NO. 9, BRAZOS COUNTY, TEXAS, AND BEING A PORTION. OF THE 21.32 ACRES OUT OF TRACT NO. 5, SAID .TRACT 5 BEING PART OF THE 88.52 ACRES CONVEYED BY THE FEDERAL DEPOSIT INSURANCE CORPORATION, (FDIC), IN ITS CAPACITY AS LIQUIDATOR OF THE FIRST BANK & TRUST, BRYAN,.TEXAS, TO TAC REALTY, INC., SAID TRACT BEING MORE PARTICULARLY DESCRIBED IN VOLUME 1157, PAGE ' 194, OF THE DEED. RECORDS OF BRAZOS COUNTY, TEXAS, FROM R-1 SINGLE FAMILY RESIDENTIAL TO PLANNED UNIT DEVELOPMENT P.U.D.-LAND USE INTENSITY RATIO NO. TWO. V1/HEREAS, on April 1.3,.1.995,. the City Councii of the :City of College Station convened and pursuant to notices.. prescribed by law held a ,public hearing with regard. to the application for the rezoning of 6.71 acres. of property situated in the Thomas Caruthers League, Abstract No. 9, Brazos County, Texas, and- more particularly described as follows: Being all that. certain tract or parcel of land lying and being situated in the Thomas Caruthers League, A-9, in College Station, Brazos County, Texas, and being a portion of the tract of land .called 21.32 acres out of Tract No. 5, said Tract 5 being part of the 88.52 acres conveyed by the Federal .Deposit Insurance Corporation (FDIC),, in its capacity as Liquidator of the First Bank & Trust, Bryan, Texas, to TAC Realty;. N 41 ° 44' 35" W for a distance of 282.83 feet for arr angle. point, Ni36° 55' 53" W for a distance of'149.62 feet for an angle point, and N 31 ° 44' 16" W for a distance of 5.74 feet for comer, ', said corner also being the most southerly corner of Lot 8, `Block Twenty-one (21), of the '.beforementioned Woodcreek, Section Six South; THENCE:> N 45° 01' 24" E along said Woodcreek, Section Six South line for a,distance of 472:51 feef,to'the POINT OF BEGINNING and containing 6.71' acres of land, more or less. ~, Ordinance No. 2122 Page 2 WHEREAS, the above-described property is currently zoned R-1 Residential and the current use is undeveloped; WHEREAS, the owner of the above-described property, TAC Realty, Inc.,. purchased the property on December 8, 1989, by deed recorded in Volume 1157, Page 194, of the Official Records of Brazos County, Texas; WHEREAS, the owner .has applied for the rezoning of'the above-described property to Planned Unit Development-Land Use Intensity Ratio No.Two zoning; WHEREAS, the City Council of the City of'College Station, Texas, heard evidence that the area.. in which the above-described tract. is located ' is predominantly Planned Unit Development zoning but very few lots are available for development in the area; WHEREAS, rezoning the.. subject tract of land would. continue the Planned Unit Development :character of the area outward to the C-3 Commercial property fronting Rock Prairie Road; WHEREAS, rezoning the subject tract of land would :allow. the owner to develop the property in such a way that it fills a need in the local real property market; and WHEREAS, the subject rezoning is :consistent with the City's Comprehensive Plan for development; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the above-described.. property is' hereby rezoned from R-1 Residential to P.U.D.
