REZONING OF THE AREA BEHIND RANDALL'S
ON CHIMNEY HILL DRIVE-~
The PUD Plan Mr. Jaffer has been working on is up for Technical Review
before the city staff on Wednesday, November 29, if adjustmanet can be made in
time or December 13 if delay is unavoidable. Depending on the degree of correct
completion, Mr. Jaffer, who is represented by Mr. Taggart of Municipal Developement
Group, may have to appear more than once before the city agrees that all his I's
are dotted and his T'sare crossed. Putting together the many ingredients of a PUD
is a very tedious process. This is not a meeting where we have any input, but it
certainly isn't exclusive. .Anyonewishingtoattend.may daso. The exact time and
location will be announced at our resident's. meeting which is the purpose of this
letter (details are at the end of the letter). After the.city approves the technical
aspects of the PUD Plan, Mr. Jaffer will> once again go before the Planning and
Zoning Commission (on 12/21 or 1/4) followed in three weeks by the City Council
(on 1/11 or 1/25). Prior to all of this, our residents need to discuss the up-to-date
developements and get as close to one mind as possible on this rezoning request.
I am now tracking the progress and attempting to keep everyone informed because:
1. Frank Slowey has asked me to do it. 2. I know how. I spent 13 years embroiled
in rezoning controversies with over two dozen cases. 3. Time is of the essence to
be sure all subdivision residents have the opportunity to input this issue with
freedom of expression in a friendly forum. Ifever an "espirit de corps" is essential
to a satisfactory outcome, it is during a rezoning battle.
Hopefully, if we keep our eye on the isst,le, after all the facts and opinions
are heard by anyone who wishes to.hear or voice them, we can all reach a unified
decision in the best interest of everyone concerned. Information coming to us from
any source is welcome. This notice is going.. to Chimney Hill single family home
owners as well as Chimney Hill townhome owners. Residents of Beverly Estates and
Cooner Street will also be informed.

Dear Ms. Thomas:
As you and I discussed briefly last week, we feel that continuing to pursue the 20ne
change to R-3 will not serve the needs of our client or of the neighborhood. Even if the City
Council accepted the professional judgement of the City Planning staff and our :firm and approved
the change. I believe we would merely create enmity against Shabeer and our firm on the part of
the Chimney Hill Improvement Association.
We request that OUT application to rezone this property to R-3 be withdrawn. We will
submit an application to rezone to a PUD-1 at a later date. This will allow us to develop a site
plan which seeks to address the reasonable concerns of the local homeowners by allowing them
input into the design process, and also provides for these solutions to be part of the City approval
process, and therefore binding on our client or his successors. Shabeer wants to be a good
neighbor and develop a quality project - that is why we were engaged. We hope that these steps
will help to accomplish this.
