We would like to arrange a time with your staff when we candiscuss these matters. A preliminary construction cast esrimate has been included far your use. As are initial discussion paint, in the interest of saving time , we would like to offer to the folltawin~ suggestiara. Since the Corn~il Street connection may be same time in occurring, Tray. vrot~ld offer to install. the connecting water line, with the. necessary valves and appurtenances, provide far engineering design of the. new street; and pay for the rough grading and site preparation. This is a fair discharge of our .obligation to assist in the development of this area. This approach allows us to proceed with our pro,~ect without having to conduct lengthy negotiations with the estate, or other tasks better suited for the City, but which the City may not want to fund at this time. In my review I have found that there is only one item outstanding as of this date. This is item 1.1.i:~"Developer shall, at his expense, contract with a registered engineer to design and prepare plans and specifications for the extension of Cornell Drive. All design work and plans shall be sealed by the ...preparing engineer'. These plans/specs have been submitted to the City for review and have been returned for correction. In my estimation, the plans when submitted were 85% complete. They have not been resubmitted for review of corrections and ultimate approval. This item is still unresolved. I have called you on several occasions regarding this invoice but you have been unavailable. During conversations we had several months ago, we discussed the invoice. and you told me to disregard them as you had directed your accountant to cease the billings until we had a signed contract. Your accountant has not complied with your request and has added a sentence regarding possible legal action for recovery. The City is more than willing to pay MDG for their services on the project, but will not pay for those services that should have been charged to your Jefferson Ridge client. We have discussed several areas where MDG was .asking the City to ppay for portions of the design that the City felt. should have been absorbed. by Jefferson Ridge. If you will. please send us a modified proposal,. detailing only that work that the City requested of MDG and not that which Jefferson Ridge was required to perform, we will be happy to prepare the contract paperwork and process any invoice in accordance with that contract. In addition, we have not received any of the final design work on the Cornell project. Last we saw, MDG was in the process of refining the final design but it has not been approved for construction. The reason for mentioning this is to remind you of that obligation in accordance with the development agreement that the City currently has with Jefferson Ridge. Approval of those documents is an obligation stated within that development agreement. Detention Facility at Jefferson Riclge Apartments (DDP #233) Dear Steve: Per our conversation today, it is our intent to perform the following activities in an effort to rectify the erosion problem on the adjacent .site (northwest corner of Jefferson Midge). Based on certain .information which. JPI will receive. from 1VIDG Engineers, the following will take place: 1. MDG will provide JPI with existing grades on the property located to the west of Jefferson Ridge; 2. If the grades do not reflect, site conditions (contours) that existed prior to work commencing. on Jefferson Ridge, MDG will provide us the information needed to restore the site. to its original grades; 3. JPI will submit the information to the. City of College Station for a permit; 4. JPI will regrade the area in question, restore vegetation by applying winter rye hydromulch, temporary irrigation; and staking hay bales. If the hay bales do not control the erosion while re-establishing the. vegetation, silt fences will be added and, 5. Once the ..area has been re-established, JPI will clean out the flume within the detention pond at Jefferson Ridge. We anticipate that NIDG will tart verifying grades within a few days and based on the information we receive, we will start the permitting process and the work immediately thereafter. Based on the above information we believe all work-can be completed by the end of February.. As we both know weather will effect our time schedule but it is our desire to complete the work as soon' as possible. All design work and plans shall be sealed by the preparing engineer". These plans/specs have been submitted to the City for review and have been returned for correction. Greg Targert Thursday, April 28 to discuss. the Troy Subdivision share of the Cornell Drive connection. ' Find attached a letter from Mr. Targert to Jane Kee. It contains the cost estimate for Cornell. Gillingwater has proposed to pay for the items with the asterisk to their right. It would leave the city'. with a water line in place, the final design and specifications for: Cornell ready to `bid, the right-of--way legal description for Cornell and an estimated $54,678 of construction expense to make the street connection. We did not discuss any:ROW costor the. potential for Gillingwater participating in that cost. Gillingwater will need construction ROW to prosecute his part and a permanent easement for the water line. I discussed the ROW with Greg Targert this. morning. He expressed a desire for the city to use its :purchasing power to secure the Cornell right-of--way. Apparently an estate. owns the. property and there is conflict within the group. He stated that in his opinion, condemnation will. likely be required.. According. to the engineer's estimate the developer will be paying about 23% of the cost. It should be pointed out that-the waterline cost may be attributed to the developer's. cost to develop his property. If that were the case the. developer's. percentage contribution would be about 20%. `Again, that does not include right-of--way. costs. Gillingwater's project can be constructed without the water line connecting through Cornell. In my opinion, that is not the best solution available. Money has not been budgeted for Cornell. Cornell. is not a part of the current list of potential projects .for bond election consideration. I recommend we,present thisproposal #o .council forconsideration in a'semiconceptual' form.
