Planner Kuenzel and Staff Planner Dunn. AGENDA ITEM NO. L• Approval of minutes from the meeting of Apri17,1994. Commissioner Hall. moved to approve the minutes .from the meeting of April 7, 1994 as written. Commissioner. Smith seconded the motion which passed unopposed {4 - 0). .AGENDA ITEM NO. 2: Public :hearing to consider a conditional use. permit to allow a sorority house to be located on the corner of Rhett Butler and University Oaks, lot 4 of the Timber Ridge Addition. (94-702) Staff Planner Kuenzel :presented the staff report .and. informed -the-.Commission that the applicants are applying for the use only and will follow with a site plan at a later date. This plan will also come before the Commission. The subject property is zoned R-6 which allows apartment buildings at up to twenty four dwelling units .per acre with the option of higher densities if approved by City Council. The applicant does not intend to exceed the maximum density. The area has developed as a mix of mostly student housing with. a concentration of apartment buildings and sorority/fraternity houses. The request is keeping in with the zoning and land use patterns in the area. Several. property owners of the R-1 zoned area have voiced concern regarding this request. Apparently, the existing sorority houses.. generate a large amount of street parking especially during rush time. In some areas, the roads become blocked by cars, preventing the passage of .private and emergency.' vehicles. Most of the other sororities in the area were built before a change in the Zoning Ordinance that made parking more restrictive. There are twelve sorority houses in this area, only two of which were built under the current requirement of one. space per resident plus one space for every thirty square feet of meeting ,room.. The requirement before the 1986 change was only one space. per dwelling unit. According to one resident, the parking problem is aggravated during rush week by not only the .additional parking generated but also by the fact that the parking lots are blocked off and that parking is forced, into the streets. The applicant has explained that the front areas of the houses are used for outdoor .activities, but that parking in the rear is allowed. Staff will take this information to the next meeting. of the Traffic Management Team for discussion. This particular site will. have the parking in the rear and will meet the current parking requirement ;~ by providing 100 spaces. The Commission does have the discretion to place conditions on approval of the use and site plan. - Chairman Hawthorne opened the public hearing. Paul Clarke of Clarke and Wyndham Investments and representative of the owner of the .property approached the Commission and stated that. the property is currently zoned R-6 for apartments. In terms of density and traffic, the proposed sorority use is less intense and would be less detrimental to the surrounding single family homeowners. Julie Garth of 6923 Kelsey Rae Court in Houston, informed the Commission that she is purchasing the property to construct the' Alpha Phi sorority house.. The current facilities along Athens are too small and the chapter is continuously growing. The current facilities cannot be expanded so the chapter would like to relocate and build a bigger facility in the neighborhood. There will be forty eight women living in the house and a house couple to manage and maintain the property.. The project. is planned for 10,000 square feet in the first phase with plans to finish out the third floor of 3000 square feet for a meeting room. Peggy Brannon of 1102 Hardwood Lane approached the Commission and expressed her frustration .and the frustration of the surrounding .property owners in dealing with the sororities in the neighborhood during "Rush Week". During .this week, the sororities close off their .parking lots .and force parking along the street. Vehicles are parked along all streets including Hardwood and deny access to, private driveways. If there was an emergency during this time, afire truck or an ambulance could not drive down Hardwood Lane. Ms. Brannon stated that the neighbors have worked with the individual sororities and the Greek Council in trying to eliminate the problem but nothing has been done. The local police and fire departments have also been made aware of the situation and still nothing has been done. Chairman Hawthorne closed the public hearing. Commissioner Hall moved to grant the conditional use permit for the use only to allow a sorority house to be located on the corner of Rhett Butler and University Oaks, lot 4 of the Timber Ridge Addition. Commissioner Lane seconded the motion Commissioner Hall informed Ms. Brannon that the neighborhood .has legitimate concerns; however, the Commission does not have. the authority. to address the problem. The proposed sorority house would be' less intense as far as traffic is concerned than high density apartments which are currently allowed. Commissioner Hall requested that staff place the item on the next City Council meeting to allow the'.. problem to be discussed in an open. forum. Jennifer Chavez, the President of :the Rush Committee at Texas A&M, presented a revised parking policy for "Rush Week" and stated that the Committee is looking into providing a bus system for 1994. She agreed to meet with Ms. Brannon after the meeting to see if an agreement could be reached. The motion to grant the: conditional use permit passed unopposed (4 - 0). AGENDA ITEM NO. 3: Public hearing to consider a conditional use permit to allow a cellular telephone facility to be located along Highway 6 South, tract 22 totalling 1.76 acres in the S.W. Robertson Survey. (94-703) Staff Planner Kuenzel presented the staff report requesting a permit to allow a cellular telephone communications facility and tower to locate on a triangular lot. along the frontage of Highway 6 South on Tract 22 of the S.W. Robertson Survey. The lot is a triangular fragment of an older tract that, due to its shape, is unlikely to develop as a larger commercial use. It abuts a public utility substation and the request is in line with the existing and future land uses. Six surrounding property owners were notified with no response. (94-705). -- -_ -- __ -_ _ __.__ ,~ -~, Staff Planner Kuenzel presented the staff report and recommended approval of the proposed conditional use permit with the ,comments outlined in the Project Review .Committee Report. .The 'Planning and Zoning Commission approved the use'. only of the property for a sorority house on April 21, 1994. _ The site .plan must also receive approval by the Commission to ensure that all minimum standards have been met. Chairman Hawthorne opened the public hearing. Architect Jimmy Holland approached the Commission and stated that he is currently working with .staff on realigning a driveway along Rhett Butler to meet the driveway ordinance requirements. He offered to answer any questions pertaining to the proposed conditional use. permit request. .Chairman. Hawthorne closed the ..public hearing.. Commissioner Herring moved to grant a conditional use permit and approve the site plan for the Alpha. Phi Sorority to' be located on the southwest. corner of Rhett Butler 'and University Oaks with staff recommendations. Commissioner Smith seconded the motion which passed unopposed (5 - 0)'. AGENDA ITEM NO. 4: 'Consideration of a final.. plat and site plan of 'the Waterford Apartments in the Troy Subdivision located. along the west side of Dartmouth Drive approximately 190'. north of the'' Colgate .Drive intersection. (94216 & 504) City Planner Kee presented the staff report and recommended approval of the final plat as submitted with the Project Review Committee comments regarding. the electrical easement. Staff also recommended approval of the. site. plan:, with the additions required by .the Committee. No permits for construction will be issued until the final condition regarding. the extension of Corneh has been satisfied. Staff has been working with the developer'... to prepare a development agreement to present to .the City' Council in the future addressing the Cornell extension. Engineer Greg Taggart with the Municipal. Development Group offered to answer questions. Commissioner Herring moved to recommend approval of the final plat and. site plan of the Troy Subdivision :and Waterford Apartments located along the west side of Dartmouth Drive approximately 190' north of the .Colgate Drive intersection. Commissioner Lane seconded the motion which passed unopposed {5 - 0). AGENDA ITEM NO. 5: Consideration. of the final plats. of the Emerald Forest Phases 10 and 10A Subdivision. (94-206 & 20'~ Project Engineer McCully presented the staff report and recommended approval of both plats according to the .conditions and comments listed in the Presubmission Conference Report. According to the development. agreement, a dedication was made 30' in width from the eastern end of Phase 10A as proposed and extending to the eastern limit of the owner's property. This dedication was for the access road to the Carter's Creek waste water treatment plant. Engineer Deborah Keating approached the Commission and offered to answer questions. Commissioner Hall moved to recommend approval. of the final plats of Emerald Forest Phases 10 and 10A with the recommendation .that the City Council move forward with the City's portion of North Forest Parkway. (94-705) A Project Review Committee meeting was held Wednesday, April 20, 1994 to discuss the above mentioned parking lot plan for a conditional use permit. City Engineer David Pullen moved to approve the site plan with the following conditions: CONDITIONS OF APPROVAL: _ Due to the number of changes to the proposed site plan, a revised site plan with complete landscape plan must be submitted by noon on Wednesday, .April 27, 1994 to be scheduled for the Planning and Zoning Commission meeting of May 5, 1994. If the conditional use permit is delayed, an additional $50 fee must be submitted along with 15 copies. of the revised site and landscape plans by noon on Friday, April 29, 1994 to be considered by Planning and Zoning. Commission at their next available meeting on May 19, 1994. PRC Report ' 'Alpha Phi Sorority Case #94-705 Page Z _ Note that the revised site plan will come before the Planning and Zoning Commission for final approval. .After the Commission approves the site plan, any significant changes to the site plan must return to the Commission as another public hearing. Correct the traffic conflicts with the three parking spaces located along the entrance drive on Rhett Butler and the small parking area totalling seven. parking spaces located closest to. the building. There are also overhang conflicts. All end islands separating two rows of parking need to be a minimum 360 square feet and not 180 square feet. A sidewalk must. be installed along Rhett Butler Drive and must meet ADA requirements where it crosses the driveway entrance.. The sidewalk can meander with transitional curves along the frontage of Rhett Butler in order to be an amenity. to the site and preserve existing trees. Label the sidewalk as proposed and. provide a public utility easement to cover. the entire sidewalk. City Planner Jane Kee seconded the motion which passed unopposed (2 - 0); Planning and Zoning Commissioner Mary Elizabeth .Herring was not present during the official vote. The following comments were made by the various reviewing agents: ENGINEERING: Note' that there is no floodplain on the subject property. _ Provide curb, sidewalk and pavement details either on the site plan or with the construction documents. _ Provide radii, throat length and driveway width opening dimensions. Show the opposite and adjacent drive openings and their distances from centerline to centerline. Verify that the final dimensions comply with the current Driveway Access Location and Design Ordinance. _ A drainage development .permit is required prior to any site work and issuance of a building permit. PLANNING: _ Show the square footage of the building including a break down of proposed uses and their square footages. Show the location. and the square footage of the meeting room. Note ownership and zoning of surrounding properties. Note the number of bedrooms, apartments, adults and students. Provide a parking legend showing the number of required and provided parking spaces. _ Show the proposed dumpster locations and screening. 1~RC Report ' 'Alpha Phi Sorority Case #94-705 Page 3 PARKS: _ A landscape plan .must be submitted and approved by staff prior to the Planning and Zoning Commission meeting. _ Parkland dedication in .the amount of $225 per bedroom is required prior to issuance of a building permit. BUILDING: Provide four handicap parking spaces and show on plan. LONE STAR GAS: _ Contact Lone Star Gas Representative Don Fazzino at (409) 776-0627 to locate the existing high pressure gas line prior to grading the site. FIRE: Provide fire lanes in accordance with current ordinance .requirements. Paint the curbing around the perimeter of the driving aisle from University Oaks Boulevard through the site to Rhett .Butler Drive. _ Locate existing and proposed fire hydrants. Afire hydrant must be located at least 300' from any portion of the building as the hose lays. WATER/WA5TE WATER: ''~ Show existing and proposed sanitary sewer and water mains. _ Provide .water demands in gallons per minute. Show the proposed water meter and the private water line to the building. Provide sanitary sewer loadings. _ Show private water and sanitary sewer services. '~, ELECTRICAL: _ The building will be served with underground electrical service. The developer is responsible to install conduit from the power pole to the building. Submit a letter requesting service .and agreeing to pay 20% of the total cost of electrical service. _ Provide transformer locations and public utility easements to cover the transformers. Provide two 3" conduits in the. same trench as the electrical lines, with a minimum 18" separation, to stub out approximately 3' from the building. Coordinate .service details with G.T.E. Representative Laverne Akin at (409) 821-4723. TCA CABLE: _ Provide one 2" conduit from the power pole to the building for cable service. Coordinate details with TCA Cable Representative Mike Lavender at (409) 846- 2044. SUBMIT 10 REVISED SITE PLANS BY NOON. FRIDAY, APRIL 29, 1994 TO BE .INCLUDED IN THE PLANNING AND ZONING COMMISSION PACKETS FOR THE MEETING OF MAY 19, 1994. APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee to :the. Planning and Zoning Commission within five days after the PRC Committee meeting. Failure to appeal the PRC action. shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of the final site plan as approved by the PRC, showing.: all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until said copies are on file, no further development approval shall occur, and no further action by the Commission shall take place. An applicant may appeal only certain aspects of site plan review, and in the absence of .discretionary review by the Commission, or review pursuant to a petition, all other aspects of the site: plan shall be final.
