Kidd, we are officially asking that the sidewalk requirement imposed on us by the'PRC be lifted. Some of the numerous reasons which areimmediately. obvious upon critical inspection are: 1) The sidewalk will be a "sidewalk to no where." No other idewalk exists on this entire stretch of Texas Avenue. Sonic does not have it; the establishments to the south' don't have it. What useful,. practical pedestrian mobility is provided o the citizens. of College Station by a 215' sidewalkwhich dead ends into a drainage`ditch? This seems to be a situation where the master. ..`plan, while generally pertinent to the entire city, does not make sense in this particular application. 2) The current requirement is unfair. The plan and ordinance establish a desired end which is clearly applicable to new development--when streets are built, sidewalks should be installed. As you know, this is not the case here. The Texas Avenue frontage road has been inexistence many years,. and development has left the site as the last to be developed in the area. Amore equitable approach to providing a sidewalk that goes no where and won't be used is to construct sidewalks all along that strip at a later Gate, with ail owners along the frontage being assessed. for ibis infrastructure at that time. The sidewalk construction on Mr. Kidd's project_should be saved for the future :when it will actually go somewhere. Thank you for your assistance and consideration on this matter. Dear Ms. Morgan: I have tried for weeks to find out who should be responsible fir the sidewalk. at the new Goodyear Store 'not meeting .the A. D. A. requirements. I ° would like to relate to you my findings. Let tae begin. wit'n when I .first found out that I would be build~.ng a s-tore for Goodyear in College Station, I decided to use an Engineering firm in College Staticn who had worked with the City and was familiar with requirements. In conversation with. the Se11er of the land that I purchased, I was told 'that Municipal Develcpment Group (Gregory Taggart) did a lot of work for the Ci_•ty and this firm .would be recommended to do whatever work that was needed. To make along story short,. .Gregory Taggart with Municipal Development Group devE7_oped a site plat: for the p;-oject (w'nich did not include a sidewalk because he said that one would probably not be required) and he surmitted°-the drawing (site plan) to your office and a permit .was issued for us to begin the site work which included t'ne driveway.. What rap~ened next was that a meeting was held which you (Geronica) and Gregory Taggart were in attendance and it .was decided that all new construction was to have ~ sidewalk. As it turns out, he's partly right - MDG DID turn in a site plan for consideration that did not show"a sidewalk. The PRC voted to require a sidewalk, and the PRC report (which was sent to Mr. Kidd) stated ."A sidewalk is required-~ along thee Texas Avenue frontage road as per the.5idewalk Master Plan. The sidewalk .should begin at the Texas Avenue and Brothers intersection with a ramp meeting ADA requirements and end at the property line near the existing drainage ditch. Lf a variance is requested, submit a formal request by noon on Thursday....". ~~ A variance was requested, taken to P&Z on 8/4/94 where it was denied, but with the condition to "require the City to complete their portion of the sidewalk near the drainage cap including the handrail with the construction of th3e sidewalk for the Goodyear Tire Store.." BUILDING PERMIT #9402671 Dear Mr. Kidd: It has been several weeks. since I have spoken with you, Mr. Prickett or any contractors regardung the repairs to the sidewalk/driveway at the above referenced site. It was my understanding in my previous conversations with you and your contractors that the redesign and repairs would be accomplished within a short time frame. The Goodyear site received a conditional certificate of occupancy on January 26, 1995 and the only condition was that repairs would be made to the sidewalk/driveway apron on the northeast side of the site to meet all American Disabilities Act (ADA) requirements. Goodyear still has a CONDITIONAL CERTIFICATE OF OCCUPANCY and will continue to have.this status until the repairs are made. The City has allowed this situation to continue beyond the original deadline on the certificate of occupancy because it was obvious 'to us that you were working with contractors on a solution. Ho.vever, contacts have ceased and there has been no action in several weeks, because of this our concern is that you are not going to make the repairs. A landscape plan was .approved on August 2, 1994, as part of the site plan approval process for the development of the Goodyear site. The landscaping on the site has since died. The local management has not replaced the .landscaping and thus, is in violation of Section 11.6 of the College Station Zoning Ordinance.. Section 11.6 states: "Landscaping/Streetscaping shall be maintained and preserved in accordance with the approved Landscape/Streetscape Plan. Replacement of dead landscaping/streetscaping must occur within forty-five (45) days of notification by the Zoning Official or his delegate. Replacement material must be of similar character and the same or higher point total as the dead landscaping." This correspondence is to serve as a warning of potential penalties. Failure to replace the dead landscaping, within forty-five (45) days of receipt of this notification, shall constitute a violation of this section of the Zoning Ordinance. Penalties for violations of the Zoning Ordinance may range up to $2,000 dollars aday/ per violation. Thank you for your cooperation in this matter. As discussed earlier with...your. associate, .John .Conquest, several different projects have been developed which drain into the detention basin adjacent to this site since the .original basin. design report included in your report as an appendix, .was prepared: As a result, we believe that the limited. capacity of the basin has been reached, if not already exceeded. Theseprojects include the First Federal expansion, the Brazos Valley Schools'Credit Union Site, the Albertson's Expansion as `well as the Walmart Expansion, all of which are either approved or were submitted prior to this application.. Therefore we believe that your management of the storm water runoff must be handled by one of three means. Your. first option is to re-analyze the basin using both existing and currently proposed development in the. area, as well as the existing volume of .the basin. Should capacity be available,.. this .project would be allowed to .drain as proposed in your report. Your .second option is to analyze the basin including all..current and proposed upstream development in order to determine the timing of the: outflow: of the basin in an attempt to show that the peakdischarge from your small site would in fact be handled by the existing facilities prior to the timing if the peak basin discharge. Your third option would be to provide on-site detention pei- our normal. ordinance .requirements. Instead of requiring that the driveway be shared and centered on the property line, they want to keep the driveway where it is and provide for a cross access easement for the property to the west. I do not have a problem with this. There is about a 15' difference in the location of the drives between the 2 alternatives. He plans to make such notes on the site plan and to submit a x access easement for this in the near future. He will also tell his client that this dvlpmt is conditioned on this. Also, their driveway radius is on the ROW in front of the property o the west. He argues that they cam legally do this since it's in the ROW - especially since the driveway will be shared by this future dvlmpm. That's. what we decided in JC's office this morning..
