STAFF COMMENTS:
Conditional use permits are granted by the Commission, subject to appropriate- conditions
and safeguards, when the Commission finds:
A. That the proposed use meets all the minimum standards established in the Zoning
Ordinance for this type of use;
B. That the proposed. use is in harmony with the purpose and intent. of the zoning
ordinance and the .plan for physical development of the district as embodied,in the
comprehensive plan for the development of the City;

C. That the proposed use. will not be detrimental to the health, welfare, and safety of the
surrounding neighborhood or its occupants, nor be substantially or permanently
injurious to neighboring property.

The Zoning Ordinance contains a broad definition of the term "nightclub" - it focuses .more on the
entertainment aspects of an establishment, rather than on the serving of alcohol. The proposed use
will have occasional bands playing, and private instrument playing is encouraged. For this reason,
staff has determined that a nightclub, rather than a restaurant, .designation would best describe the
intended use. Any nightclub in the City .must first undergo a Conditional Use Permit review by the
Commission before staff may allow the. use.
There is no site plan review required, therefore there was no PRC held. However staff has no
concern with the intended use and would recommend approval.
