TO : Plaiuling alid Zonnig Commission FROM: Ed Hard, Transportation P1amler Sabine Kuenzel, Senior Planner DATE : July 27, 1995 RE : Reconsideration of the condition for cross access between Post Oak Village and Post Oak Square Shopping. Centers The P&Z approved the rezoning of the Post Oak Village ceirter from C-3 to C-1 in February of 1995. Staff recoimnended denial. of the rezoning due to concerns for the worsening of traffic problems on SH 30 that could result from higher traffic generating C-1 uses. Staff conducted traffic counts at numerous local restaurants and found that the amount. of traffic to Post Oak Village. could double if restaurants (the highest traffic generating C-1 use) were allowed in the center. The City Council approved the Post Oak Village rezoning in March of '95 with the condition that a cross access driveway be .provided between Post Oak Village and .Post Oak Square. Staff provided a detailed presentation to Council on the increased traffic to the center and the resulting operational concerns on SH 30 if the rezoning were granted. In light of this, Council approved the rezoning with the condition for the cross access. Attached fnd a letter from AndyBernstein; the owner of Post Oak Village. acid Post Oak Square, to Sabine Kuenzel. Mr. Bernstein requests that the condition of the rezoning. for vehicular cross access bet~Teen tike twocenters be reconsidered. This comlection would be quite expensive because it would require crossing a large drainage way. Mr. Bernstein is quite aware of the traffic difficulties on SH 30 in front of his centers .and is not opposed to making improvements to improve traffic safety. However, in light of the considerable expense .of constructing the cross access he -hired a local traffic engineering consultant to take a more comprehensive look at the traffic problems associated with Post Oak Village and Post Oak Square. The study points out that traffic accidents area "relatively frequent occurrence" on Harvey Road in front of the three shopping centers. (including. the Mall) and indicates that the majority of these accidents involve t11otorists attempting to make left turns on to and off of SH 30. It discusses a number of improvements options anal concludes that there is no "one best" solution to remedy the accident problem. The study reconunends installing raised medians in SH 30 to restrict and control left turn movements, installing a traffic signal. at the main entrance to Post Oak Square, installing a FI®~ae ®f Tomas ABM Clniversaty ~. P&Z -Cross Access, Page 2 cross access between Post Oak Mall and Post Oak Square, and installing a pedestrian bridge over the drainage way between. Post Oak Square ahd Post Oak Village. Staff agrees with the recommendations to install medians in SI-I 30 and to provide cross access between the Mall and Post Oak Square. Staff is also in agreement that a traffic signal is needed, but not necessarily that it be located at the main entrance to Post Oak Square. It may be that the west mall entry/exit location would be a more suitable location. This determination will require further study by staff. A study of the traffic accidents on SH 30 between Dartmouth and the E. Bypass conducted by staff indicates that there is an accident problem in front of the Mall's west driveway and to a lesser extent a problem in front of Post Oak Square's main driveway: This finding supports the need for cross access between the Mall and the Square and for an additional traffic signal on SH 30 that could be utilized by patrons of either shopping center (via the cross access). Mr. Bernstein's study offers two preferred alternatives for providing vehicular cross access between Post Oak Village and Post Oak Square but questions their cost effectiveness. It says that cross access should be "strongly considered" but points out that the centers were not designed initially for this connection. His study essentially concludes that the small amount of improvement in traffic safety and convenience gained by vehicular cross access would not be worth its high cost. This may be the reason the study arrived at the recommendation for a pedestrian bridge across the drainage way that could ultimately allow the two centers to share parking. Staff is of the impression that Mr. Bernstein is interested in making improvements to improve traffic safety, but that he feels that money would be better spent somewhere other than the vehicular cross access between the Square and the Village. Staffs accident study is somewhat consistent with Mr. Bernstein's findings. Tt shows that there is not an accident problem on SH 30 at the most easterly driveway to Post Oak Village and therefore no serious need for .cross access between Post Oak Village and Post Oak Square at this time. However, the rezoning to C-1 could result in a higher traffic volumes to the site and create an accident problem at some point in the. future. Keep in mind that staff must consider the "worst case" in considering rezonings. In order to mitigate. current and potential firture traffic problems, Staff reconvnends the City enter into a development agreement with Mr. Bernstein for the following: 1. The City condemn and constniet a cross access driveway. between the Post Oak Mall and Post Oak Square; 2. If it is determined that a traffic signal should be located on SH 30 at the main entrance to Post Oak Square, Mr. Bernstein participate in the cast of this signal. in an amount equal. to the cost of the design and constn~ction of a vehicular cross access driveway between Post Oak Square and Post Oak Village. ~. If it is determined thata traffic signal should be located on SH 30 atthe west entry/exit to Post Oak Mall, then the City will install the signal and pursue financial participation from the Mall on its construction. 4. Mr. Bernstein forego the constriction of the cross access between Post Oak Village and Post Oak Square at this time and constrict it at a point in the future when the accident frequency is one or more every two months for three consecutive two month periods or at a frequency of six or more per year. If accident conditions are met and Mr. Bernstein is required to constrict the cross access, then the City will reimburse Mr. Bernstein for the amount of moneyl~e may have previously contributed toward the installation of a traffic signal at the main entrance to Post Oak Square. The accident frequency calculation will include all accidents on SH 30 involving vehicles attemptuig to enter or exit the most easterly driveway of Post Oak Village on SH 30. The accident frequency determination will be based on the records and accounts of the. College Station Police Department. If conditions are met for the installation of the cross access, the City and Mr. Bernstein will work together to determine a mutually agreeable location, design, and cost of the access drive. Such location and design may also include closing the most westerly driveway in the Post Oak Square center and improvements needed for circulation in the parking areas of both the Post Oal< Square and Post Oak Village centers to make the cross access work. The access will meet all applicable City of College Station standards and specifications for constnlction. 5. The City will worl~ with the Texas Department of Transportation and pursue the installation of raised traffic medians in SH 30 from Munson Drive to the E: Bypass. BERNSTEIN INVESTMENTS 1800 ST. Dear Ms. Kuenzel: This letter requests that Post Oak Village be reconsidered for Rezoning without having to construct a automobile bridge between Post Oak Village and Post Oak Square. As you are aware, my company requested and paid to have a Traffic Flow and Safety Analysis prepared by Transportation Engineering Analysts. I felt this was needed because of the significant quantity of automobile accidents on Harvey in the general area of Post Oak Mall, Post Oak Square and Post Oak Village. This hazard is unacceptable to me as the developer of two of the surrounding properties. In fact, during the peak shopping time of the Christmas season, I hired, at my expense, three College Station Police Officers to direct traffic on Harvey. I am very interested in implementing the recommendations made in the study to the extent that I can to assure our community of a safe and hazard free shopping area. Item: Presentation and discussion of traffic accident data relating to the condemnation for cross access between Post Oak Square and Post Oak Mall. Previous Council Action: Council approved the rezoning of Post Oak Village to C-1 General Commercial in March with the condition that cross access be provided between Post Oak Village and Post Oak Square. Council had previously approved a 'replat of Post Oak Square in May of 1993 with the condition that cross access be provided between the Mall and the Square: Council discussed condemnation for the 'Mail/Square cross access at closed session in June and asked that staff return at a 'future date with traffic accident data. Item Summary: Staff research of accidents in this area indicates that there is a problem in front of the Mall's west driveway and to a lesser extent a problem in front of the Post Oak Square's main driveway. Details on the amount and type of accidents will be presented at the meeting. Andy Bernstein is the owner of both Post Oak Square and. Post Oak Village. He hired a local traffic engineer to conduct a study for this area. As a result of the study, he requests that the condition for cross access between the Square and the Village be reconsidered.. Staff will discuss the findings of Mr. Bernstein's study in an effort to enable Council to determine the need for the Mall/Square and Square/Village cross accesses as well as for other improvements in the area. Financial Summary: The appraised value for the cross access between the Mall and Post Oak Square was $.16,500. The legal department indicates that costs for litigation, if required, could be high taking into consideration costs of suit and valuation of the cross access. The estimated cost to acquire the property and construct the cross .access is $50,000. Mr. Bernstein has indicated to staff that he is willing to participate in this cost, but. that an exact amount would have to be negotiated. The City's portion of the cost would be paid for. using interest and contingency funds from the 1991 G.O. Bond Series. The. estimated cost to construct a new traffic signal on SH 30 is $100,000. It would be paid for using 1.995. GO Bond funds budgeted in FY 96 for traffic signal enhancements. Staff Recommendation: Staff recommends that the City .condemn the necessary property for the cross access and construct the driveway between Post Oak Square and Post Oak Mall. The high number of accidents on SH 30 at the Mall's west driveway and at Post Oak Square's main driveway supports the need for cross access between the Mall and the Square. In addition, staff's study as well as Mr. Bemstein's" study shows a need for an additional, traffic signal on SH 30 that could be utilized by patrons of either. shopping center (via the cross access). As indicated in staff's memo to P&Z, staff recommends that the cross access between the Mall and the Square be included as part of a .development agreement between Mr. Bernstein and the City. This same development agreement also addresses the cross access between Post Oak Village and Post Oak Square and an additional traffic signal on SH 30.' City Attorney Recommendation: The Office of the City Attorney has held land acquisition on the Mall/Square cross access in abeyance pending staff's presentation and direction from the City Council Council Action Desired: Approval of .staff recommendation.
