Appeal to Section K(2)(g) of the Driveway Access Location .and Design Policy to construct a commercial driveway at less than the- minimum :185' spacing required for collector streets: APPLICANT: Maria Poltes of Brazosland Realty fora major fast food chain. LOCATION:.. Lot 1, Block 17 of Southwood Valley 4B located on the southwest corner of Deacon Drive and the SH 6 Service Road. - ZONING AND LAND USE Subject Tract:. C-1, Vacant North: C-1, Includes Rheas :Car Wash and Laundry.Mat, Apartments Plus, and a vacant parcel with plans to be developed as a new Wing's & More Restaurant. South: C-1 Southwood Valley Turf East: C-3, Diamond Shamrock Gas and Convenience: Store (across Texas`. Ave.) West: `R-S, Developed as four-plexes STAFF COMMENTS: The property in question has 100 feet~of frontage on the service road and 350 feet: of .frontage on Deacon. The appiicam requests a curb cut on both the service road and Deacon and feels that the site will not work for her client if a driveway' is not allowed on the service road:` The proposed service road driveway .would be about 90 feet from Deacon. By ordinance, this distance should be 185 .feet. Staff approves of a single access being taken- off of Deacon but denied the request: for access to 'the service road due to it's close proximity to the Deacon/Texas signalized intersection: STAFF RECOMMENDATION: Staff recommends denial of this request. There is already a problem with the operation of the Texas/Deaconsignal due conflicts of north-south traffic on the service road interfering with traffic on Deacon waiting for the signal at Texas. During peak times, the queue on Deacon for the light stacks. well past the service road. Adding a high volume driveway fora aconvenience-oriented use will only compound this problem. and create mare havoc i for the operation of he Texas/Deacon signal. This appeal also applies to Section K(2)(h) which states that for corrunercal tracts abutting more than. one public street, access to each street may be allowed. only if it is demonstrated that -such access is needed to adequately serve driveway volumes and not be detrimental or unsafe to traffic operations on public streets.
