RE: REQUEST FOR RECONSIDERATION OF DENIAL OF A
TEMPORARY PARKING LOT
This request is-from Marvin. Tate and Larry Allen regarding the gravel parking lot located
on Kyle adjacent to the Culpepper office buildings. The Planning & Zoning Commission
considered a request for a temporary parking lot .earlier in February of this year. There:
were only five Commissioners present and neither Mr. Tate nor Mr. Allen were able to
attend the meeting.. The Commission voted to deny the temporary parking lot by a vote of
3 to 2.
Mr. Tate and Mr. Allen are asking permission from the Commission to rehear the case at a
future meeting. They feel that perhaps the Commission did not have all the necessary
information. If the Commission is amenable to this staff will schedule this item for a future
agenda. This is not on your agenda for discussion of the pros and .cons of the temporary
.parking lot. but only .for a decision as to whether or not the Commission will reconsider the
request.

RE: Temporary Parking Lot 94-434
The request .for a temporary parking lot came before the .Commission in January of this year and was
denied due. primarily to aesthetic concerns. The applicant was not present at the meeting and therefore
was not in a position to negotiate any screening or other potential improvements to the temporary lot.
He has requested that this item come back before the Commission. for an opportunity to address this
concern and any others that the Commission may have.
The. Zoning Ordinance requires all parking .lots to be paved, curbed, and landscaped and it provides
accessand maneuvering specifications.. However, there is a special section that gives the Commission
authority to, approve emporary parking lots for a period of one year if the applicant meets the standards
for a gravel. parking lot and if the Commission finds the following:
1. Traffic control is safe and convenient
2. Pedestrian safety is assured
3. Access for emergency vehicles is efficient
4. Runoff and flooding is controlled
5. There is little or no impact on adjacent land uses
,6. The lot is not a detriment to the health, safety, and welfare. of the public
The PRC met in Decembex of last year to review the plan and. found compliance with the. gravel parking
lot standards.. .Staff also .has reviewed the access and pedestrian/traffic .control and will assure
compliance with the Drainage Ordinance (to address items 1. through 4., above).
Staff recommends approval with the conditions that a fence be provided along the northern sidle to
prevent illegal parking and .that signs be posted to this effect. Due to the fact that access is taken .:from
the adjacent parking lot to the south, a letter from that property owner needs to be submitted that would
allow such access.

RE: Temporary Parking Lot 94-434
The Zoning Ordinance ordinarily requires that all parking lots be paved, curbed, landscaped,
and meet dimension requirements. However, the Ordinance also allows temporary parking
lots for a period not to exceed twelve months .where all standards for -such lots as prescribed. in
the Ordinance have been met, and where the Planning and Zoning Commission finds that
safety and drainage concerns have been met and that the impact on surrounding land uses is
minimal. Please refer to the 6 standards that the PRC reviews for compliance as well as the
additional criteria that are at the Commission's discretion.
The applicant wishes to use a small portion of a vacant lot located along Kyle adjacent t:o the
Culpepper Office Park behind Appletree for a gravel parking. lot. This area. will serve
overflow .parking from Kensington Apartments.
The PRC reviewed this plan on December 28, 1994, and found compliance with the 6
standards. As a condition of approval, staff recommends the following three items be rnet:
1. A fence around the parking area will prevent parking on the rest of the
vacant land and keep it on the approved area only.
2. Signs stating. "parking on improved area only" will further discourage illegal
parking.
3. The site takes access across the office center parking lot. A letter from that
property owner needs to be submitted to allow such access.
Staff would recommend approval. Should the Commission approve this project, the property
will still need to be returned to its original .state or brought into compliance with normal
parking lot standards 12 months from the approval date.

Re: Kyle Street temporary parking lot
Thank you for taking the time to reconsider my request for a temporary parking lot
on Kyle Street across from the Kin~sington Apartments, which I own.
There appeared to be some concern about the fact that I did not attend the P&Z meeting when.
this matter was on the agenda or that my associate, Marvin Tate, did. not attend the meeting. I was in
California on a business rip, and Marvin had retained the services of Garrett Engineering with the
understanding that Garrett would handle the matter and Marvin. did not choose to attend because he was
the mayor of Bryan at the time and did not want his position or presence to be considered in the request.
This. request is very important to our operation because of the pressure of additional vehicles parking in
and around our apartment project caused partly by the fact that when we bought the property, .cars were
allowed to park onKyle Street.
We will appreciate the granting of this temporary parking lot request, and it is our intent to
convert part of this: property into a permanent parking lot within the lime frame of the temporary permit
working in conjunction with the city staff.

RE: Temporary overflow parking lot located within a 2.92 acre tract -Parcel IV,
Block B, of the Culpepper. Plaza Subdivision
To whom it may concern:
I am writing in reference to an illegal parking lot that was recently created bn the. subject
property. About a year ago, we spoke with Mr. Marvin Tate, .who was at the time
representing the owners of that property. We informed him that the gravel lot does not
.meet City requirements and standards. All new parking lots must meet City standards
relating to paving, curbing, landscaping, drainage,. etc. A lot that does not meet: this
standard can only be permitted if the Planning and Zoning Commission grants a permit. for
a temporary. parking lot. In February of this year,. the Commission denied permission for
such a facility.
Several members of this Staff have called my attention to the fact that the parking of is
still in existence. Please. note that the lot remains in violation of Ordinance No. 1638, the
Zoning Ordinance for .the City of College Station. Section 10 of that ordinance requires
that a site plan for .all development be submitted, showing compliance with a11. site
requirements as required. in Section 9 and 11, and construction must be in compliance with
an approved site plan. To date, we do not have such a site plan on file.
I am hereby requesting that this portion of the subject tract be returned to its natural ;state,
and that all gravel be removed. If any vehicles continue to use the site, even after it has
been cleared, they must be removed as well.
I regret that I must now. serve formal notice of the City's intent to file charges against this
property. If compliance has not been gained by the end of 45 from the of receipt of this
letter, we will cite you for each day that the property is not in compliance. A Zoning
Ordinance violation is considered a separate offense for each day of violation, and each
offense could cost up to $2000.00 a day, with a minimum fine of $25.00 a day.

RE: A Temporary Overflow Parking Area To Be Located On A 2.920 Acre Tract
Out Of Parcel IV, Block "B" Of The Resubdivision Of Lots 1 & 2, Block
"A" And Block "B" Of Culpepper Plaza, College Station, Brazos CouGnty,
Texas.
Dear Mr. Laza,
The project is situated on South Kyle approximately 350 feet southeast of Dominik Drive
in College Station, Brazos County, Texas. The parking lot is temporary in nature and is to
be used only until a formal site plan for the existing property is compiled. The parking
.area is located within the limits of the 100-year flood plain, however, it does not extend
into the floodway.
The parking area covered by the limestone is approximately 25 feet long and 210 feet long
and follows existing grade. It is located approximately 40 .feet from Kyle South and 30
feet from the nearest existing building.. (See enclosed Site Plan) Access to the temporary
overflow parking area is achieved from the existing drives locatedon the property south of
and adjacent to the subject property. At this time no curb cut to South Kyle is being
requested.
Drainage Computations are presented as follows:
Pre-Development:
Pervious Area (A): 2.29 acres = 99752 ft2
Time of Concentration (Tc): 10 min.
100-year rainfall intensity (I): 11.64 in/hr = 2.694 X 10-4 fdsec

Since no excavation is required and the limestone is a pervious material with
approximately the same runoff coefficient as the original soil and ground cover, the
drainage from this tract of land will be basically the same for both before and after
conditions. Additionally, the proposed temporary parking lot constitutes a very small
percentage of the total drainage area of the subject tract. Because any increased runoff
from the property will be negligible, it stands to reason that no detention will be necessary.
