ORDINANCE NO.
AN ORDINANCE REZONING A 3.51 ACRE TRACT OR PARCEL OF LAND KNOWN
AS LOT 3, HENTON SUBDIVISION, COLLEGE STATION, BRAZOS COUNTY,
TEXAS, BY REMOVING THE ZONING WALL OR FENCE BETWEEN THE R-4
APARTMENT/LOW DENSITY AND R-1A SINGLE FAMILY RESIDENTIAL ZONES
AND REZONING ALL 3.51 ACRES TO R-1A SINGLE FAMILY RESIDENTIAL, AND
FOR THE REMOVAL OF THE EXISTING ACCESS EASEMENT.
WHEREAS, on February 9, 1995, the City Council of the City of College Station
convened and pursuant to notices proscribed by law held a public hearing with regard
to the application for the rezoning of a 3.51 acre tract or parcel of land known as Lot 3,
Henton Subdivision, College Station, Brazos County, Texas;
WHEREAS, half of the above-described property is currently zoned R-4 ApartmenULow
Density and the other half is. zoned R-1A Single Family Residential, and the current use
of the entire tract is vacant land;
WHEREAS, pursuant to Ordinance No. 1627, subject to a change in conditions, devel-
opment of the property cannot be made as a fence exists between the two differently
zoned tracts;
WHEREAS, the owner of the above-described property, J.V. Henton has applied for the
removal of the zoning wall or fence imposed by Ordinance No. 1627, for the rezoning of
the entire tract to R-1A Single Family Residential and for the removal of the existing
sixty~two foot (62') access easement recorded in Volume 1622, Page 128, of the Deed
Records of Brazos County, Texas;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence as to
the location of the property on the north side of Lincoln Street across from where
Munson Street ends;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence of
the change in conditions for the development of this property, for the removal of the
zoning wall or fence, and for the removal of the existing sixty-two foot (62') access
easement mentioned above; and
WHEREAS the City Council of the City of College Station, Texas, heard evidence that
the proposed zoning change is in conformity with the City's Comprehensive Plan; .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the zoning wall or fence on the above-d~scribed
3.51 acre tract is hereby removed, the entire tract is rezoned to R-1ASingle Family
ResidE:mtial, and the sixty-two foot (62') access easement on said. tract is hereby
removed, effective immediately.

STATION, BRAZOS COUNTY, TEXAS AND BEING MORE PARTICULARLY DE-
SCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM

WHEREAS, the City Council held a public hearing in the City Hall
at 7:00P.M. on January 9, 1986 on the question of rezoning cer-
tain areas within the city limits: and
WHEREAS, the City Council has determined the following:
To rezone or change the classif~cation of the following five (5)
tracts of land lying and being situated in the Richard Carter
Survey, A-8, College Station, Brazos County, Texas and being more
fully described by metes and bounds as follows:

LOT 3, HENTON SUBDIVISION, COLLEGE STATION, BRAZOS COUNTY, TEXAS, BY
REQUIRING THE ZONING WALL OR FENCE BETWEEN THE R-4 APARTMENT/LOW
DENSITY AND R-IA SINGLE FAMILY RESIDENTIAL ZONES TO BE CONSTRUCTED
AS BRICK COLUMNS AND WOOD, REZONING ALL 3.51 ACRES TO R-IA SINGLE
FAMILY RESIDENTIAL, PROHIBITING VEHICULAR ACCESS BETWEEN THE TWO
PROPERTIES, AND FOR THE REMOVAL OF THE EXISTING ACCESS EASEMENT.
WHEREAS, on February 9, 1995, the City Council of the City of College Station convened and
. pursuant to notices proscribed by law held a public hearing with regard to the application for the
rezoning of a 3.51 acre tract or parcel of land known as Lot 3, Henton Subdivision, College
Station, Brazos County, Texas. and decided to require the above referenced fence to be
constructed as brick columns and wood and to prohibit any vehicular access between the two
above referenced properties;
WHEREAS, half of the above-described property is currently zoned R -4. Apartment/Low Density
and the other half is zoned R-IA Single Family Residential, and the current use of the entire tract
is vacant land;
WHEREAS, pursuant to Ordinance No. 1627, subject to a change in conditions, development of
the property cannot be made as an impractical fence exists between the two differently zoned
tracts;'!
WHEREAS, the owner of the above-described property, 1. V. Henton, applied for the removal of
the zoning wall or fence imposed by Ordinance No. 1627, for the rezoning of the entire tract to R-
IA Single Family Residential and for the removal of the existing sixty-two foot (62') access
easement recorded in Volume 1622, Page 128, of the Deed Records of Brazos County, Texas on
February 9, 1995;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence as to the
location of the property on the north side of Lincoln Street across from where Munson Street
ends and decided that there shall be no vehicular access between the R-1A property and the R-4
property;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence of the change
in conditions for the development of this property, for the requiring ofa fence with brick columns
and wood, and for the removal of the existing sixty-two foot (62') access easement mentioned
above; and
WHEREAS the City Council of the City of College Station, Texas, heard evidence that the
proposed zoning change is in conformity with the City's Comprehensive Plan;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the zoning wall or fence on the above-described 3.51 acre
tract is hereby required to be a fence with brick columns and wood, the entire tract is rezoned to

R-1A Single Family Residential, vehicular access between the two differently zoned tracts is
prohibited, and the sixty-two foot (62') access easement on said tract is hereby removed, effective
immediately.
