We can release some of the money and extend the conditions on the C.O. for the islands, however, we would want him to specify a time frame for the extension because it can't be for. an indefinite period of time. He said he thought "we" were trying to work something out with the UHaul people, and I told him that the City has it's requirements, and it's up to the contractor and the owner to decide what they want to do and then let the City know. As I promised you, I have committed the cogent paints. of our discussion to paper so we can make sure I do not miscommunicate. U-Haul is perfectly willing. to purchase on easement from you, rather than the City. 1) I believe that U-Haul should not have to get permission in the form of an easement to drain the water we have discussed, as .long as U-Haul does not injure you. The small low area or "Swale" which already rlans across your property appears to me to represent a "common law" easement because it is a natural feature where the U-Haul tract has been draining for a long time, apparently. I believe that you would want to keep your right to drain onto your neighbors downhill. (Mr. Bertrand and Homefinder Realty). I do not believe U-Haul should be treated differently.. As I told you yesterday, I am not an attorney and what I believe is not particularly important in this matter. The City has told us we must get a specific, written easement. We are complying with the City's instructions. 2) We do not plan on constructing any ditch or pipe system across your property. The water will run wholly in the Swale which already. runs across your property. This Swale is the apparent path of the natural water flow since, as I commented, "God made that hill." 3) The width of the proposed easement is 20 feet, primarily because the City of College Station generally requires .drainage easements to be .that wide, They might allow a narrower easement under certain circumstances, but in this case, I believe that to be unlikely. 000028-C,10-14(2536) 04/10/96 12:11 FAQ 409 693 4243 M D G ~~-~ COCS DEVE. C~7j004 Mrs, Josef Budig Page 2 April 9, L 996 4) Based on the common sense {and City required) design principal, I explained to you ("Q-Before" ° "Q-After"), you will not have any more water in the Swale at a particular instant of time than you do now. The water will flow in the Swale for a somewhat longer period of time as our detention pond. empties, but the depth of flow will not be any deeper than now, unless we have a massive (100 year) storm which is larger than our pond capacity. As we discussed,: this is an unlikely event.. 5) Based on the rough.size estimate I.sketched at your table, the size of the easement U-Haul would need would be approximately 280 feet long by 20 feet wide, or about 5600 square feet. The actual total may vary some what, because a ground survey is more accurate than scaling from a map, but this figure is close enough for discussion purposes, as I told you yesterday. 6) I told you I would develop an approximate cost estimate for your easement. These are the same figures that I am sending to the City. Your land is valued at $1.50. per square foot according to the Brazos Central Appraisal District, who are supposed maintain values according to "current fair market". Based on an easement of 5600 square feet, and a "damage factor" of 0.6, the fair cost of the easement. would be approximately $5,040A0 5500 X 1.5 X 0.6 = $5,040.00 As I told-you yesterday, knowledgeable experts may use a higher or lower."damage factor" and there maybe as much as 20°!° error in the Appraisal District numbers. I still expect the approximate reasonable range to lie. between $4,000.00 and $6,500.00 for an easement which is merely "written permission to drain water along the route. it has always followed". 7) The ultimate owner of the easement will be the City. They want the easement so they can maintain the drainage way if they ever need to. This is, in my opinion, not very likely. S) U-Haut is in a hurry. If you would prefer to deal with them rather than the City at a future date, we need to act. before April 16, 1496. Application of the ordinance would severely restrict the number of trucks U-Haul would be able to have on the property at any given time. Obviously, it would be an unreasonable burden to expect U-Haul to strip the decals off its trucks. every time it is necessary to parkin the spaces along Texas Avenue. But also limiting the places where the trucks could be parked would create a disincentive for U-Haul to allow customers to bring trucks into the City. U-Haul controls truck distribution through ra#es, and increased rates would dissuade customers from bringing trucks to the City. .This would have a chilling affect not only on the number of people moving into the City, but also would negatively impact the availability of equipment in the City for customers seeking. to travel out of Texas. The overall discrimination and burden on interstate commerce far outweighs the City's aesthetic interest in this ordinance. In our experience, it is unprecedented for a City to attempt in this manner to interfere with the vita( role of U-Haul in interstate commerce. 2. The Ordinance is Unconstitutionally Vaque. The genera! rule is that for an ordinance to pass constitutional scrutiny it must not be "so vague that men of common intelligence must necessarily guess at its meaning and differ as to .its application ...." Connal)v v. General Const. Co., 296 U.S. 385 (1926); See also United States. v. Lanier, U.S. , 117 S.Ct. 1219 (1997). At best, this ordinance is so vague as to leave. U-Haul or any' other reasonable person guessing as to its application. As worst, the City Planner's proposed interpretation is contrary to the ordinance itself. The key portion of the ordinance is that trucks should be "parked ... in areas appropriate to their use ...such as ...locations close to the business building(s) away from public traffic areas." First, parking trucks in the spaces along the front of the property is appropriate considering the use of the trucks. The vehicles are for the general public to use, and the front of the property is the absolute most convenient place for customers to inspect, check in, and drive away the trucks. The front parking spaces are also the most sensible place to make the general .public aware of ,the quantity and types of vehicles that are available.. In short, the trucks are for the customer, and the front parking stalls are the most appropriate place to park them considering their use. The Proposed Application of the Ordinance is an Unconstitutional Taking. The general rule is that, to avoid a taking, a land use regulation must not deny an owner economically viable use of his land. Dolan v. Citv of Tigard, 512 U.S. 374 ((1994). The proposed applicationof the ordinance denies U-Haul economically viable use of its land. As you are aware, U-Haul has been very cooperative in its efforts. to establish the new facility. Not only has U-Haul complied with al[ requirements of the City, but also has gone so far as to paint the facility using the local university's colors. In making its decision to build the new facility, U-Haul carefully analyzed the economic viability of the location. As you can imagine, U=Haul operates in a competitive industry, and a careful review of the economics is necessary before committing large sums of money to such a project. An integral part of this economic analysis was the visibility of the. location and the calculation of the equipment that could be available at the site for rental -- according to the site plan submitted and a reasonable application of local law. Based on this analysis, U-Haul invested millions of dollars in this location. The City Planner's strained application of the ordinance after the substantial U-Haul. investment not only is unfair, but also constitutes a taking because it denies U-Haul the economically viable use of the land_ 4. Summary. U-Haul feels strongly that the City should not attempt to apply this ordinance to our new facility. I then made a site visit and found the following: 1) All landscaping is in, however there are 4 trees which. appear to be very brown, and could be dead or dying: While I was there, .they called the landscaper who indicated he thinks they are alive,. but will come out and strip the leaves to hopefully promote new leaves. The contractor was informed. that living landscaping is a requirement and he should coordinate with. his landscaper. 2) The curbing. and islands are missing at the corner of the loading dock and on each side of the handicap parking spaces at the southwest corner of the building. Curbing is also missing near the shared access with the Exxon Station. I requested a letter citing a timeframe for completing these islands accompanied by an estimate for the cost of completing them. I told them we will accept a financial guarantee in that amount for those items. 3) The screening fence. is not around where the dumpster will be located (in the northeast corner of the property facing south). January 1, 1995 Site plan approved. June 10, 1996 Changes to site plan include a 2 handicap parking space row without end islands. Staff overlooks the change and approves site plan despite noncompliance. August 21, 1996 Bldg. permit issued. May 1996 Development nearing completion -Staff inspections take place during which we notice that three islands are missing -two at each end of the handicap row (not shown on approved plan due to Staff error) and one near in "L" of the building (shown on approved plan). Staff discusses whether or not to require the two handicap row islands despite the fact that they were not on the final approved plan. May 6&7, 1997 Staff observes that trucks are being stored on site in an .area not designated or approved as parking. I DID tell the contractor that there are times the building official allows the occupant of the building to begin stocking, e'tc. without a C.O. Lhope you and your wife had a nice visit with your relatives, and that you arefeeling better. As you know, the City of College Station has received several questions from various people, including Eddie Reyer and. Howard Post of American International Construction and Greg Taggart of Municipal Development Group regarding what can and cannot be done on the. new U-Haul site at 2813 Texas Avenue South. One of the questions is about lighting of the site. The City does not review and approve proposed outdoor lighting'plans. It is, however, responsive to complaints about the presence of adverse influences to adjacent properties or the general health, safety and welfare of the people. Therefore, we would suggest that should you install outdoorlighting on your site, you would take into consideration the fact that you are adjacent to an occupied residence, and so direct your lighting so that it does'not interfer with the welfare of the people in that home. Along those same lines. is the requirement of the Zoning Ordinance for the owner of commercial land to erect a fence that "properly screens adjacent residential lots from adverse influences such as noise, vehicularlights, trespass and other-adverse influences." The fence may be made of any material (except chain link or something with slats) but hall be at least six feet in height and form a solid continuous screen between the residence and commercial project. As we discussed during your visit, this fence will help mitigate adverse impact from both vehicular lights and the proposed site lighting on the adjacent house. Another question which has been received from you and Howard Post is one of where U-Haul trucks and trailers can be parked on the sites When the first site plan was submitted by Mr. Taggart of Municipal Development Group, it showed some,parking spaces with islands at the end of each. parking row approximately in the center of the'site. When the plan was revised following the review by the Project Review t~ommittee and resubmitted, those parking spaces and: islands had',,Pen removed. Whe ~. questioned about this, Mr. Taggart replied that U-Haul does not ever intend to store vehicles on this site.. While we understand that you do not propose to "store" vehicles. on your site, there will be an assorted collection of vehicles at different times, and we understand you must have a place to park those vehicles. We would suggest that since you have approximately 13 parking spaces over the minimum required by the City, that you use the spaces along the southern property line for short term parking (as opposed to storage of vehicles): of the U-Haul vehicles. We also have noticed that there is an "assorted arrangement of vehicles" parked in the large concrete area in the' center of your site. We believe that your site can accommodate thae type of parking arrangement, and would suggest that you submit a site plan which Flame of Texas ~.f~t~i tlr~lverslty 3° includes such a proposal so it can be considered by the Planning staff. Our zoning ordinance requires that sites are designed to include an island at the end. of every parking row but the same ordinance makes provisions for applicants to seek variances to certain requirements of the ordinance. We must point out at this time that parking of U~Haul vehicles in the spaces parallel to Texas Avenue will be considered additional signage, and will be prohibited at all times. The City has made a strong effort over the years to reduce the "visual clutter" by strictly adhering to .the-.sign regulations adopted: However, I repeat that should you desire to pursue a variance to those regulations, staff will process your request. The contractor superintendent, Howard Post, recently called to see if he can "lose" a couple ofparking spaces and the above information was relayed to him over the phone. He says that in order,to place the propane tank andbollards in the proposed island location in a safe manner, he will be required to use a parking space on each side of the island. Then I asked him how his ZBA application is coming and he said he is waiting for the letter Sabine told him she would write. I checked my notes, and. sure enough, Sabine, you said you would write an official letter of interpretation and send it after you routed it to others to review and critique. After he receives that, he will respond with either an application for "appeal of interpretation" or "variance" -whichever is applicable. Deaz Sirs: The purpose of this letter is to put in writing the interpretation that I have made of specific sections of the Zoning Ordinance, to inform you of the status of recent site changes that have occurred on the subject property, and to discuss your options to gain relief from the application of the City's requirements to your proposed site changes. I am also. providing information regarding the status of the seven parking spaces located along the loading dock, the requirements that still need to be met on site in this area, .and options to gain relief from the requirements. I am then also verifying in writing the requirement that the City has agreed to accept for the treatment of the ends of the handicap parking row. Section 9 of Ordinance No. 1638, the Zoning Ordinance for the City of College Station, sets the standards for parking rows for all new development and for additions or changes to existing development Section 2 of the same ordinance defines a "parking space" as "a space used for the parking of a motor vehicle". The customary English use of the term "to park" is "to put or leave a vehicle for a period of time in a certain location" (see Webster's II New Riverside University Addition). Therefore the City has determined that the storage of the U-haul trucks constitutes "parking", even though such storage may be temporary. During the initial review of the site plan for this site, City Staff inquired whether or not the site would be used for storage of the U-Haul trucks. We were assured that the site. was to be used for mini-storage warehousing with some office and showroom space. The use was not intended to be a facility that stored trucks. Around May of this yeaz, The use of the interior portion of the subject site has been changed from a truck turn-around area to an area where trucks are to be pazked. This recent change would require the following: 1. Each space must be a minimum of 9' X 20', or 9' X 20' with a 2' overhang (see Section 9.2 A. 1.) 2. Each pazking row must be adjacent to a 23' circulation aisle (see Section 9.2 A. 4.) 3. Each pazking row must have curbed, raised end islands that have a bottom contiguous with existing soil (see Section 9.2 A. 6.) Curbing may be either of the standazd 90 degree type or a mountable lay-back crab. 4. End islands must be planted or set with decorative pavers (see Section 9.2 A. 7.) Due to the fact that additional truck parking spaces have been added to the subject site, and to the fact that the spaces do not meet the specific requirements of Section 9, the City considers the site to be in violation of items 1-4 as listed and cited above. In order to avoid code enforcement procedures to be sought against you, you have three options. The first would be to provide the site improvements as listed above. The second would be to seek variances from the Zoning Boazd of Adjustment. The third option would be to seek a determination that the truck storage areas do not constitute "pazking" and are thus not subject to the requirements as listed in items 1-4 above. It is my understanding that you do not agree with my decision that the storage of the trucks constitutes "parking" and that you wish to appeal this interpretation Section 15 of the Zoning Ordinance provides the process for appeal of the Zoning Official's decisions. I am providing the application for that process with this letter, as well as a deadline schedule for application. In regards to the seven parking spaces located along the loading dock, there is an end island of 360 squaze feet required to delineate the end of the two parking rows. (see Section 9.2 A.6.). It is my understanding that you do agree that these spaces constitute "parking". Therefore all requirements as listed above in items 1-4 apply. The approved site plan shows the two pazking rows in compliance with all requirements. However, the site in this area was not built in compliance with the site plan. Items 3 and 4 have not been met and therefore aze currently in violation of the two cited sections of the Zoning Ordinance. There are two options available to you if you wish to avoid code enforcement as it would relate to the loading dock parking area. The first is to install an island in the configuration shown on the approved site plan. As I have suggested to you in the past, alay-back curb that is mountable is permitted as long as the overall height of the island is 6" above the existing pavement. Decorative pavers are permitted in lieu of landscaping if you so desire. Finally,. I wish to discuss the handicap parking row that is located in front of the southwest corner of the building. You may remember: that during the approval process, there was confusion as to whether or not there would be any parking in this area at all. The final site plan. was approved with the handicap parking shown, but there were no islands shown on that plan. The same sections of the Zoning Ordinance that we've discussed thus. far would require end islands in these areas as well. However, due to the confusion, the City missed the inclusion of the islands during its final review. Technically, it is the responsibility of the property owner to ensure that all City development codes have. been met. In the interest of fairness, however, we do not typically proceed with code enforcement of items that are missing on site. if the same items were not reflected on the approved site plan, unless those items aze related to health or safety. In this instance, we do have concerns for the safety of the pedestrians in getting to and from their vehicles. The City is therefore. requiring that there be some type of protective barrier installed at either end of!this row. In the interest of fairness, we aze not requiring this area to take the form of an island. In order to bring this issue to a close, please submit details of the protective barriers that you have proposed before they are .installed. Upon the satisfactory treatment of the area, we will verify that the area has been approved in lieu of the islands for your records. I have included a deadline sheet for the Zoning Board of Adjustment meetings for the rest ofthe year. No such equipment shaIl be used for living, sleeping, home occupation, or household purposes when parked or stored on a residential lot, or in any location not approved for such use. 8.9 PARKING AND STORAGE OF CERTAIN VEHICLES Automotive vehicles or trailers not bearing current license plates and state motor vehicle inspection stickers or not in operating condition shall be parked or stored on any residentially zoned property one in .completely enclosed buildings. Excepted from this are vehicles being repaired or .serviced in compliance with the definition of Automobile Repair Shop. 8.10 SCREENING FENCES REQUIRED L Where there is a common side or rear lot line or lot lines between commercial or industrial .land and developed residential areas, the owner of said commercial or industrial land shall erect a fence that properly screens adjacent residential lots from adverse' influences such as noise, vehicular lights, trespass, and other adverse influences. 2. Where #here is a common side or rear lot line or lot lines between appartment land and develop~ sing~le family residential land, the owner of the apartmentland shall erect a fence chat will properly screen adjacent single family residential land from adverse influences such as noise, vehicular lights, trespass, and other adverse influences. Such screening fences may be, made of any material but shall be at least six (6) feet in height and shall form a solid continuous screen between the residential and non- residential land uses. In the case of rear lot lines such screening fence shall be continued from one side lot line along the rear lot line to the other .side lot line. In the case of side lot lines such screening fence shall be continued from the rear lot line along the side lot line to tie front setback line but no farther than a point fifteen (15) feet from the street right-of--way .line. MINIMUM PARKING REQUIREMENTS 9.1 PURPOSE It is the purpose of this section to establish the guidelines for off-street parking spaces consistent with the proposed .land .use to: 1. Eliminate occurrence of non-resident on-street parking in adjoining neighborhoods. 2. Avoid the traffic congestion and public safety hazards caused by a failure to provide such parking space. 3. Expedite .the movement of traffic on public thoroughfares in a safe manner, thus increasing the carrying capacity of the streets and reducing the amount of land required for streets, thereby lowering the cost to both the property owner and the City. 9.2 OFF-STREET PARKING SPACES REQUIRED In all districts, for all uses, at the time any building or structure is erected or enlarged or increased in capacity, or at any time any other use is established, there shall be provided off- street parking spaces for motor vehicles in accordance with the requirements specified herein. A. DIMENSIONS AND ACCESS (See illustrations at end of this section): 1. Each off-street parking space for automobiles shall have an area of not less than nine feetby twenty feet 9, x 20'). The scope and extent of the review of the site plan by the Planning and Zoning Commission shall be equivalent to that of an appeal to the Project Review Committee. Subject: UHaul i MEMO TO FILE I got a call this a.m. (Wed., 5/28/97) from the contractor(s) at UHaul who. indicated they want a "temporary c.o." today. ~~ ', I told them the very .first thing they must do-is to contact the FD & Bldg Dept ', for final inspections, since those health and safety related items must be addressed by those entities. I then made a site"visit and found the followingz ~~ E 1) All landscaping is in, however there area' trees which appear to be very brown, and .could be dead or dying. While. I was there, they called the landscaper who indicated he thinks they are alive, but will come out and strip the leaves to hopefully promote new. leaves. The contractor was informed that living landscaping is a requirement and he hould coordinate with his landscaper. 2) The curbing and islands are missing at the corner`of the loading dock and on each side of the handicap parking spaces at the southwest corner of the building. Curbing is also missing near the shared access with the Exxon Station. I requested a letter Biting a timeframe for completing these islands accompanied by an estimate for the cost of completing them.. I told them we will accept a financial. guarantee in that amount for those items. 3) The screening fence is not around where the dumpster will be located (in the northeast corner of the property facing south). Jim & Wally, the location has been changed because of the location of the fire. lane adjacent to the rear of the building. The timing of this fence is to be addressed in the letter. 4) The land between the edge of the sod along the northern property line and the adjacent property to the north needs to be smoothed out'and either seeded or sodded. The land to the south of the property line has been filled and graded, but still needs to be seeded or sodded. I asked the contractor to address the timeframe for "established groundcover" in these areas in the letter. Those are all the conditions I will be listing on the C.O. if Lance & Jon are o.k. to issue it today. Are there any other conditions I have missed? Tony, the $1300+ came in last week, I believe. I had the Building Dept send whoever brought in the check up to Carmine.
