Your site plan'should be modified to show,the extent of the existing drainage easement on the east side. of the. ditch. If there is-at least' 15 feet between the eastern limit of the easement which is free of major obstructions (like power poles), then access can be assumed from the east, and the easement requirement on your site will be limited to a minimum of 5 feet. from the western -top of bank. ,: Ifthere is not enough room on the east, or the access is blocked, then a minimum of 15 feet will be required from the western top of bank. Fwd=by:=Sabina=Kuenze=9/15/94=12:19pm== Fwd to: Shirley Volk CC: Jane Kee, Veronica Morgan la•barronena•-•they•need•to•let•us•know when their landscaping is in and we will go check again. applebee's - Joey and i checked yesterday and they are no where near finished - no striping, some curbs still missing, sidewalk missing (forms are up for it), no landscaping. 548 sw parkway - we ran into larry on site and i told him i would check into some things for him. he wants a co before the weekend but will have no landscaping in until all 8 buildings are finished. so i told him that i think i can co up to 4 buildings and that if he gets some trees out. there, maybe i can let him bond out. what is missing at 5 times point value. he will not have striping in until all 8 buildings are done. i don't know how to handle that one - jane what if fwe check to make sure the measurements are ok but allow the co on one half of the buildings? as long as .the dimensions. are ok and the. parking area on one side of the lot is cleaned up for resident parking, do we want to set up this. kind of precedence? actually, if we require striping building by building, we can ensure that at least these areas of the parking lot are clear (they look bad now with construciton stuff and equipment in them) also, (v?, Jane?, shirley?), don't you guys remember that we required the entrance drive that leads thru phase two to be curbed until phase two develops? .that long drive currently does not have one but i could swear we discussed that. of course, the prc report does not say anything. but maybe the first round of building permit red lines say something to this effect? Texas 77842-9960 (409) 764-3500 June 26, 1995 Mr. Larry Landry 3609 E. 29th Street ` Bryan, TX 77802 RE: Code Violations at Pontalba Apartments Dear Larry: Engineering and Planning/Zoning :personnel made inspections of your site during the week of June 19-23 following notification by you that the work listed in our letter to you dated May 22, 1995, was completed..I was informed by Engineering staff members Ghat the engineering problems listed in that.. letter have been adequately addressed by your contractors and you no longer. have .code inadequacies in that area. Planning staff members reported. that their inspection of your site indicated. that you are still lacking 220 points, ..however they have agreed that because that represents less than 1 % of the required number of points, they are agreeable to letting that go until you complete Phase 2, at which time the total number of .points for the entire deve)opment must be in place. Planning staff found 63 shrubs, 21 canopy trees and 2non-canopy trees during their visit to your site, with the point total being 1575 in trees, 630 in shrubs and 80 in non-canopytrees, foi- a total of 2285. points provided. Phase 1 required a point total of 2505, but as mentioned. earlier,. these can be made up in Phase 2 when you are putting that landscaping in. .Thank you so much for your cooperation. STATIOI`I Post Office Box 9960 1101 Texas Avenue College Station, Texas 77842-9960 May 22, 1995 (409) 764-3500 Mr. Larry Landry 3609 East 29th Street Bryan, TX 77802 Dear Larry: It has come to my attention that the last building of Phase One of the Pontalba Apartments received a Certificate of Occupancy on May 5, 1995. At the time the final inspection was made of the site, it was noted that some of your landscaping is lacking; in fact, ar additional 1..,185 points are required. Four hundred ninety-seven (497) of those points need to be irr canopy trees A° LEAST 1.5" in caliper. The remainder of the required points can be in,canopy trees, non-canopy trees or shrubs. In addition to the landscaping which .needs to be completed, the engineering inspector made a final inspection on May 4, 1995, and furnished the following list which needs to be completed before the site is acceptable: 1. The drainage out-flow. structure is not completely backfilled at the southeast corner; 2. The parking. lot leave-outs were not constructed correctly; 3. Clean out the drainage ditch on the east property line: It contains quite a bit of construction debris. 4. Seal the expansion joints betweer4 the sidewalk and the back of curb on Southwest Parkway. 5. The handrail does not extend the full .length of he drainage ditch, and is set on top of the sidewalk instead of behind the sidewalk, thus impeding the clearancesrequired on a public sidewalk. Please address these. inadequacies on your site within 45 days. Failure to comply within the allowed time frame will.. result in issuance of a 'citation. Zoning Ordinance, violations are considered as separate offenses for each day of ' violation, and each offense .could cost from $25.00 to $2000.00 per day. Our Zoning Ordinance includes a provision for you to post a financial .guarantee for your landscaping requirements, but. the .other site violations have'-no :provision for posting financial guarantees, o you wilt have to complete these items within the 45 days. The College Station Planning and Zoning Commission City of College Station College Station, Texas Re: Ordinance 1961 Variance Request on Driveway Location fora 4.02 Acre Tract on Southwest Parkway-Owned by Larry Landry' (Proposed Pontalba Apartments) Dear Sirs:. We are requesting. a variance for driveway location because we oannot meet all. of the ordinance requirements.. This tract is vacant and the surrounding tracts have been developed.. We: are trying to retrofit a development into an area that has been constructed over the years under different guidelines. This variance request is not. contrary to the public interest. The driveway location we have chosen has taken into account the ordinance intent along with the physical characteristics of the specific area. We believe we are justified in our driveway location as follows: A. The ordinance requires on a minor arterial that adjacent driveway spacing be 230 feet minimum, with 300 feet desirable. 1. 'Our tract has a total frontage distance of 287.97 feet. There are already existing driveways on adjacent properties very near .our. property lines. There is not enough room to physically meet the ordinance. 2. Our driveway ocation is 268 feet from a Willowwick Apartment driveway to the west, and 95 feet from a Southwest Parkway Car Wash and Store More driveway to the .east. We believe this location is acceptable due to ....traffic being heavier. in and out of an apartment project as opposed to a storage project. B: The ordinance requires, on a minor arterial, that the opposite left drive spacing be 125 feet minimum, and that the. opposite right drive spacing be 225 feet minimum, with adesirable spacing of 350 feet. 1. _Our drive is spaced at 287 feet on the opposite left; and at 225 feet on the opposite right. The Oakwood Apartment driveway is connected to the major portion of the complex, and the Brownstone Apartment driveway only serves a 67 space parking lot. There are several units of Brownstone that is cut off from the rest of the project. Iu summary, we haveplaced. our driveway to be farther from the higher traffic loads. and closer to the lesser traffic loaded drives. By allowing us our requested location, we also allow greater flexibility for. whoever develops the land across the street. Please approve this variance request for our driveway location. as shown on the attached site plan. Thank you. He already has a C.O. Yor bldg 532. The electric and mechanical finals have been done on bldg 528, so a C.O. request will follow soon. Planning/Zoning personnel. made inspections of your site during the week of June 19-23 following notification by you that the worklisted in our letter to you dated .May 22, .1995, was completed. I was informed by Engineering staff members that the engineering problems listed in that letter have been adequately addressed by your. contractors and you no longer .have code inadequacies in that area. Planning staff members reported that their inspection. of your site indicated that you are still lacking 220 points, however they have agreed that because that represents less thane 1 % of the required number.. of points, they are agreeable to letting that go until you cornplete Phase 2, at which time the total number of points for the entire development must be in place. Planning staff found 63 shrubs, 21 canopy trees and 2non-canopy trees during their visit to your site, with the point total being 1575 in trees, 630 in shrubs and 80 in non-canopy trees, for a total of 2285 points provided. Phase 1 required a point total of 2505, but as mentioned earlier, these can be made up in Phase 2 when you are putting that landscaping in. Thank you so much for your cooperation.
