ORDINANCE NO.
AN ORDINANCE REZONING A 3.43 ACRE TRACT OR PARCEL OF LAND
KNOWN AS AND BEING LOT 1, BLOCK TWO, WOODSTOCK, SECTION ONE,
COLLEGE STATION, BRAZOS COUNTY, TEXAS, RECORDED IN VOLUME
436, PAGE 481, OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS,
FROM C-3 PLANNED COMMERCIAL TO C-1 GENERAL COMMERCIAL.
WHEREAS, on March 9, 1995, the City Council of the City of College Station
convened and, pursuant to notices proscribed by law, held a public hearing with
regard to the application for the rezoning of a 3.43 acre tract or parcel of land
known as and being Lot 1, Block Two, Woodstock, Section Two, College Station,
Brazos County, Texas, recorded in Volume 436, Page 481 of the Official
Records of Brazos County, Texas;
WHEREAS, the above-described property is currently zoned C-3 Planned
Commercial and the current use is as a specialty retail shopping center without
sit down restaurants;
WHEREAS, the owner of the ~bove-described property, Post Oak Village
Management, Inc., has applied for the rezoning of the above-described property
to C-1 General Commercial zoning;
WHEREAS, the City Council of the City of College Station, Texas, heard
evidence as to the location of the property on the southeast corner of Dartmouth
Drive at its intersection with Harvey Road;
WHEREAS, evidence was presented that this area of College Station is rapidly
experiencing both commercial and residential development;
WHEREAS, evidence was presented that the proposed use of the property as a
specialty retail shopping center with sit down restaurants will provide support
facilities for the nearby developing and existing residential areas;
WHEREAS, evidence was presented that the proposed zoning change is in
accordance with the Comprehensive Plan; and
WHEREAS, the City Council. of the City of College Station, Texas, has
concluded that the development taking place in this area isa changed condition
that makes.the subject property more suited to General Commercial use;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION, TEXAS, that the above-described property is hereby
rezoned. from C-3 Planned Commercial to C-1 General Commercial, effective
immediately.

WHEREAS, evidence was presented that this rezoning application is condi-
tioned on the provision of a cross access between the subject property known as
Post Oak Village and the adjacent Post Oak Square Shopping Center; and
WHEREAS, the. City Council. of . the ,City of, College Station, Texas, has
concluded that.the development taking. place.in this area is a changed condition
that makes the subject property more suited to General Commercial use;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION, TEXAS, that the above-described property is hereby
rezoned from C-3 Planned Commercial to C-1 General Commercial, effective
immediately.
