water and' Wastewater,. Bill Riley. He maybe contacted at 764-3660.
Floodplain reclamation shall be reviewed under the City's Drainage Ordinance. The
question was asked whether floodplain reclamation here will fall under the same
regulations. as the pending Carter CreekRelocation project.. Both. projects must comply.
with the. City's drainage ordinance. The ordinance does call for a longer review time for
projects located in the Carter Creek floodway. The creek located on this property is
Burton Creek and the ordinance allows for a l0 day review of proposed plans when
submissions are complete and 'no variances are requested. As Burton Creek is an
interjurisdictional creek shared. by the City of Bryan, as a .courtesy all reviews. shall be
forward to the City of Bryan. All development within. the Burton Creek basin has a
mandatory detention requirement of 100 year ultimate development.
The C-B zoning district allow some outside display of merchandise (for sale only and
not storage).. The merchandise shall be within 50 feet of the building and not in the
parking lot nor closer than 50 feet to any street frontage.
