(94-404) A Project Review Committee. meeting was held: Wednesday, April 6, 1994 to discuss the above mentioned parking lot plan. City Engineer David Pullen moved to approve the site plan with the following conditions: j ~' CONDITIONS OF APPROVAL: A 6' wide sidewalk adjacent to the existing .curb is required along Deacon with ADA ramps at the entrance drive for wheelchair access. Staff Planner Kuenzel seconded the motion which passed unopposed (3 - 0). The following comments were made by the various reviewing agents: ELECTRICAL: _ It is the developer's responsibility for the placement of all conduit and for payment of twenty percent of the cost for electrical service. Submit a letter requesting electrical service and agreeing to pay the associated costs. Submit electrical loading demands and size of service. _ Provide easements to cover the transformer and service to the building. A transformer could be placed in the existing public utility easement. Wings N' More Case #94-404 Page Z of 2 PLANNING: _ Extend the curb around the perimeter of the parking lot along the alley to either side of the property. _ Submit screening details for the proposed dumpster location. Screening must be either wooden, brick or vegetation or a comgination thereof. Revise the parking legend to include the outdoor seating area. One parking space is required per .100 square feet. _ Submit. a landscape plan. Steetscape requirements must be met for minor arterials. G.T.E.: _ Telephone service lines will be placed in the same trench as electrical lines as much as possible. Place conduit from:. the. building to stub out 2' from the transformer.. Coordinate telephone service with G.T.E. Representative Laverne Akin at (409} 821-4723. WATE}2/WASTE WATER: _ Provide water demands, sanitary sewer loadings and water meter location and size. FIRE: _ .The building must be loca ed within 150' of the street to avoid designating fire lanes. As shown on the site plan, the building is located 154' from the street and would. require fire lanes throughout the site. Either move the building 4' closer to the street or provide fire lanes. ENGINEERING: A variance request must be submitted and approved to address the .driveway throat length and location. Show the opposite and adjacent drive. openings on the site plan prior to consideration of the variance request by the Planning and Zoning .Commission. Submit the variance request and revised site plan by noon on Friday, April 15, 1994 to be considered by the Planning and Zoning Commission on .May. S, 1994. _ Detention flow must be carried to the edge of the pavement. SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE REVISED SITE AND LANDSCAPE PLAN ATTACHED AND 4 ADDITIONAL REVISED SITE PLANS ONLY TO CONTINUE WITH. PHASE II OF THE BUILDING PERMIT PROCESS. APPEAL PROCESS:. An applicant may appeal the decision of the Project Review Committee to the Planning and Zoning Commission. within five. days after the PRC Committee meeting. Failure to .appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether under state or federal law. An applicant. appealing the decision of ,the PRC shall file ten copies of the. final site plan as approved by the PRC, showing all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until said copies are on file, no further development approval shall occur, and no further .action by the Commission shall take place. An applicant may appeal only certain aspects of site plan review, and in the absence of discretionary review by the Commission, or review pursuant to a petition, all other aspects of the site plan shall be final. Any notice of appeal shall state with particularity .the aspects which are to be appealed. Coordinate appeal process through Development Coordinator Shirley Volk at (409) 764-3741. AGENDA I'T'EM NO. 10: Consideration of a drivewayvariance request for the proposed Wings N More drive' thru restaurant to be located at 1815 `Deacon Drive. (94-4.04} City .Engineer Pullen presented the staff 'report and recommended that the. variance request be denied. The site is able to access Deacon Street. by connecting to the adjacent properties via the platted access and parking easement, thereby connecting. to the existing driveways. In doing so, the situ is able to comply with the driveway access policy. It may be.in the interest of the .applicant to widen one or both of the driveways to improve 'traffic flow by providing more turning.. space. Commissioner Mariott stated that. there are too many existing driveways in this area. and their close proximity to each other would not be allowed under he current ordinance. There is an existing traffic problem in the area. and allowing. an additional. driveway would only. add to the congestion. Commissioner Gribou, stated that. there are other alternatives available including working with the surrounding property owners to develop a plan that meets .the current access ordinance.. He moved to deny the driveway variance request for the '.proposed Wings N' More drive thru restaurant to be located' at 1815 Deacon Drive. Commissioner Herring seconded the motion which passed unopposed {6 - 0). AGENDA ITEM NO. ll: Other business. Transportation Planner Hard informed the Commission. that the City received funding ,in the amount. of $1.1 million to develop the, proposed Bike Loop system. City .Planner Kee updated the Commission on the outcome of a` recent Traffic Management Team meeting` in which the Alpha" Phi Sorority house was discussed. The Team. recommended that next year a block. party permit be denied so that Athens and Olympia. cannot be barricaded. Staff is currently.: sending letters informing the sororities of this and suggesting that if' a shuttle system ~ is worked out in the future, the block' party'., permit may be reconsidered. Assistanfi Director of Economic and Development Services Callaway invited the Commission to a reception for City Engineer Pullen on Friday, .May 6, 1994;'from 3:00 to 5:00. p.m. Mr. Pullen is moving to the City of Longview where he wily be their new City Engineer. AGENDA ITEM NO: 12: Adjourn. Commissioner Mariott moved to adjourn the meeting of .the Planning and Zoning Commission. Commissioner Herring seconded the motion which passed unopposed: (6 - 0}. (94310) City Planner Kee presented the staff report and recommended approval. of the preliminary plat as submitted. This plat was approved by the County Commissioner's Court on May 2, 1994. Commissioner Herring moved to recommend approval of the preliminary plat of the Spencer's Cove Subdivision as submitted. Commissioner Smith seconded the motion which passed .unopposed (5 - 0). AGENDA ITEM NO. 11: Reconsideration of a driveway variance request at 1815 Deacon Drive for the proposed Wings N' .More drive thru restaurant. (94-404) Transportation Planner Hard informed the Commission that at their last meeting, the proposed variance request was denied unanimously. Because the applicant was not present at that meeting, he has requested that the variance be reconsidered. Staff recommended denial_of the variance request because the proposed.. driveway access is inconsistent with the parking and access easements that were dedicated on this property and is not. in compliance with..the Driveway Access and Location. Ordinance. The proposed request does not meet three of .the fourstandards outlined in that ordinance. Staff received .faxes in .favor of the variance request from the two adjacent property owners. The adjacent property owners do not wish to share a driveway with the subject 'property. Lawrence Link of Link. Construction approached the Commission and stated that Kling Engineering met with the City, at the. very beginning of the project to ensure that all ordinance requirements were being met. At' all of these meetings, the driveway access was shown where there is an existing: driveway opening. There was .nothing ever said. about not being able to use the existing driveway. A shared driveway will interfere with the existing intersections.. The. proposed development will combine four lots and allow only one driveway instead of individual driveways. Currently, the' property owners have a vested right to use the existing curb cut that has been. there since 1979. Harold Hogard owner of 3230 Texas Avenue, the Apartments Plus office building, submitted a .letter from the. Apartments Plus manager in .opposition to a shared driveway. He also presented a letter in opposition to a shared driveway from the Dwayne Rhea, the owner of the adjacent car wash. Mr. Hogard stated that the driveway ordinance is not in the best interest with regard to safety and the welfare of .the general public in this particular application. There will be a problem with a large amount of .cars sharing. the adjacent driveway of the Apartments Plus. building. Mr. Hogard also expressed concern with the maintenance. responsibility of a shared driveway on his property and the cost of providing access to the Wings N' More patrons. Steve Musser of 716 Canterbury informed the Commission that he was hired by the owner Mark Dennard to work on the project and was in the meetings with Kling, Engineering and City staff. He stated that the problem with the .driveway opening was not brought to their attention until the Project Review Committee meeting on May 5, 1994: Mr. Muster stated that all .other ordinance requirements have been met. He expressed concern with traffic safety and creating a problem for the .adjacent property owners. The owner of Wings N' More restaurant Mark. Dennard approached the Commission and stated that he does not want to be a burden to the surrounding .property owners. In order to run a viable business, there must be access to the front of the property so that the flow of traffic is into the property and not on adjacent properties. P & Z Minutes May 19, 1994 Page 6 of 7 Bonnie Hogard, a co-owner of the Apartments Plus building. and local real estate broker stated that if a shared driveway was required, the .property would be difficult to sell in the future and possibly cause a loss of approximately $50,000 on the sale of the property. Commissioner Lane moved to grant the driveway variance for the. Wings N' More restaurant to be located on lots 5, 6, 7 and..8, block 16 of Southwood Valley Section 3. Commissioner Smith seconded the motion. Chairman Hawthorne stated that access to the subject .property is a problem and there are no answers primarily because of the way it was developed and a recent change in the ordinance. If a traffic. generator is placed on the vacant tract, there is going to be a traffic problem regardless of what is done. The best alternative .seems to be to try and compromise and .minimize the raffic problems.. It does not seem to be a .viable option in this particular case to only have one access point through someone else's property. The motion to grant the variance request passed (3 - 2); Commissioners Hall. and Herring voted in opposition to the motion. AGENDA ITEM NO. 12: Other business. There was no other business. AGENDA ITEM NO. 13: Adjourn. Commissioner Lane moved to adjourn the .meeting of the Planning and Zoning Commission. Commissioner Herring seconded the motion which passed unopposed (5 - 0).
