It has come to our attention that Parkland Dedication was not paid for the two buildings you,
Jeff McDowell, and the Marek Brothers built on Balcones. The amount owed the City for
those two buildings, based on a base fee of $225.00 per unit, totals $2,700.00. This amount
was due prior-to .issuance of a Building Permit,. but because it has not been paid, it becomes
necessary to inform you that until that fee is paid, additional building permits for residential
units on Tract B & Tract C of Southwood Section 30 subdivision will not be issued.
We will be happy to apply. funds. toward the required Parkland Dedication immediately upon
receipt.

DearJeff:
In response to your request, the .City staff has conducted research to determine if Mr. Fitch,.at
the time of subdivision of certain sections of Southwood Valley which are located in Park Zone 5,
dedicated enough parkland to cover the 24 apartment dwelling units you :recently built on
Balcones.
The result of that research indicates that parkland dedication was made to cover the construction
of a total of 3105 dwelling units,in that zone: The attached schedule indicates that a total of
3098 units have been used with the listed plats, leaving an excess of 7 units which can be used
toward the parkland dedication required for your 24 units on Balcones. That leaves a dotal of 17
units for which parkland dedication'_has-not been made.
That dedication can be made by a monetary payment in the amount of $225.00 per dwelling unit,
or $3825.00. This dedication must be-`made before any additional building- permits will be issued
in Southwood Valley Section 30.
Tony Jones ,has submitted building plans for -a 12 unit building on :Lot C2, and he will be
expected to pay parkland dedication on those units prior to issuance of `a Certificate of
Occupancy because the review of his plans was well underway prior. to the' findings of his
research. He has been apprised of this requirement.

SUBJECT: Parkland Dedication
Attached is a brief synopsis of the parkland dedication. related to Mr. Fitch and
Southwood. Valley, Inc.. Land dedication included Longmire. Park, part of the
Er®thers Pond Park, and. a very small parcel adjacent to George K. Fitch Park.
George K. Fitch Park itself was a gift deed: to the city and. to my knowledge was
not dedicated with the intent of meeting the parkland dedication ordinance.
The total dedication allowed for 3105 dwelling. units in that zone. The attached
schedule indicates that a total of 3098 units were used with the listed plats.
Additional dedications for other projects in Zone 5 were done through cash
dedication.

Dear Shirley:
i am iri receipt e; your letter of ~anuar; ~7, 199a regarding sxalanation of the
disputed Parkland Dedication Fees for our project located on Balcones.
Our posture has not changed with receipt, of this correspondence: In researching
the plat dates for Southwood Valley Section 24D,E,C, and A, the earliest plat date for
any of these sections is April 1985. Southwood Section 30 was originally platted in
February 1981. The discrepancy in dates does not lead me to believe that Mr. Fitch
platted Section 30 with the intention of using a portion of the parkland dedication to
` service future sections within Southwood Valley.
In referring to "College Station Development Services Subdivision Regulations"
Revised 1/92, page 9-30, Section 10~ Reguirerrients For Park Land Dedication, I find
that it is the responsibility of he developer, of the filing of the "Final Plat" that "such ,
plat shall contain a clearfiee simple. dedication of an area of land to the City for .park
purposes, which area shall equal to one (1) acre for each one hundred thirty hree
.(133) proposed dwelling units:" As :the zoning was established at or prior to the, ,
acceptance by the City, of College Station of the "Final Plat", I can surmise that the
parkland dedication of 10 acres is more than adequate to satisfy the total number of
.units that could be developed within',Southwood Section 30. Further, absorption. by the'
First Baptist Church of College Station of `land previously platted for multi-family
development removed land in this section from development into multi-family
development, thereby allowing less units to use the dedication with the same
acreage, as originally platted, per the ordinance.
We remain steadfast in our belief that Mr. Fitch dedicated 10 acres in Section 30 for.
the express. purpose of satisfying the Parkland Dedication requirements for that -
Section. That belief is further verified by the ordinance as'it relates to the dediG~tion of
parkland. It appears from your letter that the City of ;College Station must also. share
the same thought because you allowed the utilization of this excess dedication 'to be
nor .does the Ordinance address this issue.

SECTION 10: REQUIREMENTS FOR PARKLAND DEDICATION
10-A Purpose
10-A1 This section is adopted to provide recreational areas in the form of neighborhood
parks as a function of subdivision development in the City of College Station. This
section is enacted in accordance with the home rule powers of the City of College
Station, .granted .under the Texas Constitution, and the statutes of the State of
Texas, including, but not by way of limitation, Articles 974a and 1175: It is hereby
declared by the City Council that recreational azeas in the form of neighborhood
parks aze necessary and in .the public welfare,. and that the only adequate proce-
dure to provide for same is by integrating such a requirement into the ,procedure for
planning and developing property or subdivisions in the city, whether such devel-
opment consists of new: construction on vacant land. or rebuilding and remodeling
of structures on e~dsting residential property.
10-A2 Neighborhood parks are those pazks ,providing for a variety of outdoor recreational
opportunities and within convenient distances from a majority of the residences to
be served thereby. The park zones established by the Pazks and Recreation
Department and shown on the official Pazks and Recreation map for the City of
College Station shall be prima facie -proof that any park located therein is within
such a convenient distance.: from any residence located therein. The primary cost
of neighborhood parks should'be borne'by the ultimate residential property owners
who, by reason of the proximity of their property to such parks, shall be the primary
beneficiaries of such... facilities.. Thezefore, the following requirements are adopted
to effect the purposes stated:
10-B General Requirement R 1 R 11~ R 2 R 3 R 4 R-5 R-6 Land to be Used for Single-Family,
Duplex, and/or Apartment Residential Purposes
10-B.1 Whenever a final plat is filed of record with the County Clerk of Brazos County for
development of a residential azea in accordance with the planning and zonntq reg-
ulations of the City, such plat shall contain a cleaz fee simple dedication of an azea
of land to the City for park purposes, which azea shall equal to one'(1) acre for
each one hundred thirty-three (133) ..proposed dwelling units. Any proposed plat
submitted to the City for approval shall show the area proposed to be dedicated
under this section. The required dedication of this subsection may be met by a
payment of money in lieu of land when permitted or required by the other. provi-
sions of this section. ',
10-B.2 The Ciiy Council declares that development of an area smaller thanone (1) acre
for public parks .purposes is impractical. Therefore, if fewer than one hundred
thirty-three (133) units aze proposed by a plat filed for approval, the developer shall
be required to pay the applicable cash in lieu of land amount provided by 10-D.3.,
rather than o dedicate any land area. No plat showing a dedication of less than
one (1) acre shall be approved.
10-B.3 In instances where an area of less than five (5) acres is required to be dedicated,
the City shall .have the right to accept the dedication for approval on the final plat,
or to refuse same, after consideration of the recommendation of the_Planning and
Zoning Comnussion and the Parks and Recreation Board, and to require payment of
cash in lieu of land in the amount provided by 10-D.3., if the City determutes that
sufficient park. area is already in the public domain in .the azea of the proposed
development, or if the recreation potential for that zone would be better served by
expanding or improving existing parks.
10-B.4 The dedication required by this section shall be made by filing of the final plat or
contemporaneously by separate 'instrument unless additional dedication is required
subsequent to .the ftlirtg of the .final plat. Ii the actual number of completed
dwelling units exceeds the figure upon which the original dedication was based,

10-E Comprehensive Plan Considerations
Land shown on a comprehensive plan as being suitable for development of the City for a
major recreational center, school site, park, or other public use, shall be reserved for a
period of one (1) year after the preliminary plat is approved by .the City if within two (2)
months after such approval the City Council advises the subdivider of its desire to acquire
the land or of the interest of another government unit to acquire the land, for purchase by
the interested .governmental authority at land appraisal value at the time of purchase. A
failure by the City Council to so notify the subdivider shall constitute a waiver of the right to
reserve the land. Any waiver of the right to reserve the land shall no longer be effective if
the preliminary plat shall expire without adoption of a final plat.

Dear Shirley:
I am in receipt of your letter of 11/2194 regarding Parkland Dedication reimbursement. I
have previously discussed this item with Mr. Bill Fitch and it was stated that the dedication of
Georgie Fitch Park satisfied the Parkland dedication for that particular phase of Southwood
Valley. Therefore, because of the option of payment of funds or dedication of land, the
Parkland dedication. has been satisfied for the lots developed and yet to be developed.
If there is a policy for double pledging of land andlor funds, please advise me.

Dear Mr. Woods:
An omission was made in the permitting .process for the two buildings you, Mr.
McDowell, and the Marek Brothers built, in that City staff did not collect the fee
for Parkland Dedication during the process. The amount owed the City for those
two buildings, based on a base fee of $225.00 per unit, totals $2700.00. This
amount was due prior to issuance of a Building Permit, but because of the error
in .collecting the fee during the entire process, it becomes necessary. to inform
you that until that fee is paid, additional building permits for residential units on
Tract B & Tract C of .Southwood Valley Section 30 subdivision will not be issued.
We apologize if this error of omission causes you any inconvenience. We will
be .happy to apply funds toward the required Parkland Dedication immediately
upon receipt.

NOTES: Find the diameter of the existing tree along the horizontal scale. Follow the grid line up until
it intersects the radius of the'barricade along the vertical scale. Read the points .allowed
from within the sector in which the intersection falls.
Example; 12"diameter existing tree with a 10" barricade would receive 125 points.
