HomeMy WebLinkAboutOrdinance~~ ~ . ~~ ~~ ORDINANCE NO. 2068 AN ORDINANCE AMENDING SECTION 2 DEFINITIONS, SECTION 7 DISTRICT USE REGULATIONS, AND SECTION 12 SIGN REGULATIONS OF ORDINANCE 1638, THE ZONING ORDINANCE FOR THE CITY OF COLLEGE STATION, TEXAS; SPECIFICALLY TO DEFINE "COMMERCIAL TELECOMMUNICATIONS TOWERS" AND TO ESTABLISH USE REGULATION THEREOF. WHEREAS., the City is now being faced with significant telecommunications development issues, as both service providers and users .attempt to upgrade capacity and ufilize new technologies that are becoming essential infrastructure. WHEREAS, there is concern for the possible impact of telecommunications towers on surrounding land uses, but reasonable controls will mitigate such impacts. WHEREAS, it is reasonable to establish. regulation to allow commercial signage in C-B Business Commercial districts. WHEREAS, the City council of the City of College Station, Texas, held a public hearing in the. City Half`at 7:00 p.m. on Thursday, May 26, 1994, on the question of providing locafiions and regulations for commercial telecommunication towers. WHEREAS, the City Council has determined to amend these sections; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF COLLEGE STATIION, TEXAS: Amend Section 2. DEFINITIONS by adding: TELECOMMUNICATION TOWER, COMMERCIAL: A structure built exclusively to support one or more antennae for receiving and/or transmitting electronic data or telephone communications. This definition does not include amateur radio stations, satellite dish receivers. or emergency broadcasting stations. Amend. Section 7.1 DISTRICT A-O AGRICULTURAL-OPEN by adding: C. CONDITIONAL USES PERMITTED: The following conditional uses may be allowed in addition to any use allowed under Section 8.12: Telecommunications Towers which conform to ail setback requirements of this zoning district, which are within the reasonable height restrictions set by the Commission, which do not jeopardize the health, safety or welfare of the .public by their presence in the proposed location, which are consistent with the spirit, intent, and objectives of this ordinance, and which do not negatively damage, affect, or curtail the surrounding land uses. In making such determination, the Commission shall consider -the height., setback from buildings on adjoining properties, the overall' construction of the tower, and possible screening of the base of the tower. .~ <; Amend Section 7.12 DISTRICT A-P ADMINISTRATIVE PROFESSIONAL by adding: D. CONDITIONAL USES PERMITTED: The following conditionaF uses shall be allowed in addition to any use allowed under Section 8.12: Funeral homes. Large recycling collection facilities. Telecommunication Towers which conform to all setback requirements, which are within the reasonable height restrictions set by the Commission, which do not jeopardize the health, safety or welfare of the public by their presence in the proposed location, which are consistent with the spirit, intent, and objectives of this ordinance, and which do not. negatively damage, affect, or curtail the surrounding land uses. In making such determination, the Commission shall consider, the height setback from buildings on adjoining properties, the overall constructions of the tower, and possible screening of the base of the tower. Amend Section 7.16 DISTRICT M-1 PLANNED fNDUSTRIAL by adding: D. CONDITIONAL USES PERMITTED: The following conditional uses may be allowed in addition to any use allowed under Section 8.12: Funeral homes. Telecommunications Towers which conform to all setback requirements, which are within the reasonable height restrictions set by the Commission, which do not jeopardize the health, safety or welfare of the public by their presence in the proposed location, which :are .consistent with the spirit, intent, and objectives of this ordinance, and which do .not negatively damage, affect, or curtail the surrounding land uses. Amend Section 7.17 DISTRICT M-2 HEAVY INDUSTRIAL by adding: B. PERMITTED USES: AIJ uses permitted in M-1 and C-2, excluding C-1 uses, plus the following: Aircraft landing strips, sales, service, rental, or repair. Broadcasting towers for radio and television. Telecommunications towers. Concrete products manufacturing. Food processing plants. Machine shops. Salvage or junk yards. Storage tanks. Tire shops, .including vulcanizing and retreading. Warehousing Amend Section 12 SIGN REGULATIONS by adding: Section 12.3 GENERAL PROVISIONS K. FREESTANDING COMMERCIAL SIGNS: Freestanding commercial signs are allowed on)y on developed commercial property in A-P, C-1, C-2, C-3, C-B, M-1 and M-2 zones.... No more than one freestanding sign shall be allowed on any- premises except when all of the following condittions are .met: 1. The site must be zoned C-1, C-2, C-3, C-B, M-1 or M-2. L. ATTACHED SIGNS: Attached signs in areas. zoned C-N, A-P, C-1, C-2, C-3, C-B, M-1 and M-2 are commercial signs under this section TABLE II Summary of Sign Regulations Sign Permitted Classification District Traffic R-4, R-5, R-6, A-P, Control- C-1, C-2, C-3, C-B, M-1, M-2 Freestanding C-1, C-2, C-3, C-B, M-1, M-2 Low Profile A-P, C-2, C-3, C-B SEVERABILITY: Should any section or provision of this ordinance be declared by the courts to be unconstitutional or invalid,. such decision shall not affect the. validity of the ordinance as a whole or any part thereof other than the part so declared to be unconstitutional or invalid. This ordinance shall become effective from and after its passage in accordance with the City Charter of the City of College Station. PASSED, ADOPTED, AND APPROVED this 26th day of May, 1994.
